OPENING REMARKS - Mayor Greg Cox Mayor Greg Cox opened the meeting announcing this is in response to concerns expressed to the Council regarding the environmental conditions and development policies in the Otay Valley Road area. The City recently formed a Redevelopment District in the area which will assist in financing public improvements necessary i f controlled and quality development is to occur. Mayor Cox added the purpose of the meeting tonight was for the opportunity to address these major questions about hazardous materials and pollution and to receive input from the concerned citizens regarding the hazardous materials and pollution. ANSWERS TO WRITTEN QUESTIONS Mayor Cox asked the people in the audience if they had any questions whatsoever to write them down on forms provided by staff members. Mayor Cox then highlighted Council's actions regarding hazardous materials and pollutions. Beginning in September 1982 when the Council expressed support of the concept of regional management of hazardous waste, as proposed in the SANDAG document entitled The Safe Management of Hazardous Waste through April lO, 1984 when the Council~opt'E~'d'Ordinance 20T4, prohibiti~ certain uses and making others subject to a conditional use permit in the Industrial Zone. Community Meeting - 2 - May lO, 1984 Valle Lindo Elementary School Chronologically the developments occurring as reported by the Mayor were: 1959 (3mar Class 1 Dump opened. lg63 Otay Landfill opened. Landfill served as an open burning dump until 1967 and a portion of the site was used and accepted hazardous Class I waste from August 1963 until November 1980. 1970-71 The area was prezoned and annexed to the City. 1970-74 The present P~C., R-l, I-P, I-L and A-D zoning patterns were established. 1971-74 The "Brandywine" residential subdivision was developed (west of Brandywine around Mendocino and Sonora Drive). 1975 Otay Industrial Park Subdivision was finalized. 1977-79 "Point Robinhood" residential subdivision developed. 1981--82 BKK conditional use permit approved in March 1981 with operating permit issued by the State in December 1982. 1982 Omar Class I dump site closed June 1982. 1983 Hyspan industrial bull ding permit issued. The Mayor then reviewed some of the questions most frequently asked and the answers to those questions: 1. Why doesn't the City prohibit transportation of hazardous materials along 1-8057 2. How bad is the air quality in Chula Vista and the Otay Valley? 3. Can the BKK plant withstand a 4.0 earthquake? 4. Why did the City create a Redevelopmerit District on Otay Valley Road? 5. Is it true the clay layer protecting the underground water table from the Otay Landfill is destined to fail? 6. Does the BKK transfer station accept hazardous waste from all of Southern California and surrounding states? At this time, Council members, the Mayor and City and County staff responded to questions submitted by the audience. Generally, the questions asked were: Community Meeting - 3 - May 10, 1984 Valle Lindo Elementary School 1. The makeup of the Environmental Task Force. 2. A buffer zone in the Redevelopment District between Industrial and Residential. 3. Toxic wastes being trucked into the BKK plant from Arizona and New Mexico. 4. Concerns with the clay layer beneath the toxic pits of the landfill on the Omar Site. 5. The leaching of toxic chemicals on the Otay Landfill. 6. Can the Sander resolution be rescinded and a trash-to-energy plant still come in to the City. 7. The "capture of methane*' at the Landfill and the impact it would have on that area. 8. Questions pertaining to the Otay Valley Road Redevelopmerit area: its finances and possible merger of it with the Bayfront project. g. The ~span noise problem. lO. Plans to upgrade the road in the Otay Valley area. ll. Concerns with southeast Chula Vista being designated as the area for the environmental impacting industries. 12. Questions to the Mayor regarding his recommendation to change the name of the Border Patrol Division in Chula Vista. ORAL COMMUNICATIONS Presentations were made by A.W. Hall, 1675 Point Reyes Court; Larry McKenna, 1347 Mr. View Lane; Bud Pocklington, 656 Glover Place~ Robert Maxwell, 373 Betland Way; D. David Foreman, 1654 Pt. Cabrillo Ct.; Ignacio Franco, 3384 Pegleg Mine Rd., Oamu1; Joy Sheresh, Chairman, Safety Commission and Bill McBreen 1650 Pt. Sal Ct., Chula Vista. Their comments were in summary: 1. A request to show the Citizen's Action slide sho~. 2. Question with the people serving on the Boards and Commissions in the City with recommendations they be replaced with other than "yes" people. 3. The potential conflict of interest by Councilman Scott. 4. The Council's right and authority to control the land in the Redevelopment District. Community Meeting - 4 - May 10, 1984 Valle Lindo Elementary School 5. The earthquake faults and the impact it would have on the area. 6. Various and general questions pertaining to air quality and toxic waste. 7. Concern that Supervisor Tom Hamilton was not present at the meeting. A ten minute break was called at 8:55 p.m. and the meeting reconvened at 9:05 p.m. Council discussion followed regarding the request to show the slide presentation. Councilmen Malcolm and Moore stated they were present tonight to hear the concerns of the citizens and that the slide presentation should be shown at a regular scheduled meeting at a time when a full Council will be present. MSUC (Moore/Malcolm) to review the Council schedule and set a date for a Conference iRedevelopment Agency or City Council); invite the Supervisor of the First District and the Candidates for that Office and schedule the showing of the Citizen's Action Network's slide presentation. Councilman Malcolm suggested the meeting should be set prior to the election. Mayor Cox announced that Chul a Vista Sanitary Service has dropped the appeal for the truck maintenance operation site in that area. City Attorney Hatton noted that since the appeal has been dropped, Councilman Scott will have no potential conflict of interest and can participate in discussions of the Redevelopment Project. Mr. Larry McKenna representing the Citizen's Action Network submitted the following requests: 1. Asked the City Council to establish a policy that a trash-to-energy plant in the City would not be welcome, whether in the City or within its Sphere-of-Influence. 2. Asked that this policy be incorporated into the General Plan and the Redevelopment District Plan. 3. Commended the Council for initiating action to remove the general industrial "cloud" from the Redevelopment Project area and converting it to light, clean industry. 4. Appreciated the City's mutual aid agreement which will speed up fire protection in the area. 5. Commended the Council on the positive actions taken by them by creating the ad-hoc committee on environmental concerns. Community Meeting - 5 - May 10, 1984 Valle Lindo E1 ementary School 6. Noted the positive actions taken on the part of this committee to do some water testing at the Apache Dump site. 7. Commended the County Public Works Department for listening to the concerns of the citizens regarding the closure of the Class I Otay Dump. 8. Delighted to hear Chula Vista Sanitation Service will look for a home elsewhere than that proposed which would be located 850 feet from a residential area, 9. Will look forward to the Redevelopment Project area if strong comments from the people that are being put on the committees (and commissions) are not just "yes" people and they would not just bow to the authority of the City Council. lO. Designation of a Project Area Committee with citizen representatives designated by the 1 ocal Homeowner's Association. ll. A request for funding for a Health Registry Baseline Study for the southeastern portion of Chula Vista. 12. Get City support for appropriate air, water and soil testing to determine the existing environmental conditions. (Giving the proliferation of toxic wastes in the Otay Valley during the past 25 years, the risk of contamination is substantial). 13. To amend the Redevelopment Plan and General Plan to exclude toxic waste dumps and Sander type garbage burning plants. 14. To amend the General Plan and Redevelopment Plan to provide for limiting Industrial uses in the Otay Valley to light, clean industry. 15. To review the existing zoning performance standards and related enforcement practices - (noise complaint procedures). 16. To schedule a public hearing on the infectious waste incinerator operated on Mace Street (just outside the City limits of Chula Vista) by Thermal Construction, Inc. 17. To appoint a representative from the City (from the Engineering Department) to work with the County Department of Public Works to examine issues and permits regarding Class Type I dumpsites. Mrs. F1 ora McKenna questioned whether Councilwoman McCandliss was able to get certain statistics she requested regarding infant mortality and the health survey on such. Councilwoman McCandl iss explained the difficulty she has been experiencing in getting these statistics to Mrs. McKenna but assured her that she will continue to work on it and will send it to her as soon as possible. Community ~eting - 6 - May 10, 1984 Valle Lindo Elementary School COUNCIL COMMENTS The Mayor and Councilmembers thanked the audience for their attendance and participation. MAYOR'S CLOSING REMARKS Mayor Cox noted a letter received from by William Harrington, Lobbyist for San Diego, asking for support of the sewer treatment plant. MSUC (Cox/McCandliss) to communicate the City Council's support to the appropriate Congressional Committee to seek the allocation of $55 million dollars to help initiate a corrective action regarding raw sewage coming in to San Diego.
