ITEM TITLE:
Public Hearing: Conditional Use Permit PCC-95-22; Request to establish
an automobile maintenance facility at the southwest comer of 30th Street
and Edgemere Avenue - Econo Lube n' Tune.
The proposal is to construct an automobile maintenance facility on 0.60 acres at the southwest
comer of 30th street and Edgemere Avenue in the C-C-P (Central Commercial with Precise
Plan) zone. The consideration of this request is contingent upon approval of a zoning text
amendment to allow such facilities to be considered by conditional use permit in the C-C zone,
which is the preceding item on the agenda (PCA-95-04).
The Environmental Review Coordinator has conducted an Initial Study, IS-95-16, of possible
environmental impacts associated with the project. Based on the attached Initial Study and
comments thereon, the Environmental Review Coordinator has concluded that there would be
no significant environmental effects, and therefore recommends adoption of the Negative
Declaration issued on IS-95-16.
RECOMMENDATION: That the Planning Commission adopt attached Resolution PCC-95-22
approving the permit in accordance with the findings and subject to the conditions contained
therein.
BOARDS/COMMISSIONS RECOMMENDATION: The Design Review Committee will
consider the site plan and architecture for the project on May 8, 1995 (DRC-95-34). The results
of that meeting will be reported to the Commission at the public hearing.
DISCUSSION:
I. Site Characteristics
The site is triangular in shape and has been cleared and graded for development. The
property is bounded by a drainage channel and the Food-4-Less market to the west,
vacant I-L zoned property and SR-54 to the south, and the Town and Country
commercial center in National City to the east.
2. Proposal
The proposal is to develop the property with a 2,500 sq.ft. Econo Lube n' Tune facility
to include general lubrication and tune-up services, plus brake, air conditioning and
radiator service. The building contains a total of six service bays; three thru-bays which
open at both ends and are oriented towards Edgemere Avenue, and three shop bays

which open to the northwest toward the drainage channel. The site also provides eight
off-street parking spaces and associated circulation areas served by a single access drive
from Edgemere Avenue.
The operation will involve four employees, and consist of lubrication and oil service,
engine tune-up, brake service and replacement, air conditioning and radiator service, and
smog testing. Hours of operation are from 7:00 a.m. to 6:00 p.m. seven days a week.
3. Analvsis
Provided the Commission supports the enabling text amendment, we believe this is an
appropriate site for a Lube n' Tune facility. It is at a convenient location for the
consumer, and is abutting compatible commercial uses to the west and east. All work
will occur within the service bays, which are separated from the closest dwellings
(located some 250 feet to the north) by the Food-4-Less loading facilities and 30th Street.
The Negative Declaration has found there would be no significant noise impacts.
The primary concern of staff is with the appearance of the building and site. For
instance, the irregular shape of the property has necessitated orienting the lubrication
thru-bays toward the street frontage in order to provide adequate stacking areas for these
high-turnover bays. The appropriate screening of these open service bays from the street
is an important design issue, as is the overall design and articulation of the building. The
National City planning staff share our concerns with design, and these issues will be
addressed by the Design Review Committee at their meeting of May 8, 1995. The
Committee's action will be reported to the Commission at the public hearing.
Based on the factors noted above, we are recommending approval of the request in
accordance with attached Resolution PCC-95-22.

A RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION GRANTING A CONDITIONAL USE PERMIT TO ECONO
LUBE N' TUNE TO CONSTRUCT AND OPERATE AN AUTOMOTIVE
MAINTENANCE FACILITY AT THE SOUTHWEST CORNER OF 30th
STREET AND EDGEMERE AVENUE
WHEREAS, a duly verified application for a conditional use pennit was filed with the
City of Chula Vista Planning Department on November 18, 1994, by Marilyn R.F. Ponseggi,
Ponseggi & Associates, on behalf of Econo Lube n' Tune, Inc.; and
WHEREAS, said application requested approval of a conditional use pennit to construct
and establish an automotive maintenance facility of the southwest corner of 30th Street and
Edgemere Avenue within the C-C Central Commercial Zone; and
WHEREAS, the Environmental Review Coordinator has conducted an Initial Study
(IS-95-16) of potential environmental impacts associated with the implementation of the project
and based on the attached Initial Study and comments thereon the Coordinator has concluded that
there would be no significant environmental impacts and recommends adoption of the Negative
Declaration issued on IS-95-16; and
WHEREAS, the Planning Director set the time and place for a hearing on said
conditional use pennit application and notice of said hearing, together with its purpose, was
given by its publication in a newspaper of general circulation in the city and its mailing to
property owners within an area greater than 500 feet of the exterior boundaries of the property
at least 21 days prior to the hearing; and
WHEREAS, the Commission has previously determined by Resolution PCA-95-04 that
it would be appropriate to amend the Municipal Code to allow the consideration of automobile
maintenance facilities by conditional use pennit in the C-C zone; and
WHEREAS, the hearing was held at the time and place as advertised, namely May 10,
1995, at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning
Commission and said hearing was thereafter closed; and
WHEREAS, the Commission found that the project would have no significant
environmental impacts and adopted the Negative Declaration issued on IS-95-16; and

NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION of
the City of Chula Vista does hereby fiud, resolve and order as follows:
1. Adoption of Negative Declaration. That the project will have no significant
environmental impacts and the Commission hereby adopts the Negative
Declaration issued on IS-95- 16.
II. CUP Findings. That the Planning Commission makes the findings required by
the City's rules and regulations for the issuance of the conditional use pennit, as
hereinbelow set forth, and sets forth, thereunder, the evidentiary basis that
permits the stated finding to be made.
A. That the proposed use at the location is necessary or desirable to
provide a service or facility which will contribute to the general well
being of the neighborhood or the community.
The proposed automobile services facility will serve the needs of
consumers in a visible and convenient location consistent with surrounding
commercial uses.
B. That such use will not under the circumstances of the particular case,
be detrimental to the health, safety or general welfare of persons
residing or working in the vicinity or injurious to property or
improvements in the vicinity.
The facility is consistent with commercial uses to the west and east and
is well separated and buffered from residential areas to the north.
C. That the proposed use will comply with the regulations and conditions
specified in the Municipal Code for such use.
Compliance with all applicable conditions, codes and regulations shall be
required prior to issuance of development permits and on conditioning
basis thereafter.
D. That the granting of this conditional use permit will not adversely
affect the general plan of the City or the adopted plan of any
government agency.
The General Plan allows, within the Commercial zone, this kind of use,
and is therefore consistent with the General Plan.

III. Conditional Grant of Permit; Conditions. The Planning Commission hereby
grants Conditional Use Permit PCC-95-22 subject to the following conditions;
whereby:
A. The project shall comply with the plan approved or conditionally approved
by the Design Review Committee (DRC-95-34).
B. The project shall comply with all the requirements of the Chula Vista
Uniform Fire and Building Codes to the satisfaction of the Fire Marshal
and Director of Building and Housing respectively.
C. Operations shall be restricted to automobile maintenance, repair and
service such as described in the project application. Major auto repair,
including carburetor overhauling, rebuilding and reconditioning of engines
and collision repair including body frame, fender repair or automotive
painting is strictly prohibited.
D. Hours of operation shall be restricted to the period between 7:00a.m. and
6:00 p.m. without the prior written approval of the city Zoning
Administrator .
E. A building permit will not be issued by the City of Chula Vista until a
sewer agreement has been executed by the City of National City and the
applicant to provide for sewer connection.
F. Applicant shall comply with all Federal, State, and Municipal
requirements and regulations.
IV. Additional Terms and Provisions of Grant.
A.
A condition precedent to the approval of this permit is the amendment of
Municipal Code Section 19.04.022 and 19.36.030 to allow automobile
maintenance facilities by conditional use permit in the C-C Central
Commercial zone (Ref:PCA-95-04).
B.
This permit shall be subject to any and all new, modified, or deleted
conditions imposed after adoption ofthis resolution to advance a legitimate
governmental interest related to health, safety or welfare which City shall
impose after advance written notice to the permittee and after the City has
given to the permittee the right to be heard with regard thereto. However,
the City. in exercising this reserved right/condition, may not impose a

D. This conditional use permit shall become void and ineffective if the same
is not utilized within one year fonn the date of this resolution in
accordance with Section 19.14.260 of the Municipal Code. Failure to
comply with any condition of approval shall cause this pennit to be
reviewed by the City for additional conditions or revocation.
V. Findings re Relation of Exaction to Impact of Project.
The City Council has individually and independently reviewed each of the
exactions imposed on the applicant contained in this resolution, and hereby finds,
in this case, that the exactions are imposed to mitigate an impact caused by the
project and are reasonably related to the project and the extent and degree of
exaction is in rough proportionality to the impact caused by said project.
VI. A copy of this resolution shall be transmitted to the applicant.

Environmental Review Coordinator Doug Reid advised that commissioner Ghougassian had submitted
his letter of resignation and that there was a question as to whether Vice Chair Guerrero.s seat was now
vacant.
PRESENTATION OF PROJECTS

Staff Presentation
Mr. Reid advised that the code amendment was to be considered first since this would actually
permit the proposed use. He reviewed the development proposed by Econo Lube'n Tune as well
as the code amendment which would allow automotive maintenance in certain commercial and
industrial zones. Mr. Reid noted that the appltcations will be considered by the Planning
Commission in late March. He introduced Marilyn Ponseggi who represented the applicants.
Commission Discussion
Commissioner Hall noted that letters to the editor have appeared in the paper from neighbors
in the project area. complaining that they do not receive notices on projects. Mr. Reid stated
that they had been noticed regarding environmental review on the Food 4 Less project. and that
this project had also been noticed.
Commissioner Fisher questioned the drainage. asking about the potential for fuels to wash into
the drainage channel; Commissioner Marquez voiced similar concerns, noting the proximity of
the proposed building to the flood channel. Ms. Ponseggi responded that this was not a problem
per se with the proposed code amendment. With respect to the proposed development proJect.
Ms. Ponseggi reviewed Econo Lube.n Tune's safety and storage procedures and pointed oul that
this facil ity conducts auto maintenance activities but 110 automotive repair.

A. Proiect Setting
The project site is a portion of a previously graded site. The total site is 5.77 acres located
at the southwest corner of 30th Street and Edgemere Avenue. A 26,920 square foot portion
of the site, east of the Food 4 Less market currently under construction, is proposed for the
automotive maintenance facility. This site is bordered by 30th Street to the immediate north,
and Edgemere A venue to the east. Land uses adjacent to the subject property include the
Sweetwater Town & County Shopping Center to the east, across Edgemere Drive, single
family residences and the National City Municipal Golf Course to the north and Sweetwater
River to the south. The site is located within the 100-year Flood Zone Boundary.
B. Proiect Description
A 2,502 square foot automotive maintenance facility is proposed on a 286,920 square foot.
portion of the project site. The applicant proposes 8 parking spaces onsite. Hours of
operation are 7:00 a.m. to 6:00 p.-m. Primary access to the site is from Edgemere with
secondary access available through the Food 4 Less access on 30th Street.
A large Tectangular concrete culvert to convey water from 30th Street bisects the property
diagonally toward the eastern portion of the site. The current discretionary action is a
conditional use permit for an automotive maintenance facility and Design Review.
Previously, the entire site was considered through Design Review. At that time
environmental review was completed and a Negative Declaration was issued (IS-94-15). The
previous environmental rtview is incoTporated into this document by refeTence.
A portion of the site is located within the 100-year floodplain and the 500 year floodplain.
It is unknown what impact the Army Corps of Engineers and Caltrans channel improvements
have had on the floodplain elevations. The applicant will be required to build one foot above.
the floodplain or to floodproof the construction. This requirement will reduce impacts to
below a level of significance. The Food 4 Less construction plans include a system to collect
onsite drainage from both the Food 4 Less and Beono Lube 'n' Tune. Off-site drainage
systems are adequate. The Landscape Architect requires minimum landscaping per tq~! I.
Landscape Manual. The sewer lateral for the project parcel shall not be connected to~ ~.

building sewer agreement between Chula Vista and National City for sewer service
(connection to National City sewer) has been approved by both cities and a sewer connection
permit is issued by the City of National City. Also the agreement between Chula Vista.
National City and Canyon-Cahan PropeTties dated 11/8/94 provides that a new agreement will
be required for this development. The existing soils report needs to be updated to reflect the
proposed development conditions which include a lube pit below grade.
Noise
There is the potential for noise impacts from the automotive diagnostic and repair equipment
used in conjunction with the automotive maintenance use. Conditions to reduce this potential
impact have been included in the proposed Code Amendment for the use. The condition
would require all work to be conducted within a building. The proposed Econo Lube 'n'
Tune will comply with the conditions in the proposed code amendment which will reduce any
potential impact to a level below significance.
Land Use
The proposed use is not currently permitted in the CCP zone. There is an amendment to the
Municipal Code proposed in conjunction with this project that would permit automotive
maintenance facilities in the CCP zone with a conditional use permit. Adoption of the code
amendment will reduce any potential land use impacts to a level below significance.
Hazardous MateTials
Automotive maintenance facilities provide a variety of automotive services including oil
changes, lubrication services, etc. There is the potential for the hazardous materials
associated with these services (used motor oil, etc.) to contaminate ground water if it is not
stored and disposed of properly. Conditions to address this situation have been included in
the draft Code Amendment. If adopted as proposed, these conditions would be imposed as
standaTd conditions on every CUP for Automotive Maintenance which would reduce any
potential impact to less than significant.
C. Comoatibility with Zoning and Plans
The General Plan designates the site as "Retail Commercial" and the zoning is "Central
Commercial" with a precise plan (CCP). As previously discussed, there is an amendment
to the Municipal Code proposed that would permit automotive maintenance facilities in the
CCP zone with a conditional use permit. Provided the amendment is adopted, the project
is compatible with the zoning and General Plan designation.
D. Identification of Environmental Effects
An initial study conducted by the City of Chula Vista (including the attached Environmental
Checklist Form) determined that the proposed project will not have a significant
environmental effect, and the preparation of an Environmental Impact Report will not be
required. This Negative Declaration has been pTepared in accordance with Section 15070
of the State CEQA Guidelines.

E. Mitigation necessarv to avoid significant effects
The proposed project will not result any significant or potentially significant environmental
impacts, therefore, no project specific mitigation is be required.

A portion of the site is located within the IOO-year floodplain and the 500 year floodplain. It is
unknown what impact the Army Corps of Engineers and Caltrans channel improvements have had
on the floodplain elevations. The applicant will be required to build one foot above the floodplain
or to floodproof the construction. This requirement will reduce the possibility of impacts to below
a level of significance. The Food 4 Less construction plans include a system to collect onsite
drainage from both the Food 4 Less and Econo Lube 'n' Tune. Off-site drainage systems are
adequate.
Automotive maintenance facilities provide a variety of automotive services including oil changes,
lubrication services, etc. There is the potential for the hazardous materials associated with these
services (used motor oil, etc.) to contaminate ground water if it is not stored and disposed of
properly. Conditions to address this situation have been included in the draft Code Amendment and
would be imposed on the proposed Econo Lube 'n' Tune. The incorporation of this code amendment
would reduce the potential impact to less than significant. Improper handling and storage of
hazardous substances other than tanks is regulated by Chapter 6.5 of the California Health and Safety
Code, Title 22 of the California Code of Regulations. Release from underground storage tanks is
governed by the California Health and Safety Code 6.75 and the Calif. Code of Regulations, Title
23, Article II. The cleanup of groundwater contamination from sources other than tanks is governed
by the Porter-Cologne Act.

75 % of the cases. The City of Chula Vista has indicated that this threshold standard
will be met, since the nearest fire station is in (National City) is 2 miles away and
would be associated with a 4 minute response time. The proposed project will
comply with this Threshold Standard.
According to IS-94-15, the fire flow is 2375 gallons per day. The necessary hydrants
to protect the site are being provided in conjunction with the market development.
B. Police
The Threshold Standards require that police units must respond to 84 % of Priority
I calls within 7 minutes or less and maintain an average response time to all Priority
I calls of 4.5 minutes or less. Police units must respond to 62.10% of Priority 2
calls within 7 minutes or less and maintain an average response time to all Priority
2 calls of 7 minutes or less. The proposed project will comply with this Threshold
Standard.
C. Traffic
The Threshold Standards require that all intersections must operate at a Level of
Service (LOS) "C" or better, with the exception that Level of Service (LOS) "D"
may occur during the peak two hours of the day at signalized intersections.
Intersections west of 1-805 are not to operate at a LOS below their 1987 LOS. No
intersection may reach LOS "E" or "F" during the average weekday peak hour.
Intersections of arterials with freeway ramps are exempted from this Standard. The
proposed project will comply with this Threshold Standard.

IS-94-15 included traffic circulation mitigations which will be provided as part of the
development of the Food 4 Less market. No additional improvements will be
required for this project.
D. Parks/Recreation
The Threshold Standard for Parks and Recreation does not apply to the proposed
project as it is a commercial project.
E. Drainage
The Threshold Standards require that storm water flows and volumes not exceed City
Engineering Standards. Individual projects will provide necessary improvements
consistent with the Drainage Master Plan(s) and City Engineering Standards. The
proposed project will comply with this Threshold Standard.
Site specific drainage improvements were required as a part of the Food 4 Less
market development. These improvements consist of collection facilities for drainage
to convey runoff to Paradise Creek Channel and/or the historic channel of the
Sweetwater River. An NPDES permit for stormwater discharges associated with
construction activities will be required because the project is part of a larger common
plan of development or sale that exceeds 5 acres in soil disturbance.
Off-site drainage facilities consist of the Sweetwater River to the south and Army
Corps of Engineers/Caltrans Channel between east and west bound lanes of SR-54.
These are adequate for the proposed project.
F. Sewer
The Threshold Standards require that sewage flows and volumes not exceed City
Engineering Standards. Individual projects will provide necessary improvements
consistent with Sewer Master Plan(s) and City Engineering Standards. The proposed
project will comply with this Threshold Standard following the implementation of the
following: an agreement between the City of Chula Vista and the City of National
City. This agreement has been approved by the City of National City Council and
is pending approval by the City of Chula Vista Council. Occupancy of the Econo
Lube 'n' Tune will not be permitted until such time as the agreement is completed.
G. Water
The Threshold Standards require that adequate storage, treatment, and transmission
facilities are constructed concurrently with planned growth and that water quality
standards are not jeopardized during growth and construction. The proposed project
will comply with this Threshold Standard upon compliance with the following
requirements: the owner must submit a letter to the authority from the appropriate
fire agency stating fire flow requirements. If the owner provides the required fire
flow information and enters into an agreement for water facility improvements with
the Authority, water service can be obtained.

Previously an environmental impact report was prepared for the site and the mitigation for biological
and cultural impacts implemented. The project was than abandoned and the site remain in a vacant
graded state for some time. The site is now under construction with a Food 4 Less Market, the
subject of IS-94-l5. The current proposal as well as the current construction does not have the
potential to degrade the quality of the environment, reduce the habitat of a fish or wildlife species
or cause a fish or wildlife population to drop below self sustaining levels.

This is to advise you that the project, located at the Second Avenue and 30th
Street, is within the Chula Vista Elementary School District which serves children
from Kindergarten through Grade 6. Rosebank School is the home school for
this project.
District enrollment has been increasing at the rate of 3-4 percent over the past
several years, and this is projected to continue. Permanent capacity has been
exceeded at many schools and temporary relocatable classrooms are being
utilized to accommodate increased enrollments. The District also buses
students outside their attendance areas, both to accommodate growth and assist
in achieving ethnic balance.
State law currently provides for a developer fee of $.28 for non-residential area
to be charged (Chula Vista Elementary School District - $.13/square foot;
Sweetwater Union High School District - $.15/square foot) to assist in financing
facilities needed to serve growth.

Dear Mr. Reid:
This letter is in response to your Notice of Initial Study for the
subject project within the Sweetwater Authority service area.
There is a 16-inch water main located on the north side of 30th
street and an a-inch main on the east side of North 2nd Avenue
adjacent to the proposed development. Our records indicate that
there are two water services to this property. Enclosed is a copy
of 1/4 SEC. 134 map which shows the existing water facilties.
At this time, we cannot comment on the adequacy of the existing
system to provide fire protection for this project. As plans
develop for structures, the Owner must submit a letter to the
Authority from the appropriate fire agency stating fire flow
requirements. Based on this requirement, this project may result
in the need for new water systems or substantial alteration to the
existing water system. The Authority recommends that your Agency
work with ours to determine if the existing water facilities are
adequate to meet the added demands prior to issuing a building
permit.
If the Owner provides the required fire flow information and enters
into an agreement for water facility improvements with the
Authority, water service can be obtained at a pressure ranging from
a maximum of 95 p.s.i. to a minimum of aD p.s.i.

Thank you for the draft staff reports and revised plans received on April 19th. The plans show
some improvement to the building design. However, I share your concern for the overall
appearance of the building. Additional architectural treatment, including wall plane and roofline
variation, is needed to avoid the building's boxlike appearance. Also, architectural treatment
similar to that along the front of the building (e.g., stucco elements, false columns) should be
carried around to the back to improve its appearance from State Route 54.
The orientation of the building and driveway opening is also of concern since the bays will be
highly visible from North Second Avenue. Berms, dense planting and lor screen walls will
reduce the visibility of the bays somewhat.
The project applicant indicates he will be requesting connection to the National City sewer
system. Authorization for that request will require City Council approval.
