The City of Chu1a Vista has supported the construction of the Sweetwater River
Flood Control Channel for nearly 20 years. During this period, the County of
San Diego, City of National City, U. S. Corps of Engineer, S. D. Unified Port
District and Chu1a Vista officials have ~lOrked in a cooperative effort to
bring about project implementation.
The proposed agreement is a significant step towards the construction of the
project.
RECOMMENDATION: That Council adopt resolution approving the agreement.

The Sweetwater River Flood Control Channel will be constructed in conjunction
with the State Highway 54 project. This project has been long in the making
and has required Council action on several occasions. The most recent Council
action occurred on February 7, 1984 whereby Resolution 11527, Council
requested the U. S. Congress for maximum Federal participation in funding the
project.
During the project formulation stages, the City of Chula Vista has accepted
certain obligations, which includes the relocation of utilities, purchase of
the necessary rights-of-way, bridge relocation and engineering costs. All
agencies involved with this project have made substantial investments in time,
effort and hard cash to gain final approval of the project.
Thi s agreement between the County of San Di ego (1 ead agency for the project)
and the City of Chu1a Vista provides the mechanics for project construction,
administration and payment of future maintenance costs. In general, the City
of Chu1a Vista therein agrees to:

1. Bear its share of rights-of-\'lay acquisition costs that are determined to
be nonreimbursable by the State of California, Department of Water
Resources (DWR).
2. Bear its share of costs for relocation and reconstruction of existing
streets, bridges, utilities, and irrigation and drainage facilities that
are determined to be nonreimbursable by OWR.
3. To pay the County 30% of actual cost of maintaining the improvements.
4. To pay 30% of all Local Flood Control costs which have not been reimbursed
by OWR within 10 years following completion of the project.
5. To pay its share of all cost overruns.
6. Accept OWR determinations concerning reimbursability.
7. Hold County harmless for any drainage/liability occurring in connection
with the project.
It should be noted that the City's obligation amount under this agreement is
not fixed. The reason is that no final plans/cost estimates have been
prepared. The most recent estimate prepared by the County pl aces the local
agency flood control cost in the range of $5.65 million (see attached table).
Based on this estimate, the City's total share would be about $1.5 million
($1,355,000 for right-of-way, bridge construction, and relocation expenses and
$142,850 for mitigation and recreation costs). Of this amount $1,355,000 is
to be reimbursed by DWR within a 10-year period to CalTrans on Chula Vista's
behalf. A separate agreement between CalTrans and the County will be executed
obl igating CalTrans to advance up to $5.65 mill ion for project construction
for 11 years interest free.
Fund reimbursements by DWR as of to date are not assured. Legisl ation has
been introduced in Sacramento by Senator Waddie Oeddeh (SB1339) that will fund
100% of the project I s cost. DWR has suffic i ent funds to pay all outstanding
obl i gations to date. However, future payments are subject to future State
legislation appropriations. Obligations associated with the Sweetwater River
Flood Control project would be next in line. Thus, the chances that DWR would
reimburse the proj~ct I s cost \vith in the next 10 years appear to be excell ent
and coul d even occur wi thin one to b'lO years after submittal of request.
In the event that DWR is unable to make the reimbursements, Chul a Vi sta \'/0111 d
be obligated to pay its share of the project's cost ($1,355,000) 10 years
after expenses occurred by CalTrans. He will keep Council informed of all
developments associated wi th th i smatter.

The proposed agreement also ob1 igates the City to pay 30% of the actual annual
costs to maintain the improvements. Our best estimate is that the City's
share of this cost will be bebleen $20,000 and $30,000. These costs will
begin to occur 2 or 3 years after project completion. We will submit budget
requests for these costs beginning in the 1986-87 fiscal year.
Completion of this project will enhance the health, safety and welfare of
Chula Vista and adjacent areas.
FISCAL IMPACT: Chu1a Vista's share of this project has been estimated to be
about $1.5 million ($1.35 million reimbursable and $142.850 non-
reimbursable). Legislation is nO\J pending that \'lOuld provide for 100% State
financing of local reimursab1e flood control costs. No fund appropriations
have occured, hm'iever. The City's reimbursement cost of about $1.35 mill ion
would be due and payable in 10 years after project completion in the event
that no State funds are actually appropriated. This situation is considered
to have little chance of occurring.
Funds for a portion of the City's share of the non-reimbursable items (such as
ri ght-of-way not ru1 ed necessary for the project, miti gation and recreati on
aspects of the project have been requested in conjunction with FY84-85 budget
submittals ($80,000). The remainder of anticipated funds will be requested in
the budget for FY 135-86.
The annual maintenance cost attributable to Chula Vista is estimated to be
between $20,000 and $30,000. These costs will begin 2 to 3 years after
project completion (FY 86-87).
