RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA GRANTING THE APPEAL OF JACK BLAKELY FROM THE
DENIAL OF THE CONDITIONAL USE PERMIT FOR THE LOCATION
OF A RESTAURANT SERVING BEER AT 937 OTAY LAKES ROAD
The City Council of the City of Chula vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula
vista has heretofore on July 24, 1974 failed by a tie vote to
grant a conditional use permit as requested by Mr. Jack Blakely
for the location of a restaurant serving beer at 937 Otay Lakes
Road, and
WHEREAS, Mr. Blakely has now appealed said decision to
the City Council, and
WHEREAS, the City Council has heretofore held a public
hearing on August 13, 1974 to consider said appeal, and
WHEREAS, based upon the testimony presented at said public
hearing, the City Council finds as follows:
1. The location of said restaurant serving beer will
provide a necessary and desirable service for the resi-
dents of the community surrounding the neighborhood
shopping center since no similar enterprise exists
within a reasonable distance of said neighborhood.
2. There will be no detriment to the health, safety
or general welfare of persons working or residing in
the vicinity since the shopping center currently exists
without any such detriment and the particular facility
will not substantially change the character or nature
of the operations of said center.
3. The use subject to the conditions required by the
City Council will comply with the regulations and con-
ditions specified in the Code for such use.
4. The use will in no way conflict with the General
Plan of the City of Chula Vista, which designates the
site area for commercial usage.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the appeal Of Mr. Jack Blakely be, and the
same is hereby granted and a conditional use permit is hereby issued
for the location of a restaurant serving beer at 937 Otay Lakes Road,
subject to the following conditions:
1. The pool tables, pinball machines and horseshoe pits
shall be eliminated from the plan.
2. Hours of operation shall be limited to 7 a.m. to 11 p.m.
3. Construction of the building shall be subject to sepa-
rate site plan and architectural approval; plans for archi-
tecture and signs shall conform to the existing features
in the center.

4. An additional 42 parking spaces and associated
landscaping shall be installed in conjunction with
construction of the new building.
5. The approval is granted subject to the continuing
compliance with the performance standards of the
Zoning Ordinance and on the continuing compatibility
of the establishment with the C-N zoned center and
residential areas adjacent. Complaints with regard
to the operation or violations shall be investigated
and may provide cause for the Planning Commission to
review this conditional use permit. No amusement
facilities shall be included in the building without
Planning Commission authorization.
