HomeMy WebLinkAboutReso 1982-10989 RESOLUTION NO. 10989 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY AND THE LOWER SWEETWATER FIRE PROTECTION DISTRICT TO INSURE CONTINUED FIRE PROTECTION AND EMERGENCY MEDICAL SERVICE FOR THE LOWER SWEETWATER AREA AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and THE CITY OF NATIONAL CITY and the LOWER SWEETWATER FIRE PROTECTION DISTRICT, to insure continued fire protection and emergency medical service for the Lower Sweetwater area, dated the 24th day of August, 1982 , a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. DATED City Clerk ( seal) CC-660 AGREEMENT BEI'VlEEN 'lEE CITY OF CHUIA VISTA AND THE CITY OF NATIOOAL CITY AND THE LOiJER SVIEE'IWATER FIRE PROIECTION DISTRICT TO INSURE CONTINUED FIRE PRarECTION AND EMERGENCY MEDICAL SERVICE FOR THE ill.vER SWE:E:'n'7ATER AREA THIS AGREEMENT is entered into this 24th day of August , 1982 by and between THE CITY OF CHUIA VISTA, THE CITY OF NATIONAL CITY and the ill.vER ffiVEETI.vA'IER FIRE PROTECTION DISTRICT: WITNESSETH. ----------- WHEREAS, the Lower Sweetwater Fire Protection District was organized to provide fire protection through the use of a skeleton force of professional firefighters supported by volunteers, and WHEREAS, District presently maintains property and equiprrent to provide fire protection and errergency medical service and employs personnel to provide such services in the area shown on Exhibit "A", and vJHEREAS, the Cities of National City and Chula Vista surround the District territory and maintain professional fire protection and errergency rredical service wi thin their respective cities, and WHEREAS, due to the limitations of Proposition 13 and the continuing re- duction in the size of the District, it is recognized that saretirre in the future the Fire Protection District will have to consider dissolution and its responsib- ilities assurred by other goverrurent agency or agencies, and \VHEREAS, the Board of Directors for Lower SWeetwater Fire Protection District desire to ensure that their constituents receive the highest level of fire and errergency rredical services possible during the interim period while continued efforts are made to provide for long-tenn fire protection, and \'lliEREAS, the Cities of National City and Chula vista are willing to provide interim fire protection and errergency rredical service to the District area pending final resolution of the dissolution question and possible annezation of that area in an acceptable manner to the two cities, and WHEREAS, the Cities of National City and Chula Vista consider the SWeetwater River as the approximate division of the area served by the Fire Protection Dis- trict as shown on Exhibit "A" for the purpose of future annexation possibilities as well as providing interim fire protection service to the area, and \VHEREAS, both cities desire to continue the service of volunteers and the professional fire fighting employees. NCW, THEREFORE, IT IS MUTUALLY AGREED BY AND BETi-vEEN THE PARrIES HERErO AS FOLI..CXVS : 1. GENERAL CONDITIONS. The Cities agree to provide fire protection and errergency rredical service to the area presently known as the Lower SWeetwater Fire Protection District. 2. TE~IJ:. This agreerrent will cc:mrence on the date a National City Fire Departrrent Engine Company occupies the District's station after necessary structural revisions are ccrnpleted. Revisions are anticipated to be accanp- lished by March 1, 1982 or sooner. This agreerrent will continue in full force and effect until January 1, 1984 or until such tirre as District may be dis- solved or unless tenninated prior thereto as provided herein. 3. TERMINATION. This agreement may be tenninated by any of the parties hereto upon delivery of a written notice of intent to tenninate fran the ini tiating governing body to the other governing bodies. Said termination shall becare effective three (3) lIDIlthS fran the receipt of notice or at such other date as may be mutually agreed upon by the parties. 4. DISTRICT PROPERrY AND EQUIPMENT. The District will continue to own, maintain, and have canplete control of its equiprrent and property during the tenn of this agreerrenti provided, however, District may loan said equipment and property to either City under tenns and conditions that may be agreed upon and, further, that should District be dissolved before January 1, 1984, said equiprent and property shall be disposed of in the manner as prescribed by State law. ~-/t?r#'f 5. DISTRICT PERSONNEL. All District fire suppression personnel will, upon the effective date of this agreerrent, be treated as employees of the respective Fire DepartIrents of the Cities as provided herein in Exhibit "B", and shall per- form for the duration of this agreerrent nnder the direction of the respective Fire Departrrents of the Cities. District personnel will preserve any accumulated vacation, sick leave or other benefits and will accrue vacation, sick leave and other benefits fran the effective date of this agreerrent as provided by the Memoranda of Understanding existing between the reSPective Cities and their firefighters. District personnel, during the term of this agreerrent, shall be considered employees of the respective city's fire departIrent, provided hCMever if this agreerrent is terminated as provided herein the cities may, but are not required to, retain said District personnel. If, during the term of this agreerrent, the District is dissolved and said area is annexed to the reSPective cities, it is agreed that said District per- sonnel will be integrated into the reSPective departments at the existing city's salaries and ranks as employees of the cities during the period that contractual protection is furnished. All prior service and benefits accrued prior to and during the contractual period shall be retained by District personnel. 6. PAYMENTS. The District will make payments to the cities quarterly on the first working day of January, April, July and October. Each payrrent shall be in advance for the succeeding quarter. The first payment date will be the beginning of each "year period". Upon the execution of this agreerrent, District shall make a pro rata payrrent to the Cities for the period fran the effective date of this agreerrent to the first payrrent date. The arronnt due to the cities for the first year period shall be as shown on Exhibit "C". Payment to the cities will be based on actual operational costs incurred by the cities. Adjustnlent of costs will be made on an annual basis. Actual costs will be reviewed with the District on a quarterly basis. Estimated amount due the cities for future year periods of this agreerrent shall be a sum to be negotiated upon the request of either party prior to the camrencerrent of the year period. The District agrees to payoff its obligation of approximately $64,000 which is the balance owed to Public Ehployees Retirerrent System (PERS) on behalf of the three full time paid employees of the department. Said sums shall be adjusted to reflect then exist- ing cirClIDlStances. Cities of National City and Chula vista will be responsible for determining the appropriate division of the total annual sum for their administrative services. 7. SERVICE. The City of National City will assign and maintain an engine carrpany at the District's station located at 2711 Granger, National City, Califor- nia. This carrpany will remain stationed there until the carrpletion of the City of National City's new station in the area of Euclid Avenue and 24th Street, National City, California, at which tine the carrpany will be reassigned to the Euclid Avenue station. The District shall maintain the volunteer system and the Cities will pro- vide on going training of the volnnteers. The District shall at its own expence install direct P-lines fran the cities dispatch. The cities shall maintain the installed lines. B. IMPLEMENTATION. The cities and District shall exercise their best efforts to implerrent the terms and consitions of this agreerrent; provided, however, it is the understanding of both cities and the District that this agreerrent provides an interim solution fran providing fire and errergency rredical services to District's constituents and an ongoing effort will be made to dissolve the District and incorporate said area into the corporate boundaries of Chula Vista and National city.
