HomeMy WebLinkAboutcc min 1989/08/24 MINUTES OF AN ADJOURNED MEETING OF CITY COUNCIL/CHARTER REVIEW COMMITTEE Thursday, August 24, 1989 Council Conference Room 4:00 p.m. 476 Fourth Avenue ROLL CALL PRESENT: Councilmembers Gayl e L. McCandliss, Tim Nader, Leonard M. Moore, and Mayor Gregory R. Cox. Committee members: Mary Francis Click, Sharon Reid, and Chairman C. J. Campbell. ABSENT: Council member David Malcolm and Committee members Carlos Batara, Jack Blakely, John Dorso, and Susan Fuller ALSO PRESENT: City Attorney, Thomas Harron; Deputy City Manager, Jim Thomson; and City Clerk, Beverly A. Authelet. Mayor Cox and Chairman Campbell called the meeting to order at 4:10 p.m. /~/~ Mr. Campbell stated that it was the Committee's understanding the Council was looking at something conservative and they approached the project accordingly. It is a very restrictive ordinance and intended to be that way. City Attorney Harron stated that they were trying to follow Council's direction regarding the aggregate related contributions and deal with the problem of the wealthy candidate. Mr. Harron stated that the definition of "Agent" was included in the Political Reform Act so it could be deleted from the ordinance. He further stated that it was not his recommendation for the ordinance to be retroactive, City Council discussion followed regarding various scenarios, and how this ordinance would be interpreted. After a lengthy discussion, the following actions were taken by the City Council: Motion: Moved by Cox, seconded by McCandliss to bring back the revised ordinance with the State's definition of "Agent" included. Motion carried 4-0-1. (Councilwoman McCandliss left the room briefly). Motion: Moved by Nader, seconded by Moore to direct the City Attorney to develop some language to define "Election Period" clarifying if the $250 individual limit applies to any one campaign. Motion carried 3-0-2 City Council Minutes -2- August 24, 1989 (Councilwoman McCandliss returned). Motion: Moved by Nader, seconded by McCandliss that under Section IV to increase the $250 aggregate amount to $2500. Substitution Motion: Moved by Nader, seconded by McCandliss to direct the City Attorney to look at the aggregate amount of $250 with the intent of replacing it with $2500 for consideration of the full council at a later time. Motion approved 4~0-1. Motion: Moved by Cox, seconded by Nader to direct the City Attorney to prepare some language regarding the campaign funds one can collect before January 1st which is consistent with Proposition 68. Motion carried 4-0-1. Motion: Moved by Cox, seconded by McCandliss to accept the Charter Review Commi ttee's recommendations that the $250 contribution limit not be lifted in the event of substantial money of the candi date invested i n his or her own campaign, but instead there be a notice provision similar to the one in the County ordinance, giving the other candidates notice of the candidates intent and actual deposit of personal funds in excess of $5,000 in the candidate's campaign contribution checking account at least sixty days prior to the election so that the other candidates will have a more substantial time period to try to obtain sufficient combating funds, al bei t limi ted to the $250 amount, and the public will be informed of the substantial infusion of personal funds. Motion carried 4-0-1. Council directed the City Attorney to make the changes as discussed and bring the ordinance back to the City Council for discussion sometime in September. MOTION: Moved by Nader, seconded by McCandliss to direct the City Attorney to include the item discussed relating to time and manner of independent committee expenditures. Motion carried 4-0-1.
