Home My WebLink AboutReso 1974-7243 Form No. 342 Rev. 9-71 RESOLUTION NO. 7243 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND COUNTY OF SAN DIEGO FOR THE IMPROVEMENT OF ALBANY AVENUE FROM TREMONT AVENUE TO MAIN STREET - GAS TAX PROJECT #195 AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and the COUNTY OF SAN DIEGO, a political subdivision of the State of Cali- fornia, for the improvement of Albany Avenue from Tremont Avenue to Main Street - Gas Tax Project #195, dated the 26th day of March , 1974, a copy of which is attached hereto and incorporated herein, the-same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. ~;~ La e F. DATED City Clerk AGREEMENT FOR THE IMPROVEMENT OF ALBANY AVENUE IN THE CITY OF CIIDLA VISTA THIS AGREEMENT, executed this 26th day of March , 197....i, by and between the CITY OF CHULA VISTA, CALIFORNIA, a municipal corporation, hereinafter called the "City" and the COUNTY OF SAN DIEGO, a political sub- division of the State of California, hereinafter called the "County". WITNESSETH WHEREAS, the City and the County desire to enter into a joint agreement to improve a portion of Albany Avenue within the City by grading and paving from the intersection of Tremont and Albany Avenue, south to Main Street, a distance of approximately 0.1 miles, hereinafter refe=ed to as "The Proj ect"; and WHEREAS, the City and the County desire to proceed with the construction of said improvement and to share in the cost of such construction according to this agreement. NOW THEREFORE, IT IS MUTUALLY AGREED by and between the City and the County as follows: 1. The City and the County shall cause to be improved Albany Avenue within the City Limits from the intersection of Tremont Street and Albany Avenue, south to Main Street, a distance of approximately 0.1 miles as herein- above described. 2. The City shall be responsible for all actions necessary to complete the improvement of Albany Avenue including rights of way, construction, engineering, and administration. The improvement of Albany Avenue shall provide for a standard forty foot (40') wide residential street in conformance with City of Chula Vista street standards. COry~,y OF SAN,nrEiO -'.."" . County will pay a lump sum of $4,500 toward the cost of this project when completed. Said sum is payable within thirty (30) days after receipt of billing from the City stating that the construction of the project has been completed to the satisfaction of the City Engineer. 4. The project shall consist of widening Albany to a paved width of a forty-foot (40') residential street. 5. This agreement shall terminate three years from the date of its execution or upon completion of construction of the project, whichever date is sooner. 6. This agreement may not be modified, amended, or otherwise changed unless by an amendment in writing executed by the parties hereto. 7. The County, its agents, officers, and employees shall not be, nor be held liable for any claims, liabilities, or for any damage to the improve- ments specified in this agreement prior to the completion and acceptance of the same. County shall not be liable for damages for any person or property injured by reason of said work or improvements, and the City hereby agrees to hold and save harmless the County, and its authorized agents, officers, and employees against any of the foregoing liabilities, and to pay all and any costs and expenses incurred by the County of account on such liabilities. The City further agrees to protect said County and the officers thereof from all liability or claim because of, or arising out of, the use of any patent or patented article in the construction of said improvements.
