SUBJECT: Request of Planning commission to consider an amendment
to the Municipal Code to allow "Automotive Maintenance"
facilities by Conditional Use Permit in certain
commercial Zones - Econo Lube 'n' Tune, Inc.
A request has been received from M.F. ponseggi & Associates, on
behalf of Econo Lube 'n' Tune, Inc., to initiate consideration of
a Municipal Code amendment to allow "Automotive Maintenance"
facilities by conditional use permit in certain commercial zones.
Please see the attached letter outlining the request and its
justification.
It appears to staff that the request, or some variation thereof,
has merit, and the applicant has submitted a deposit to reimburse
the city for all costs associated with the proposal. As a result,
we are recommending that the Planning commission authorize staff to
study the proposal, prepare a staff report and recommendation, and
schedule hearings before the Planning Commission and city council.
RECOMMENDATION:
Adopt a motion to authorize consideration of
an amendment to the Municipal Code to allow
"Automotive Maintenance" facilities by
conditional use permit in certain commercial
zones.

RE: Request to Consider a Code Amendment for "Automotive Maintenance"
Dear Members of the Planning Commission:
On behalf of Econo Lube 'n' Tune, Inc. I hereby request that the Planning Commission
consider an amendment to the Zoning Code of the City of Chula Vista to clarify
"Automobile Maintenance" as a separate use from "Automotive Repair"; and that this use
be permitted in the CoB, C-C, C-V and CoT zone with a Conditional Use Permit and in the
I-L zone as a matter of right.
After extensive research into the City of Chula Vista's Zoning Ordinance, we have concluded
that this amendment would be consistent with the City's Codes, particularly the recent
amendment to allow "automobile car washes" in the same zones that we propose for
"automotive maintenance uses".
No doubt the changes in automotive services over the last several years contributed to the
need to re-examine where automotive washes should be permitted in the City. We believe
it is these same changes that now necessitate a new look at automotive repair and
automotive maintenance in general.
Currently the City's code does not differentiate between "Automotive Repair" and
"Automotive Maintenance". The City's "Land Use Chart" does have a separate category for
"Automotive Service Stations" which are permitted in the C-B,C-N,C-C, C-V, CoT, I-R, I-L
and I zones with a Conditional Use Permit. "Automotive Repair" is broken down into
"major" and "minor" repair. "Major" automotive repair is permitted in the C- T and I-L zones
with a Conditional Use Permit. "Minor" automotive repair is permitted in the CoT zone with
a Conditional Use Permit, in the I-L zone as a matter of right and in the C-C zone as an
accessory use. Minor Automotive Repair as an accessory use would permit these types of
uses as a part of a major department store, without the requirement for a Conditional Use
Permit.

"Automotive Maintenance" as a primary use is a fairly new enterprise. In years past when
"Automotive Service Stations" (gas stations) truly provided all services needed by the driving
public this type of use would not have been necessary. Now however, with the advent of
"Automotive Service Stations" that provide a variety of convenience uses but relatively little
automotive service it has become necessary for separate "Automotive Maintenance Uses".
"Automotive Maintenance" Services, such as lube and tune-up shops, quick oil change shops,
etc., are meeting the needs of the driving public in the most convenient way possible.
Typically they are located close to the retail uses which permit the customer to leave their
car for a short time for the necessary maintenance, and while waiting for their car, do
grocery shopping or other errands in the immediate vicinity of the maintenance shop. This
concept of course is what makes it viable for several of the major department stores to
include automotive shops as accessory uses to their stores.
We recognize that these types of uses, while a convenience to shoppers may not be
compatible in every commercial center or area. For this reason we have proposed that the
use be subject to a conditional use permit. This would allow the City to review each use
independently to ensure that it is compatible with the surrounding area and place
appropriate conditions to protect this compatibility on the use.
For your information we have attached a recent survey conducted of the other jurisdictions
in the County regarding their classification of automotive maintenance uses. It is interesting
to note that almost every jurisdiction allows these uses in their retail commercial zones with
a Conditional Use Permit.
We appreciate your consideration of this matter and look forward to making a full
presentation to you regarding Econo Lube 'n' Tune at a future public hearing to consider
the Code Amendment.
