RESOLUTION NO. 7498 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE DEPARTMENT OF FINANCE OF THE STATE OF CALIFORNIA FOR CONDUCTING 1975 MID-DECADE CENSUS AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the Clty of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certaln agreement between THE CITY OF CHULA VISTA, a municipal corporation, and THE DEPARTMENT OF FINANCE OF THE STATE OF CALIFORNIA, for conducting 1975 mid-decade census dated the 29th day of October , 1974 , a copy of which is attached hereto and lncorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the sum of $20,000 be, and the same is hereby appropriated from the unappropriated surplus of the Planning Fund and $10,000 is hereby appropriated from the unappropriated suplus of the General Fund for the purpose set forth hereinabove. BE IT FURTHER RESOLVED that the Mayor of the Clty of Chula Vista be, and he lS hereby authorized and dlrected to execute said agreement for and on behalf of the City of Chula Vlsta, Presented by ~/. /.~. ~.r/ I" /~. DATED , Clty Clerk of the City that the above lS a full, , and that the same has City Clerk Contract No. 2012-8 AGREEMENT THIS AGREEMENT made and entered into this 29th day of October . 19 ~. at Sacramento, California, by and between DEPARTMENT OF FINANCE of the State of California, hereinafter called the Department, and the City of Chula Vista hereinafter called the City: WIT N E SSE T H : WHEREAS, it is provided in Section 2107.2, Streets and Highways Code, that any city or city and county may apply to Department to enumerate its population or the population of any inhabited territory annexed to the city subsequent to the last federal census, and WHEREAS. said Section 2107.2 provides that Department may make the enumeration if in the opinion of Department there is available ad- equate information upon which to base the enumeration, and WHEREAS, City desires to have Department enumerate population of City and Department is willing to make such enumeration, provided adequate information is available upon which to base the enumeration, NOW. THEREFORE. it is hereby mutually agreed between the parties hereto as follows: 1. City shall provide such data as are requested by Department in order that Department may determine whether adequate information is available upon which to base an enumeration of population. In the event Department determines that adequate information upon which to base an enumeration of population is not available it shall inform City and shall Form BD-1l5(b) Rev. 01174 Enumeration ,Page Two. explain to City the basis for this determination and in such case Department may render no further services hereunder. However, should Department deter- mine that adequate information upon which to base an enumeration of popula- tion can be developed Department agrees to proceed to perform such further work as it deems necessary in order to make an enumeration of population and if requested to do so by City, Department shall file a certified copy thereof with the Controller pursuant to Section 2107.2, Streets and Highways Code. It is further mutually understood and agreed that Department shall have full and complete charge in the selection and application of the meth- od or methods used in enumerating the population of City and that City shall certify as to the accuracy of all information furnished from local records for use in preparation of said enumeration of population. 2. If City is unable to provid~ adequate information upon which to base an enumeration, the Department, at the request of City, may provide add!- tional service directed toward the development of data for population enu- merating. Such service may include the design of procedures and provision of materials and data processing services for enumeration work carried out under the administrative guidance of and at the expense of City. It is mutually understood that Department shall have full and complete charge in the design of the enumeration, definitions used, and interpretation of results although City will retain the right to include materials and questions of its choice subject only to final approval by the Department. 3. Within thirty (30) days after notification by Department to City of completion of such enumeration of population, City agrees to reimburse Department for all costs incurred by Department in connection with the per- formance of this agreement. Said costs shall include (1) a standard fee determined by reference to a scale of charges based upon past cost experience Form BD-115(b) Rev. 01174 Enumeration / f! -;\19K Page Three of the Department and the size of the City as officially established. (2) Where applicable, an additional cost per data card for materials, data processing and programming. (3) When available and at the City's request for permanent possession, a charge for data tapes. The standard scale of charges and the unit card charge are attached as Appendix A, which is by reference hereby made part of this Agreement. 4. Department shall furnish a statement to City of al1lOunt due from City as hereinabove provided upon the completion of the services to be rendered under this Agreement by Department and City agrees to pay Department the 8I1lOunt due as shown in such statement within thirty (30) days after receiving such statement.
