PUBLIC HEARING:
Conditional Use Pennit PCC-94-09: Request to establish a
private school for grades K-12 at 2400 Fenton Street in the
EastLake Business Center - Covenant Christian School
A. BACKGROUND
The request is to relocate and operate a private school for a period of at least five years
in an existing building within the Eastlake Business Center at 2400 Fenton Street. The
school provides classes for grades K-12 and currently operates in conjunction with
Bayview Orthodox Presbyterian Church at 505 E, Naples Street.
The Environmental Review Coordinator has detennined that the project is exempt from
environmental review as a class l(a} exemption.
B, RECOMMENDATION
Adopt the attached Resolution approving a two-year pennit based on the findings and
subject to the conditions contained therein,
C, DISCUSSION
Site Characteristics
The property is zoned P-C (Planned Community) and designated for Business Center-
Manufacturing Park, as are the properties to the north, south and west. The area to the
east is designated for Research and Limited Manufacturing within the EastLake III
Community, and is planned as an extension of the EastLake Business Center,
The 1.25 acre site is occupied by a 20,400 sq, ft. two-story building, Access to the site
is provided via Fenton Street. A total of 65 surface parking spaces are located along the
north, east and south portions of the site, The property contains no outdoor playground
or recreational facilities, The site is surrounded by undeveloped industrial parcels,
Existing Use
A majority of the second floor and a portion of the first floor are presently occupied by
Bonita Country Day School, a private non-denominational school for grades K-12 with
70 students and 10 staff, The school was originally granted a one-year administrative
conditional use pennit (pCC 91-55) which was subsequently extended by the Zoning
Administrator for a two-year period to expire on July 19, 1994, Outdoor recreational and
physical education activities are conducted in Scobee Park under an agreement with the
EastLake Business Center Owners Association,

Proposed Use
The proposal by Covenant Christian is to occupy 9,900 sq, ft. of the fIrst floor and share
the building with Bonita Country Day, The requested tenn for the conditional use permit
is fIve years, The proposed lease is for a period of fIve years with an optional 5-year
extension, The applicant views this site as one that could not only accommodate the
school's current operation, but also as one that has future long-tenn potential,
The school's current enrollment for the 1993-94 academic year is 165 students, which is
expected to increase to approximately 268 students (152 elementary/116 secondary) over
the next fIve years. A total of 20 administrative and faculty staff members are currently
employed by Covenant Christian School. The increase in students is expected to require
the addition of 5-10 faculty staff members over the next fIve years,
Covenant Christian proposes to relocate only grades K-6, representing approximately 100
students, during the 1993-94 academic year, The remainder of the student body would
be relocated from the Naples Street facilities to Fenton Street during the second and third
year of operation,
Classes are held between 8:15 a,m.-3:00 p,m, Monday-Thursday, and between 8:15 a,m,-
12:00 p,m. on Friday, A supervised child care program for children dropped off early or
picked up late operates between 7:00 - 8:15 a,m, and 3:00 - 6:00 p,m,
Approval has been obtained from the EastLake Business Center Owners Association to
utilize Scobee Park for recreational and physical education purposes between the hours
of 9:30 to 11 :30 a.m. and 1 :30 to 4:00 p,m, for a period of two years, although Covenant
Christian has been unable to provide staff a specifIc sChedule of activities which confonns
with the Association's approval (see attached letter from Covenant Christian dated
October 12, 1993),
D, ANALYSIS
The proposal to establish a private school as a long tenn use within the EastLake
Business Center raises issues which were considered by the Zoning Administrator with
the Bonita Country Day School (BCD) application. BCD had an immediate need for
facilities to accommodate a maximum of 70 students, and was granted an initial one-year
approval and two-year extension with the understanding that they would be seeking
pennanent facilities elsewhere, When their permit was originally granted in July, 1991,
it contained the following language:
"The school is an interim use, and its occupancy of the facilities at 2400
Fenton Street shall in no way restrict the use of adjacent properties from
uses otherwise deemed appropriate under the EastLake Planned
Community District regulations,"

When the permit was extended for two years in July, 1992, the following language was
added:
"The permit extension is approved for a period of two years, and will
expire on July 19, 1994, Any proposed operations after that date will
require submittal for a new Conditional Use Permit, and approval of such
must be obtained prior to the expiration date. This school is currently
approved as an interim use, and approval for the continued use of a school
at this site after the two year extension is not guaranteed,"
The staff was and is concerned with the long tenn use of this site as a school. The
potential for conflicts between the operations of industrial users and the comings and
goings and activities of children seem great, particularly when there is no provision for
on-site recreation, but children must be chaperoned to and from Scobee Park for their
recreation and physical education needs,
Although there may be little potential for conflict now since most of the immediately
sUITounding area is undeveloped, this condition can change in a relatively short period of
time, The City in fact is now working with EastLake to create a "BioTech" zone which
would encourage and facilitate the establishment of bio-medical manufacturers in this
portion of the Business Center,
In a more general sense, the City Council has recently expressed concern over the
availability of industrial land and its rezoning to other uses, The EastLake Business
Center now represents perhaps the primary focus for high quality industrial park
development east of 1-805, Although the request by Covenant Christian is not a rezoning,
it would represent non-industrial use of industrial acreage and should be considered in
view of Council's concern.
Although we believe it is probably desirable to offer school (as well as day care) facilities
in close proximity to employment centers, the relationship between the uses must be
carefully preplanned in order to ensure that the operations of one do not have an adverse
impact on the other, With the expansion of the Business Center anticipated with
EastLake III, this parcel will be in the middle of a manufacturing district, and on a
property which contains no on-site playground facilities and inadequate parking to serve
both schools beyond the second year of shared use,
There is a concern for the welfare of the children over the long tenn, and there is also
a concern with the impact a school at this location may have on the decisions of bio tech
or other prospective manufacturers to locate within this area of the Business Center,
For these reasons, staff has taken the position from the outset that we could support only
a temporary, short-tenn permit of two years, subject to review and possible extension
based upon a reevaluation of development progress within the Business Center at the end

of that period, During that time, Covenant Christian could investigate the possibility of
expanding or redesigning the site to include on-site recreation and other measures to
perhaps support permanent school use, This issue, however, should be addressed in the
broader context of a plan amendment which would consider redesignating the property
to a CPF Community Purpose Facility site, rather than in the context of a conditional use
pennit.
Another issue with respect to this application is the fact that Bonita Country Day School
has raised several concerns with regard to sharing the facility with Covenant Christian,
These include traffic safety, parking, security, a relocation of their first floor classrooms
to accommodate Covenant Christian, as well as a possible conflict in operations resulting
from two different schools with "two different philosophies" sharing the same facilities,
The most significant of these issues from a land use perspective are traffic safety and
parking, Traffic safety in terms of potential conflicts with the timing and guidelines
under which drop-offs and pick-ups occur, and parking in terms of its inadequacy to meet
the needs of both schools beyond the second year, The property owner, Covenant
Christian and Bonita Country Day have met and exchanged correspondence regarding
these issues, but they have yet to be resolved,
Based upon the foregoing, staff is recommending that approval be given for two-years of
use subject to review and possible extension per the conditions contained in the attached
Resolution,

RESOLUTION NO. PCC-94-09
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CHULA VISTA APPROVING A CONDITIONAL USE PERMIT TO
ESTABLISH A PRIV ATE SCHOOL AT 2400 FENTON STREET IN
THE EAS1LAKE BUSINESS CENTER
WHEREAS, a duly verified application for a conditional use permit was filed with the City of
Chula Vista Planning Department on August 18, 1993, by Covenant Christian School, and
WHEREAS, said application requests approval to establish and operate a private school for a
minimum five year period at 2400 Fenton Street (APN 595-232-11) in the EastLake Business Center,
and
WHEREAS, the Planning Director set the time and place for a hearing on said conditional use
permit application and notice of said hearing, together with its purpose, was given by its publication in
a newspaper of general circulation in the city and its mailing to property owners within 500 feet of the
exterior boundaries of the property at least 10 days prior to the hearing, and
WHEREAS, the hearing was held at the time and place as advertised, namely October 27, 1993
at 7;00 p,m, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said
hearing was thereafter closed, and
WHEREAS, the Environmental Review Coordinator has found the project exempt from
environmental review as a Class lea) exemption,
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION hereby
finds as follows:
1. That the proposed use at the location is necessary or desirable to provide a service or
facility which will contribute to the general well being of the neighborhood or the
community.
The site represents a suitable interim location for the school to continue to meet the private
educational needs of the community provided the circumstances which favor approval at this time
are subject to review and reconsideration in two years time to determine if the development of
the surrounding area and/or any changes in the plans or regulations of the Business Cenler may
result in a conflict in uses,
2, That such use will not under the circumstances of the particular case, be detrimental the
health, safety or general welfare of persons residing or working in the vicinity or injurious
to property or improvements in the vicinity,
The present lack of development immediately surrounding the site should ameliorate any potential
conflicts between uses. The permit, as conditioned, will further ensure compatibility with co-
tenants and other properties within the Business Center, and will allow review and
reconsideration of these circumstances within two years time.
3, That the proposed use will comply with the regulations and conditions specified in the
Municipal Code for such use.
The approval of the pennit, as conditioned, will require the use to comply with all applicable
regulations, codes and requirements,
4, That the granting of this conditional use permit will not adversely affect the general plan
of the City or the adopted plan of any government agency,
With the approval of this pennit and the implement of all conditions, the use will be consistent
with the General Plan and EastLake PC District regulations.
BE IT FURTHER RESOLVED THAT THE CITY PLANNING COMMISSION hereby approves
the conditional use pennit subject to the following conditions:
1. The pennit is approved for a period of two years (until October 27, 1995). The pennit may be
considered by the Planning Commission for renewal and extension beyond that date provided a
written request therefor, along with the required fee, exhibits and infonnation, is received,
deemed complete and approved at least 30 days but no more than 120 days prior to the expiration
date.
The primary factors to be considered in renewing and extending the pennit is the potential for
conflict with surrounding development and/or any changes in the plans for the Business Center,
2, Prior to occupancy the property owner shall submit to the Director of Planning a program to
avoid traffic conflicts and allocate parking between the two schools and any other potential
building tenants per City standards. Said program shall be agreeable to and signed by
representatives from both schools, or shall be shown to be legally enforceable by the property
owner/landlord,
3, Prior to occupancy the applicant shall submit a schedule of outdoor recreational and physical
education activities which confonns with the parameters of use approved by the EastLake
Business Center Owners Association,
4, The occupancy of the building by Covenant Christian shall not exceed the staff/student figures
provided by the applicant, Le" 24 staff and 208 total students consisting of 122 students in grades
K-6, 46 students in grades 7-9, and 40 students in grades 10-12, and/or the number of
staff/students indicated by the parking allocation program, whichever is less,
5, All on-site school activities, including recess and recreation, and pre-school and post-school
activities, shall be limited to the inside of the building,
6, Trained, unifonned adult crossing guards shall be provided at the intersection of Fenton Street
and Lane Avenue to oversee and protect the children on all trips to and from Scobee Park.
7, Prior to occupancy the school shall comply wilh all of the codes, requirements and conditions
imposed by the Department of Building and Housing and the Fire Department.
8, By the acceptance of this pennit, the applicant acknowledges that the school has been approved
as an interim use, and its occupancy of the facilities at 2400 Fenton Street shall in no way restrict
the use of adjacent properties from uses otherwise deemed appropriate under the Business Center
PC District Regulations.
9, This pennit shall be subject to any and all new, modified, or deleted conditions imposed after
approval of this pennit to advance a legitimate governmental interest related to health, safety or
welfare which City shall impose after advance written notice to the pennittee and after the City
has given to the pennittee the right to be heard with regard thereto, However, the City, in
exercising this reserved right/condition, may not impose a substantial expense or deprive
Pennittee of a substantial revenues source which the Pennittee can not, in the normal operation
of the use pennitted, be expected to economically recover,
10, This conditional use pennit shall become void and ineffective if not utilized within one year from
the effective date thereof, in accordance with Section 19,14,260 of the Municipal Code, Failure
to comply with any condition of approval shall cause this pennit to be reviewed by the City for
additional conditions or revocation,

RE: Further requested information re: our request for a Conditional Use Permit
for the use of the property at 2400 Fenton Street, Chola Vista, CA
Please find attached a written addendum, dated September 23, 1993. from our headmaster, Mr,
Mark Dolan. to Mr. Curt Stephenson of the Eastlake Business Center Owner's Association with
further outlines the matters discussed and agreed upon re: our students' use of Scobee Park for
recreational and physical education purposes.
I have been able to find out the folowing infonnation about the current scheduling of recess and
physical education times for our elementary school:
Recess for grades K-2 (42 children) - 10:00-10: 15 a.m. (M-F)
Recess for grades 3-6 (42 children) -- 10: 15-10:30 a.m. (M-F)
Lunch recess for grades K-6 (99 children) -- 11:40 a.m, - 12:15 p,m. M-Th (Fri. is half-day)
Physical eduction class for grades 3-4 (23 children) -- 1:45-2:15 p,m. (MfTh)
Physical eduction class for grades Kil or Ki2 (29 children) -- 2:00-2:20 p,m, (alL M-Th)
Physical eduction class for grades 5-6 (24 children) -- 2: 15-2:45 p,m. (M/W)
As you can see from the current schedule, the classes are di vided so that only a portion of the
students are at recess or P,E. at one time, The children currently all have their lunch recess togeth-
er since the elemetary schedule must be made to mesh with the secondary school schedule. That
will not be necessary at the new facility, and the schedule will be adjusted to meet the hours sched-
uled for our use of Scobee Park. The same will be the case with the times of morning recesses,
but a similar breakdown of classes will probably be followed.
As I mentioned on the phone yesterday to Ms. Wolfe, it is not practicable (nor do I believe it
necessary) for us to come up with a projected schedule for our classes in the new facility, There
are just too many variables, and we do not want to be morally bound to keep to a schedule that is
just "best-guess work" made in order to anwer one of many questions about minutae of our
school's internal operation, I lrust this infonnation I've provided will indicate that we share the
city's concern for the well-being of our students, and will schedule things to the maximum benefit
of our students within the limitations outlined by the EBCOA for the use of the park,
As to the question of our students' eating lunch in the park. Mr, Dolan tells me the matter did
not come up in our discussions with the EBCOA, They did not raise it as a concern. and we did
not have any particular plans on the subject one way or the other,

RE: ^ddendum to Covenant Christian School's Proposed Use of Scobee Park
At a meeting yesterday with the Scohee Park's Roard of Directors, ~e\eral key
questions concerning our ~ch()ol's use of the park were raised to us which we had
overlooked in the written proposal. While I believe these were addressed at the meeting,
we would like to update our proposal with the following Information,
Covenant Christian School (CeS), a non-profit and private Christian school
currently serving a student population of 160 students in grades kindergarten through
12. [t was established in Chula Vista in 1'176. It has consistently prodded a well-rounded
academic education, rich in the liberal arts, with a mission to integrate bihlical truth
InlO the world and life view It teaches its students. We ohserve a traditional school \'ear
calendar, breaking for the usual Christmas, [:aster, and summer vacations, In addltl"n to
customary school holidays.
Initially, our goal in mo\'ing to the renton Street building Is to secure a larger
facility for 'mly our elementary ~chool. comprised of about Ion students presentl\', .tnd
to prO\ ide for expansion to appr<Jximately 14() students there within two ye:Jrs. Our
longer-term goal Is to reunite the two Gtmpuses in East Lake In the third year to include
.t total school population of approximately 250, Obviously, this second phase is

facilitate safe student crossings, trained crossing guards and supercislng teC1chers will
C1ccompany the students at all times to and from the park. Group crossings will he made
.It the ,cheduled times for park use, (We ha\'e accommodated a similar prohlem in our
currel11 location.) The best appC1rent location for ~tudent crossing is oorth .teross
renton, and then west 'teross I ane to the renton Street entrance to the park.
All 'Jf our students are covered bv accident and liabillt\' insurance which co\'Crs
such df-c:Jmpus trips. Additionally, we -are willing to agree to any indemnity clause to
protect the Eastlake Business Center Owners ,\ssociation or the Scohee Park Directors for
any possible damage or loss resulting from our use,

RE: Further information reI our request for a Conditional Use Permit for the use
of the property at 2400 Fenton Street, Chola Vista, CA
Please find attached a revised plot plan for the facility at 24(X) Fenton Street. Chula Vista. CA.
The revised drawing eliminates the previously requested portion of parking lot for playground
usage. and the indications of evacuation areas in case of fire or other emergency. It also indicates
the exterior doorways which will be used by students to enter and leave the building and the entrys
which will be available to the public.
Also included is a copy of our signed agreement with the Eastlake Business Center Owner's
Association for the use by our students of Scobee Park for recreational and physical education pur-
poses.
In view of these changes. we herewith present a revised use profile for the facility:
1. PROPOSED USE
The applicant proposes to use this facility for the operation of a non-profit. religious (Christian)
day school comprised of grades kindergarten through twelfth. Covenant Christian School has
been offering an alternative educational opportunity in the Chula Vista community for nearly twenty
years. having operated at 505 E. Naples St.. Chula Vista. CA since its founding in 1976. It has a
multi-racial and multi-national constituency made up of families who reside primarily in Chula

The proposed lease of this property is for a period of five (5) years. with an optional five-year
extension. The school sees this site has having both short-tenn and long-tenn potential for
accommodating a thriving, growing school into the next century,
2, STUDENT POPULATION
The current enrollment of the school stands at a total of 165, It is our intention to move grades
K-6 to the new building for the 1993/94 academic year, This will mean a first year occupancy of
approx. 100 students (perhaps adding 20 students during the course of the school year). The re-
mainder of the student body (grades 7-12) will remain at our current facility at 505 E. Naples
Street. Chula Vista.
We continue to project an incremental growth over the next five years (see the scheduled break-
down below) which could bring the size of the total student body at the Fenton Street location to

There are presently approximately 20 members of the administration, faculty, and staff. The
anticipated growth in student population might require the addition of 5-10 more faculty/staff per-

3, HOURS OF OPERATION
The hours during which classes are heJd are 8: 15 AM - 3:00 PM (Monday - Thursday) and
8: 15 AM _ 12:00 noon (Fridays), Staff usually begins arriving around 7:30 AM and remains until
about 4:00 PM, A supervised child-care program for students who must be dropped off early or
remain at school until they can be picked up by their parents is provided from7:(X)-8: 15 AM and
from 3:00-6:00 PM,
4. PARKING
There is a total of 65 available parking spaces on sight, of which 20 spaces are needed by the
other tenant of the building, Bonita Country Day School.
According to the mandated ratio of parking to pupils, we would need a total of 20 spaces for
the current size of our student body, and would need a total of 59 for our projected maximum en-
rollment of c. 260 students (see the scheduled breakdown below),

5. TRAFFIC FLOW ON TIlE PROPERTY
Parents will use the two driveway entrances on the north end of the property to drop off and
pick up students before and after school (see attached figtlre), Faculty and staff parking will !1c
along the east side of the building as indicated, There will be no anticipated traffic to lhe rear
(south) end of the parking area during !\Chool hours, A turn-around hammer-head area for emer-
gency vehicles is provided in the rear of the building and will not be obstrtlcted hy school use, In

6, OUTDOOR RECREATION SPACE
The applicant has received pennission from the Eastlake Business Center Owner's Association
for the use by our students of Scobee Park for recreational and physical education purposes (see at-
tached agreement). The applicant is agreeable to the conditions set forth by the EBCOA. and will
schedule its recreational and physical education classes 10 coincide with the times indicated by the
EBCOA (i.e.. 9:30-11:30 a.m. and 1:30-4:00 p,m, Monday through Friday), The children's pas-
sage to and from the park will be supervised by qualified staff personnel from CCS.

S, Should a conflict arise between an owner wishing to use

Park by the school, Covenant Christian School agrees to

6. The maximum number of students in the Park at anyone
time shall be 100, Groups of 2S or more must be
supervised by a minimum of two teachers,
7. Any excessive or unusual damage to Park facilities,
landscaping, or apparatus attributable to Covenant
Christian School shall be reimbursed by the School.

and Manager of the Association reserve the right to
rescind this approval for the use of the Park by
Covenant Christian School.
Additionally, although this is not a restriction, we wish to
alert you so that you can plan accordingly of the landscape
maintenance schedule, currently we have heavy mowers in the Park

On the matter of what BCDS calls "Forced Violation" -- I,e., that without access to ground
floor space for their younger students I which BCDS has not leased, but have been allowed by the
owners to use on a month-to-month basis until the lower tloor was leased to other tenants) BCDS
would have to either discontinue their K-2 grades or move them upstairs. which would be a viola-
tion uf their C.U.P, -- CCS made the offer mentioned above to make space on the ground Iloor
available to BCDS for the duration of the upcoming school year. Such an adjustment (if agreeable)
wiil be retlected in the first year of the fi\'e year !ease,
For the record it should be noted that the representatives of BCDS did not themselves make any
?romises to adjust their program ()r use of the facility in order to assist CCS in the conduct of our
educational program, Apparently. in then view, :he matter of concession and :lccommodation is
soiey the responsibility of the owners and the new tenant,

Dear Mr. Griffin:
At this time. Bonita Country Day School has no alternative
location for the school classrooms. We expect to stay at 2400
Fenton Street in the Eastlalce area of Chula Vista where the
school has been located under a C.U.P. since 1991. The school's
sma11 enro11ment and very sma11 closs size has a110wed us to
operate in this office-type building with very few problems.
Since the facility has served us we11 and we hove no other
option for relocation. it is our intention to apply for a two year
extension of our C.U.P. which would expire in August 1993. It
appears that the building under consideration. at 2400 Fenton
Street. has gone into foreclosure proceedings. If the R.T.C.
tokes control of the building. Bonito Country Day School would
most lilcely be able to negotiate a lease which wi11 coincide
with a C.U.P. extension.
With regard to the possible relocation of Covenant Christian
School to 2400 Fenton Street. Bonita Country Day School is very
concerned over the safety of the children of both schools.

provided by Covenant Christian School in their app1ication.) In a
memorandum dated September t 3, t 993 one of the owners of the
building, Gordon Dunfee, proposed to relocate the ground floor
classroom space to be used by Bonita Country Day School. The
space designated in the drawing is not satisfactory for our use
for the fol1owing reasons:
L Water seeps through the f100r during the rainy season
which presents a health hazard to children occupying that
area. This can be verHied by contacting EastLalce
Communi ty Church who rented space where the seepage
occurs.
2. The classroom space designated for BCD does not meet
building code requirement of 20 sq. ft. per child.
3. I question whether the designated space for BCD would
meet the fire department.s requirements for access to the
to the outside in case of an emergency.
I question the use of bathroom facilities designated in the above
mentioned memorandum. The drawing is unclear as to whether
the space designated for the use of BCD is actually separated
from the rest of the ground f100r. If so, does that give BCD the
exclusive use of the bathrooms so designated? If that is the
case then 200 students plus staff of 20 would be left with
insufficient bathroom faci1ities. If that is not the case, no
consideration has been given to the safety of any of the children
in a co-mingling situation.
With the safety of the children the foremost consideration, I am
still very concerned about the amount of traffic converging at

an uncontrol1ed intersection during arrival and departure times,
which are the same for both schools, and the haiordous traffic
flow at the front door of the facility.
Bonita Country Day School holds firm to the belief that two
different schools with two different philosophies would find it
impossible to operate at the same location because of the high
potential of ongoing conflict of operations_ If you remember the
statement made by Roger Wagner of Covenant Christian School at
the August 25th t 993 meeting, CCS occupancy of 2400 Fenton
Street would be harmful to Bonita Country Day School.
It is my understanding that Covenant Christian School requires a
larger facility than they currently occupy in order to increase
their enrol1ment. It seems to me that the school would be
seeking a more permanent location rather than a two year term
at 2400 Fenton Street.

Not only did CCS neglect to consider the amount of
parking needed by both schools, but they propose to use

classrooms Wh1Ch overlook the park1ng lot, we see this
as a distract10n to the qU1et classroom environment
that is needed for learning,
II) NUMBER OF STUDENTS: As per meeting on September 9,
1993 between Mr, Dunfee and AssOc1ates, CCS and Bonita
Country Day School, CCS st3ted that they would have
seventy or fewer students during the1r f1rst operat1ng
year at the 2400 Fenton Street fac1l1ty. ThiS was an
1mportant conceSS1on that was nonexistent in the
attached memorandum from Mr. Dunfee,
III) SAFETY: We bel1eve that separate entr3nces for both
students and parents would help ma1nta1n autonomy and
securlty of both part1es, We also bel1eve that the
safety 1ssue 1ncludes seriOUS questions about the
density of students that is proposed by CCS now and in
the future,
It is our understanding that for reasons of fire
safety, children 1n grades Kindergarten through second
requ1re a dlrect access to the outside of the building
via an outside door from the classroom, We, therefore
have three problems with the proposed relocation of our
Kindergarten through second grade classrooms, First,
the area proposed has no d1rect outside access,
Second, there 1S too llttle square footage for the two
classes presently requ1r1ng space on the first floor.
Thlrd, there 1S a problem w1th water r1s1ng up through
the flooring ln the section of the building that is
proposed for use of our young students, This is a
health hazard, and is hardly suitable for classroom
space.
IV) TRAFFIC: Bonita Country Day School has observed the
dropping off and picking up of students at this
facility for two full years, and with fewer than fifty
students, we have found it important to constantly
monItor the movement of vehIcles on and off the
property, Our experience suggests that, with the

very serious threat to the safety of all students,
V) SECURITY: Further consideration must be made to

most likely to offer a threat to the safety and
securIty of all the children, The number of students
proposed by CCS guarantee that there will be large
numbers of parents on the grounds both In the morning

MEMORANDUM OF UNDERSTANDING
TO: CALIFORNIA LAND ASSOCIATES, NO. 1 (OWNER), COVENANT
CHRISTIAN SCHOOL ("CCS"), BONITA COUNTRY DAY. SCHOOL
("BCDS"), DUNCAN DODD, and DAN MALCOLM

RE: JOINT USE OF 2400 FENTON STREET, CHULA VISTA
In response to the objections submitted by BCDS in a August 24,
1993 letter to the City of Chula vista Planning Department, the
parties assembled with the intent to discuss and resolve as many
BCDS objections as possible. As a res~lt of the meeting that took
place August 9, 1993, 6:30 p.m. at Jake's, Chula Vista, the
following solutions were proposed:
1, safety: There will be separate identified entrances for the
schools so that the students can enter and exit through their
respective doors. Only faculty, ~taff, and the public would
be permitted to enter through the front, two-story entry.
2. Containment: Both schools made statements that their student
popula~~ons are tightly controlled through teacher/staff
superv1s10n. Further, it was agreed that the BCDS will not be
permitted access to the ground floor, except as to designated
areas ,reserved for the K-2 first floor programs, and that CCS
shall not have access to BCDS's second floor leased areas.
3, Schedule.: Both schools operate on the typical school day
schedule,
4, Noi.e: By restricting use of the front two-story lobby to
adults only, this problem will be addressed. As to hallway
noise, the closed doors between floors will prevent excessive
noise from both users.
5, Security: Without students from CCS having access to the front
entry, this should not be a problem. If necessary, the owners
will install additional doors, per code, to provide
additional security for the second floor.

6, Traffio! BCDS has stated that Ms, Catanzaro is present daily
to monitor traffic of parents and students, CCS is willing to
provide a staff member to monito~ their traffic and parking.
Owner has offered to mark parking stalls, and provide signs
for traffic direction and student movement.
7, Business! BCDS and CCS will address their own business plans.
S, Violation! See the attached floor plan, as proposed by CCS.
with these issues addressed, it is anticipated that BCDS will
withdraw it's letter of objection. If ~here is no withdrawal, the
understandings and agreements cOI1':ained in this memo are
rescinded, If any party has any comments, please call me and I
will modify this memo, if everyone agrees, and we will then
submit to the City Planning Departments.
September 16, 1993: This memorandum has been reviewed and
approved by CCS. This was faxed to BCDS on Monday, September 13,
1993 with the notation that we wanted to file it with the City
the next day. I followed it up with a telephone call to BCDS on
September 14, 1993. I spoke with Paul Catanzaro and told him I
wanted to submit this to the City of Chula vista that afternoon,
He stated he was too busy to respond then, but would do so later
that day. I still have not rec~ived a call, fax, or letter in

It has come to mv attention that Covenant Crwlstlan School has
submitted an application for a conditional use permit for the use of the
first floor of the facility at 2400 Fenton Street Chula V1sta. Bonita
Country Day School currently operates a school on a conditional use
permit at the same address,
I have a number of objections to the form of thiS application submitted
by Covenant Christian School. There are many dIfficult and delicate
Issues which could have a tremendous effect on either or both of the
schools Involved, These 1ssued should be addressed by the parties
concerned before the Issuance of a permit Is entertained.
Some of our concerns are as follows:
SAFETY
, 70 students upstaIrs plus another 165 - 266 students proposed for
downstalrs:arriving and leaving about the same time wi 11 create a
congested situation which could endanger ,,]1 of the students,
CONT AII'NENT
No proposal has been addressed regarding how to conta1n and control the
large student body throughout the day and especially for use of
restrooms and the surrounding grounds during lunchtime.
DIFFERENT SCHEDULES
No conversation on how the other school's schedule will disrupt the
existing operatIOns of Bonita Country Day School.

No walls or doors separate the main entries to the main bUl1ding, The
noise from the front entry and the downstaJrs hallways echos throughout
the bul1djng.
SECURITY
Bonita Country Day School has no present means of securing It's space
from a large student population downstairs,
TRAFFIC
The applicant school proposes a population of 270 which Is comprised of
students, staff and administration, They ar~ proposing daily trips out of
east lake area for physical education which we have calculated to be
1860 trips to be made each dav. This 1s in addition to the traffic from
Bonita Country Day School.
DISRUPTION OF BUSINESS
A great disruption of the way Bonita CountfY Day School has conducted
business under the present school permit will occur, There has been no
effort from Mr. Malcolm, Mr. Dodd or Mr, Dunfee to seek our input. In fact
the contrary exists as there is every indication that we were purposly
made unaware of the facts, without regard to our students or the
school's ab111ty to function,
FORCED VIOLATION
This proposal to add a new school in the existing facility at 2400 Fenton
'Street puts Bonita Country Day School in violation of our existing use
permit by not having first floor space for grades K-2nd as well as
handicapped students,
In lIght of the concerns that have been addressed above, we ask that
careful consideration be placed on the decision to grant the conditional
use permit to the applicant school.
