HomeMy WebLinkAboutReso 1974-7230 RESOLUTION NO. 7230 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA PROVIDING AN EXPEDITIOUS METHOD FOR ADJUSTING TAXICAB RATES IN THE CITY OF CHULA VISTA AS A RESULT OF THE CURRENT ENEP.GY CRISIS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the United States is presently faced with an energy crisis resulting in substantially increased costs for petroleum fuels of all kinds, especially gasoline, and WHEREAS, the cab operators in the City of Chula Vista pur- chase substantial amounts of such fuel for the operation of their cabs, which accounts for a major portion of their operating expenses, and WHEREAS, said fuel costs are increasing at such a rapid rate and at unpredictable times, it has become difficult, if not impossible, for the taxicab industry to make application to the City Council for increased rates based upon increasing expenses resulting from the energy crisis, and WHEREAS, the City Council of the City of Chula vista concurs with the City Council of San Diego in the recognition that one of its duties is to establish just and reasonable rates for the taxicab in- dustry, which now cannot be reasonably forecast into the future because of the fluctuation in operating expenses based upon increasing fuel costs, and vIHEREAS, it is now evident that in order to affect just and reasonable rates, an expeditious method of rate adjustment must be established which will allow for a more rapid adjustment of the rates as well as make the rates uniform throughout the San Diego metropoli- tan area since it is clearly unreasonable to have a variety of rates requiring a complex metering system for vehicles that operate daily on an inter-city basis, and ~VHEREAS, a procedure has been established in the City of San Diego, which procedure is recommended by the City Manager and the Finance Director, as a basis for adjusting taxicab rates on a monthly basis, and WHEREAS, said procedure, as approved by the City Council of the City of San Diego, is substantially as follows: A. That on or before the tenth day of each month, all cab operators legally operating within the City of San Diego shall file the following data as experienced in the previous month for the following items: 1. Number of paid trips; 2. Total miles driven by taxicabs; 3. Number of these miles paid for by customers; 4. The revenue from taxicab operations; 5. Other revenues, such as advertising, received in connection with taxicab operations; - 1 - 6. Cost of gasoline consumed; and 7. Number of gallons of gasoline consumed. B. Each cab operator as set forth hereinabove shall submit verified data supporting the cost of gasoline set forth in the reports as required above, which shall be subject to audit and supported by copies of invoices for gasoline purchases. C. Each cab operator shall submit on a monthly basis the monthly report form on file in the office of the City Clerk as Document No. D. Failure of any single cab operator to submit a report by the tenth day of each month will result in a denial to all operators of any increase in costs as evidenced by the results of reports as submitted by said cab operators. E. The following formula shall be utilized in determining the allowable taxicab flag drop rate: Comparative Cost and Rate Ranges Average cost of Allowable Flag Gasoline Drop Rate 29.2<:: through 33.2<:: 60<:: per 1/5 mile 33.3<:: through 41.3<:: 65<:: per 1/5 mile 41.4<:: through 49.4<:: 70<:: per 1/5 mile 49.5<:: through 57.5<:: 75<:: per 1/5 mile The City Manager shall notify the cab operators, by the 20th day of each month, of the allowable flag drop rate for the next ensuing thirty-day period, commencing on the first day of the following month. The allowable flag drop rate shall be determined by the cost of gasoline based upon an average industry-wide cost as determined by the facts set forth in the reports submitted as required herein and in accordance with the above schedule. Such adjustment shall be automatic upon proper presentation of evidence by the cab operators as specified herein. F. The rates which may be adjusted pursuant to this reso- lution shall in no event exceed 75<:: per 1/5 mile, nor be less than 60<:: per 1/5 mile, unless and until a full rate hearing shall have been held before the City Council. and, WHEREAS, rather than the City Manager of the City of Chula vista duplicating the actions stipulated in said procedure, it is deemed reasonable to ascertain the rate established by the City Mana- ger of San Diego after the hereinabove procedure has been followed. NOW, THEPBFORE, BE IT RESOLVED by the City Council of the City of Chula vista that the City Manager of the City of Chula Vista be, and he is hereby authorized and directed to contact the City Manager of San Diego on the 20th day of each month and determine the rate that has been fixed pursuant to the procedure set forth herein- above and to notify local taxicab operators that said rate shall be effective. - 2 - /1-/- / - 1-[' h~ .L_, / ~ /r'/->\ \" j "j I ~.... ,;.- \ ,-- BE IT FURTHER RESOLVED that the City l1anager of the City of Chula Vista be, and he is hereby authorized and directed to forward a statement of said rates to the City Council. BE IT FURTHER RESOLVED that this resolution is adopted in accordance with the requirements of Section 31.2 of the Chula Vista City Code and shall constitute a resolution authorizing the amend- ment of the existing Resolution No. 7194 establishing current taxi- cab rates in the City of Chula vista. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to forward a certified copy of this resolution to the taxicab operators in the City of Chula vista and to the City Manager in the City of San Diego.
