ROLL CALL MEMBERS PRESENT: Mayor Cox; Councilmembers McCandliss, Nader, Malcolm and Moore MEMBERS ABSENT: None STAFF PRESENT: Deputy City Manager Morris; City Attorney Harron 2. RESOLUTION 15380 AUTHORIZING THE CITY OF CHULA VISTA TO PARTICIPATE AS AMICUS CURIAE IN GEARY V. RENNE IN SUPPORT OF NONPARTISAN LOCAL ELECTIONS In 1986 the California voters adopted Proposition 49 which prohibits political parties from endorsing, supporting or opposing candidates for nonpartisan offices. Proposition 49 has been supported by the League of California Cities. The City of San Francisco is presently defending a challenge to the constitutionality of Proposition 49 in Gearv v. Renne. The City of San Diego has agreed to write an amicus curiae brief for the League of California Cities and has requested support from cities throughout the state. RESOLUTION OFFERED BY MAYOR COX, the reading of the text was waived by unanimous consent. Councilmembers Malcolm, Nader and McCandliss noted they did not receive notice of this special meeting. Mr. Harron stated the notice for this meeting was posted and the newspapers received notice. He added that 24 hours notice is required for a special meeting; the Council does have the option of waiving the requirement. Councilman Nader stated he supported Proposition 49, however, he questioned why this particular lawsuit is receiving priority treatment for the City's involvement. Mayor Cox stated he requested the special meeting primarily because if the Council does want to take a position on this matter, the deadline in order to have the City's name included is November 3. The amount of staff effort and labor on this matter is only to call the City of San Diego who is preparing the brief and tell them to put the City of Chula Vista on the list.
