1. ROLL CALL

2. PUBLIC HEARING - Continued from meeting of December 1,
1987
Appeal of Thomas Horning on behalf of Sundancer Lounge, Inc.
of his denial of a dance permit application for 1011
Broadway (Tioga).
This being the time and place advertised, Mayor Cox declared
the public hearing open.
Assistant City Manager Asmus stated the staff recommendation
is that the City Council (1) direct staff to issue a dance
permit for this premise subject to the Planning Director's
satisfaction that the premises, as existing or perhaps
modified by the new owner, meet all the required parking and
other requirements of the County Code; and (2) that staff be
directed to review the regulations surrounding the granting
of dance permits, particularly as present regulations
pertain to only granting said permits to "bona fide eating
places" and any other regulatory measures that may need to
be added or modified as they presently exist.
Responding to Councilwoman McCandliss, City Manager Goss
stated he believes there needs to be an administrative
appeal process whereby executives in the Police Department
or Administration could review these matters instead of
going directly to the Council.
Mr. John Gaden, Manager of Villa Hermosa Apartments on Moss
Avenue in Chula Vista, addressed the Council. These
apartments are located close to the premises under
discussion. He noted his objection to issuing a dance
permit.

Mr. Michael Green, 535 "H" Street, Chula Vista, representing
Mr. and Mrs. Risinger, owners of the property, addressed the
Council. Mr. Green pointed out this location has had a Type
48 liquor license for 25 years with no problems. The
purchaser, Mr. Horning, has a contingency in the purchase
agreement that if he is unable to get the dance permit, he
does not have to go through with the purchase.
Councilwoman McCandliss asked if the purchaser, Mr. Horning,
is aware, given the changes the Land Use Plan is going
under, that there could be an abatement period where he
would be brought into compliance? Mr. Asmus responded that
Mr. Horning is aware that the City is working on the Land
Use Plan for the area and that there could be some changes.
Ms. McCandliss commented eventually the Montgomery area and
Chula Vista codes will have to be brought into alliance.
There being no further public comment, the public hearing
was declared closed.
MSUC (Moore/Nader) to accept staff recommendation #1: that
the City Council uphold the appeal of Mr. Horning and direct
staff to issue a dance permit for this premise subject to
the Planning Director's satisfaction that the premises, as
existing or perhaps modified by the new owner, meet all the
required parking and other requirements of the County Code.
MSUC (Moore/McCandliss) to accept staff recommendation #2:
That staff be directed to review the regulations surrounding
the granting of dance permits, particularly as present
regulations pertain to only granting said permits to "bona
fide eating places" and any other regulatory measures that
may need to be added or modified as they presently exist.
