LEGISLATIVE COMMITTEE REVIEW OF AB3808 (COSTA) In order to be able to consider a position on AB3808, which will be before the full Assembly during the week of April 23, the Council requested a report on the bill at this time. In summary, the bill establishes that in a rent control situation "fair return on investment" to a rental property owner would be based on current market value of the property. Recent court decisions have based the "fair return on invest- ment" calculation on the property owner's investment in the property or on Net Operating Income. The bill would also exempt from any rent control new construction units not involving public financing, single-family homes, and voluntarily vacated units. Mobilehome park rental spaces would be included in this legislation. Councilman Malcolm spoke in opposition to the bill indicating the City should have the right to control rents whenever possible. He reported that the consensus of the Legislative Committee is to take no action on this bill. Councilman Scott discussed rent control examples in other cities, which haven't solved any problems. Councilman Moore agreed that rent control is not economically viable and he questioned the effect of this subject on the City's binding arbitra- tion ordinance. Mr. Cliff Roland, 1100 Industrial Boulevard, I-6, Chula Vista, 92011, remarked that although he has never advocated rent control, passage of this bill would send citi- zens to City Hall seeking remedies for rent increases. MSC (Scott/Moore) to oppose AB3808. (Councilman Malcolm voted "no.") Councilman Malcolm indicated he opposed the motion because he could not advocate this subject either way. He suggested it may behoove the City to control and rent out spaces in a mobilehome park. This procedure could be accomplished by using Redevelopment funds to condemn property. MSUC (Malcolm/Moore) direct staff to report back on investigating the Redevelop- ment Agency's acquisition of land for mobilehome parks for rental purposes (not for construction of condominiums) to provide housing at reasonable, affordaSle rates. ~" i Adjourned Regular City Council Meeting -2- April 19, 1984 In response to Mayor Cox's request for an update on displaced mobilehome sites, Community Development Director Desrochers stated a continued search for sites:.has been underway for two years. To date there is no land within the City limits that is zoned for such use. The Planning Department is assisting the search and new sites may become available in the eastern areas of the City. COUNCIL COMMENTS a. Mayor Cox commented on a letter from Mayor Hedgecock which requested cities to send letters in support of San Diego hosting a Superbowl game. MSUC (Cox/Malcolm) ask staff to prepare a letter of support to be forwarded to Mayor Hedgecock's office requesting San Diego be allowed to host a Superbowl game. b. Mayor Cox discussed the possibility of obtaining a Lanier Message Recording System on a two-week basis. MSUC (Scott/Cox) schedule a presentation by Lanier representatives at 6:30 p.m. on Thursday, May 3, 1984, prior to the regular Redevelopment Agency meeting.
