1. REPORT OF THE DIRECTOR OF PUBLIC WORKS REGARDING REQUIREMENT TO PURCHASE
STREET LIGHT IN CONNECTION WITH REMODELING PROJECTS FOR
SERGIO PEREIRA, 491 QUAIL STREET
AND
MR. AND MRS. SUTTON, 144 TWIN OAKS
Director of Public Works/City Engineer Lippitt reported the issue at both 491
Quail Street and 144 Twin Oaks is that the applicants applied for a permit to
remodel and increase the size of their homes. Due to the location of these
homes, it was required to install ornamental street lights (lights with
underground wiring). The City Code provides that when projects for buildings
are developed, public improvements, including street lights, sidewalks, etc.,
are put in. "Bull ding" is defined as any project over $10,000. Mr. Lippitt
further reported that street lights have been one of the most difficult areas
to deal with in that one street light serves 5 to 10 houses. Normally the
first house that is near the spacing for a street light is required to install
the light; also houses on corners. The house at 491 Quail Street is on a
corner, however, there is a street light on the other side of the street on a
wooden pole. There is a street light in front of the Sutton home (144 Twin
Oaks) on a wooden pole.
Mr. Lippitt stated he believes the Cit9 Code needs to be looked at with regard
to the dollar amount used as the basis for requiring public improvements. He
also stated a policy needs to be developed with regard to replacing wooden
pole street lights with the new ornamental street lights in older areas of the
City where the City will not be undergrounding the service for many years.
Mr. Lippitt stated another issue involved is sidewalks with regard to the Twin
Oaks property. None of the properties in that subdivision have sidewalks.
There are provisions in the City Code where the Planning Commission can waive
the requirement for installation of sidewalks. Mr. Lippitt pointed out the
applicant could go through the waiver request process with the Planning
Commission.

Mr. Lippitt stated the decision to require sidewalks is a Code requirement and
not a discretionary act of staff. Decisions for street lights, in both cases,
even though a Code requirement, is a discretionary act of staff as to where
the street light should go. The staff decision can be overruled by the City
Council or a deferral can be requested.
Councilmember Malcolm stated the City needs to have a policy whereby
remodeling and/or room additions does not require putting in street lights.
Putting in street lights where needed should be the City's responsibility.
Mr. Lippitt also noted the property at 491 Quail Street which is located on a
corner requires the installation of a handicap ramp. This is also a
discretionary action by staff. This entire subdivision does not have any
handicap ramps.
MSUC (Malcolm/Nader) have the policy brought forward with recomnended changes
(requirement to purchase street lights, install sidewalks, and handicap ramps
in connection with remodeling projects).
MSUC (Moore/Nader) to bring back the policy that deals with the requirement
for curbs, gutters and sidewalks.
Councilmember Malcolm pointed out this i s a time sensitive matter and
requested this be brought back as soon as possible.
Mr. Lippitt stated staff will waive the street lights and rebuilding of the
curb return for the handicap ramp for these two properties. Staff will
discuss the sidewalk issue with the property owner.
2. TRAILER FOR CITY USE AT PARADES AND SPECIAL SERVICES
City Manager Goss noted this item was not previously noticed on an agenda,
therefore, it may need to be continued.
MSUC (Nader/Malcolm) to continue this item to Tuesday, September 8, 1987.
3. ORAL COMMUNICATIONS
Mr. Bud Pocklington, 656 Glover Place, Chula Vista addressed the Council. He
noted the County Supervisors voted recently that they would not defend any of
their comi ssions or volunteers who are on commissions. He further noted
there are a number of commissions consisting of volunteers in this City. If
one of the members is sued, would they be defended by the City? City Attorney
Harron responded he works under the assumption that they are agents of the
City and that the City has a responsibility to represent them.
Mr. Pocklington also stated he is a Director of the Sweetwater Authority.
Recently a position paper was mailed to each Councilmember regarding the 1985
decision denying the Pointe Project. He wanted to be sure the paper was
received. He further stated Sweetwater Authority is looking at this project
again because of public inquiries and another decision will be made in the
next few months.
