BACKGROl'ND 1. ~ The application. submined by Ms. Elizabeth Annette Stillwagon of Chula Vista Connection (CVC), requests authorization to establish a day nursery at 73 Nonh Second Avenue (APN 563-310-26 - the old Southwood Psychiatric site) (see site plan - Anachment "A") for a maximum of 250 children. Hours of operation will be from 6:00 a.m. to 7:00 p.m.. Monday through Friday. The applicant also wishes to place a live-in security guard on-site. An Initial Study. lS-93-27. of possible adverse environmental impacts of the project was conducted by the Environmental Review Coordinator. The Emironmental Review Coordinator concluded that there would be no significant emironn1ental effects and recommends thaI the draft Mitigated Negative Declaration for IS-93-27 be adopted. B. REC0',1'.!E;\DA TION Adopt Resolution PCC-93-25 which: 1. Finds that this project will have no significant environmental impacts and adopts the draft \1itigated Negative Declaration issued on lS-93-27 based on the Initial Study and comments on the Initial Study and draft Mitigated Negative Declaration: and 2. Approves PCC-93-25 based on the findings and subject to the conditions contained therein. C. DISCUSSION l. Existing Site Characteristics: The proposed project is located on a 4.8 acre site situated on a ridge line at the northern end of North Second A venue. The property is irregularly shaped with the eastern property line running generally north/south, while the western property line is shaped by the curvature of North Second Avenue as it descends into the Sweetwater Riwr Valley and becomes Edgemere A venue. The property drops off sharply to the east and somewhat sharply to the north and northeast, but more gently to the west. The property is at-grade with North Second A venue at its southern edge where the two access driveways are located. The site contains two main buildings. several accessory buildings. and approximately 54 on-site parking spaces. CVC plans to occupy the larger 23,000 square foot structure on the northern three quarters of the site as well as approximately 700 additional square feet consisting of the education building between the two main structures. which will be used as an art area: the triangular recreational building to the north of the main structure: and a smaller storage building along the northeastern edge of the site. On the same parcel but to the north of the main structure are open slopes which drop to Edgemere /\\'enue and the entrance the KOA Kampground. The parcel's northern- most line is located here. Across Edgemere Avenue to the north is the entrance to a condominium complex Single-family homes are located to the west and south across 1\orth Second Awnue. The existing facility has been used in the past as a residential treatment facility for emotionally disturbed youth. first by Vista Hill and more recently by Southwood Psychiatric. In February of 1991. Southwood vacated the site and consolidated operations at their Third A venue facility. On November 6, 1991, a conditional use permit, PCC-92-06, was granted to Nosotros for a two-year period establishing the MAAC Project care facility. a 12-bed residential treatment facility for recovering alcoholics. This facility uses the smaller of the two main structures. located on the southerly portion of the property, as well as three adjacent prefabricated structures and 10 of 24 off-street parking spaces. The estimated stay for a resident at Nosotros is between three months and one year. 3. Proposed Use: CVC plans to lease the facility for five to ten years and is proposing to provide a day nursery facility for a maximum of 250 children primarily from low income families. fIOME PLAt.'"NJ"SG .\IAR"fr.\;C\'( 9J25PCRPT ~..~ City Planning Commission Agenda Item for Meeting of June 23. 1993 Page #3 The facility is approximately 23,000 sq. ft. in size, and will allow, according to State licensing criteria, 250 children maximum. The hours of operation will be from 6:00 a.m. to 7:00 p.m.. Monday to Friday. In addition. CVC intends to use three buses to pick up children after school. These will be stored on-site. To ensure the physical security of the facility. CVC is proposing to place a live-in guard in the main building. Besides ensuring the security of the complex, the guard will also help maintain the lawns and landscaped areas. Closed-circuit cameras will also be placed at various locations around the facility to enhance security. D. Ai'iAL YSlS GENERAL PLA:\'/ZO:'i'ING ORDINANCE CONFORMANCE: The parcel is zoned R-3 and is intended to ha\e a General Plan designation of Public/Quasi-Public once the Lower Sweetwater Special Study Area General Plan Amendment has been processed. While there are no specific goals and objecti\es in the General Plan that apply to this project. there are none that it conflicts with. The use is. in fact. considered to be a "day nursery" and is defined in the Zoning Ordinance as: 19.04.064 Day nursery. "Day nursery" means day nurseries for working mothers: nursery schools for children under the minImum age of admission to public schools: parent-cooperative nursery schools: play groups for pre-school children: programs gi\ing after-school care to school children; all other lypes of group day care programs. The term "day nursery" does not include: Family day care homes: facilities offering twenty-four hour care: regular elementary schools which offer educational programs only. A day nursery requires a conditional use permit if it is proposed to be located in the R- 3 Zoning District. as in this case. As long as it can meel the standards for parking. traffic. access, and other such Municipal Code criteria it can be approved. This project requires only Planning Commission approval unless appealed. LAND USE COMP A TIBIUTY: Because the site is designed for institutional uses. and because of its separation from adjoining uses, the project is considered to be compatible with surrounding land uses. In the case of the MAAC Project, a fence will separate the two uses. HO\fE PLA~;-";I!"G _~ARTr~ cvc 93~5PCRPT .:>..,3 City Planning Commission Agenda Item for Meeting of June 23. 1993 Page #4 LANDSCAPE TREATMENT: The project is subject to the Municipal Code requirements regarding landscaping and the applicant must submit a fully detailed landscape plan to the Planning Department for review and approval by the City Landscape Architect. TRAFFIC/CIRCULATIOl'l/ACCESS/PARKING: To ensure safe ingress 10 and egress from the complex, the project is conditioned such that the northern or downhill access and existing parking areas shall be reconfigured (see site plan - Attachment "A"). In addition. parking is being added across from the main entrance to the facility. The hillside immediately adjacent to this access point to the north will be cut back so the driveway can be widened and a retaining wall added to increase the sight distance for traffic exiting at this location. A fence will be added at the northern edge of the building across the northern driveway as well as a fence separating the MAAC Project from this project. The parking spaces on the eastern side of the property between the two fences will be deleted to make room for additional play area. In the western parking area se\'eral changes will be made. The existing angled parking will be re-striped to be 90 degrees. The existing 10 parking spaces immediately on the left after entering will be pushed back sC\eral feet to ensure adequate back up space. With the 90 degree parking. this area will accommodate 11 spaces. Eleven new parking spaces will be added immediately across from the main entrance. The site plan shows 10 spaces. however, to meet the requirements. II will have to be added. There is adequate area to do this. Five new parallel parking spaces will be added along the northwestern edge of the paved driveway area. The existing three parking spaces between the main structure and the small art building will be replaced by two handicapped parking spaces. The parking area at the southeast portion of the site will be restriped for 18 spaces which are reserved for CVC's exclusive use. With the above changes. the si1e will contain 65 parking spaces: 37 in the western parking area and 28 in the southeastern parking area (37 + 28 = 65). With the ten spaces reserved for MAAC, and based on a ratio of one space per 10 children and one per teacher used by the Zoning Administrator for other day care providers in the city. the minimum requirement is 55 parking spaces for the day nursery ((250 capacity, 10 = 25 spaces) + (I space per teacher/staff = 30) = 25 + 30 = 55). The project will meet the required minimum. The property O\'mer has agreed that 18 of the 28 spaces can be dedicated to CVC, since the 10 spaces reserved for Nosotros/MAAC Project meets their needs. Most of the 25 teachers and staff will either car pool. be dropped off by their spouse or take public transit when comenient. In addition, those teachers and staff who drive will be required to park on-site but in the southeastern parking area so as to leave the other spaces available for drop off/pick up. Approximately 25% of the children are school age and will be picked up by busses from school in the afternoon. The most critical time for morning drop off is between 7:00 a.m. and 7:30 a.m.. during which the majority of the children are dropped off Most families have two children or more enrolled and. therefore. approximately 30 to 35 automobiles can be expected during this 30 minute period. Howner, if it is found that several children live in close proximity to each other. CVC will schedule its own bus service to pick up and deliver these children from home to the facility. thus reducing the parking demand even more during this critical period. Until enrollment begins. this service cannot be scheduled. Pick ups are more evenl) distributed between 4:00 p.m. and 7:00 p.m.. and thus should not represent a problem. To ensure parking. circulation and access function as foreseen, this project is conditioned for staff monitoring and review after one year, If after one year problems have been found. solutions will be sought. If a problem related to parking. circulation or access can not be solved. the project will be brought before the Planning Commission for additional conditions or revocation. NOISE: Because the play areas are located along the east side of the site, away from any residen1ial areas, City noise standards will be met and a noise study will not be required. SITE HISTORY: This facility has historically been used for institutional purposes such as residential treatment/rehabilitation, including Vista Hill and Southwood Psychiatric facilities, and now the Nosotros/MAAC Project. DAY NURSERY ST AFFIJIOG: CVC will exceed State requirements for staffing. The State of California requires 1 teacher per 12 children over 2 years old, and I adult per 4 children under 2 years old. evc proposes to begin with about 25 teachers/ directors for 100 children. but will not drop below a ratio of I teacher per 10 children oyer 2 years old as enrollment increases. eve will meet the minimum state ratio of I to 4 for children under 2 years old when infants are eventually added to the program. Children will range in age from 1.5 years to a maximum of 12 years old. In addition to the 25 teachers. there will be 5 other staff members (administrators, cooks). Part of the staff will be State licensed counselors who will be on-site to counsel any "problem children" in order to assist them to overcome their particular difficulties. Children will be allowed to play outside in shifts with no more than 20 children in the play areas outside the courtyard. CVC has established a hierarchy for admitting children. This hierarchy of preference is as follows: I. Children from low income families residing in Chula Vista. ') Children from medium and high income families residing in Chula Vista. 3. Children from low income families residing in surrounding communities (1\ational City. South San Diego). 4. Children from medium and high income families residing In surrounding communities (1\iational City. South San Diego). Part of the purpose of CVe. as stated in the Constitution and B\-Laws (Attachment "B") and Articles of Incorporation (Attachment "C"). is to pro\ide affordable child care for children who would otherwise be left alone a1 home after school ("latch-key children") in order to pro\'ide for them a place that is stable and safe. It should be noted that acti\'ities related to the other purposes listed in the Articles of Incorporation (help the homeless. aid the needy and lower income families: help in youth awareness. pre\ent gang acti\'ities) will not be carried out at 73 North Second Avenue other raising funds which support cve s efforts to address these problems. Chula Vista Connection has no religious affiliation. It is a charitable. non-profit organization with Section 50l(c)(3) (Attachment "D") designation. Even though CVC provides a variety of services to low income families, it does not provide counselling for parents. If the parents of a child need counselling, they will be referred to a competent. licensed agency. The only counselling on-site will be for children. Neither will there be parenting classes. Parents requesting such classes will be referred to an organization offering such courses. The minimal amount paid by families, if any, does not support this project and therefore financial support for CVC comes from fund raisers (door-to-door sales of discount booklets. candy. etc.). The proj ect si te is currently being assigned a new address as 3 N. Second Avenue in Chula Vista. The parcel is situated on a ridge line, which drops off sharply to the east towards the KOA Campground and more gently towards the west and north. Although the project site does not fall within the boundaries of the proposed Chula Vista Heritage District, the buildings on site are considered by the Chula Vista Historical Society to be of historic value. No alterations will be made to the exterior of the existing historic structures on site. The exiscing 23,000 square foot building was previously used as the Southwood Psychiatric Hospital until February of 1991. That facility provided on-site sleeping quarters and social services for approximately 56 mentally-challenged children. In addition to the .children being housed on site, approximately 100 administrative and miscellaneous staff were on site to run the facility. Since the time that Southwood vacated the premises in 1991, a number of uses have been proposed, and two uses have been conditionally approved to occupy the site. First, Pac Tel Cellular was issued a conditional use permit (PCC 91-48) to install an unmanned cellular radio base station on the roof line of the southern-most building, which now houses the MAAC facility. The MAAC facility was conditionally approved in 1992 to occupy the smaller of the two main structures on site (approximately 3,000 square feet) for use as a culturally-specific residential recovery home (PCC 92-06). Three adjacent mobile trailers are used in conjunction with this facility for classroom use. city of chuJa vista planning department environmental review section ~(~ -.- F__---.,;~ ~- - CITY Of CHULA VISTA ~,~. -2- Numerous code enforcement violations have been issued to the owner of the property since 1991. Complaints have included reports from neighbors that sewage was overflowing along the eastern property line towards the KOA Campground facility. Complaints have also been issued from neighbors regarding transients utilizing the vacant portions of the site, as well as concerns regarding the general lack of site maintenance. B. proiect Description: The proposed "Chula Vista Connection" day-care facility would utilize the vacated structures on the northern portion of the site for the provision of day-care facilities for disadvantaged children. The total size of the facility is approximately 30,000 square feet including detached structures. The approximate ages of the children accepted into the facility would be from one and one-half years old to twelve years old. The day-care facility would be conditionally-approved to provide educational and recreational opportunities for up to 250 children, which is the maximum number allowed by the State of California for this type of day-care facility. The Chula Vista Connection would lease the site for approximately five to ten years. Children accepted into the facility must come from disadvantaged families residing in Chula Vista that would otherwise not be able to afford day-care services. Other children, such as those from medium- and high-income families and from low-income families outside Chula Vista could be accepted, if space allows. The screening of children to determine their eligibility will be done by the applicant, Liz Stillwagon. The Chula Vista Connection (CVC) would occupy the larger 23,000 square foot building located at the northerly portion of the site. In addition, the facility will utilize an additional 700 square foot education building located between the two main structures, a smaller storage building along the northeastern property line, and a triangular recreational building north of the main structure. Approximately three school buses or mini-vans will be stored on site for use in picking up school-age children and transporting them to the site. The day-care facility will capitalize on the under-utilized areas of the northern and eastern portions of the site for outdoor play activities. All outdoor play activities would be ~,.,( -3- confined to these structured play areas. The facility proposes to allow the children to engage in structured outdoor play activities on Monday through Friday, from 1:00 p.m. to 2:00 p.m. A private security guard will live on-site to provide twenty- four hour-a-day site security services. Camera surveillance equipment will be posted throughout the interior of the building to monitor the location of the children at all times and to promote their safety and welfare. Selected points on the exterior of the building may also be equipped with camera equipment for additional site security in the future. In addition to site security, the security guard will be responsible for keeping the grounds properly maintained to avoid the maintenance concerns which have bothered neighbors in the past. The proposed hours of operation for the day-care facility are 6:00 a.m. to 7:00 p.m. Monday through Friday. No day-care services wi 11 be provided on weekends, and no overnight sleeping facilities will be provided at any time. To meet the State- licensing criteria, one teacher must be available per 10 children at the facility. The credentials of the facility staff will be monitored by the appropriate State of California and County of San Diego licensing agency(ies) on an on-going basis. On-site monitoring will be conducted once a month by the licensing agency(ies) to ensure the adequate treatment of the children. ~"~a -4- State licensing personnel will periodically inspect the safety and cleanliness of the facility, as well as review the credentials of the day-care staff. The day-care facility will be required to comply with all of the mandated State of California and County of San Diego licensing criteria to operate a large day-care facility. C. Compatibility with Zoninq and Plans The existing zoning on the project site is "R-3" Residential and the general plan designation is "PQ" Public-Quasi Public. The proposed proj ect does not involve the change in any underlying zoning or land use designations. The proposed project is compatible with underlying land use designations on site, with approval of a conditional use permit to operate the day-care facility. E. Identification of Environmental Effects An initial study conducted by the City of Chula Vista determined that the proposed project could have one or more significant environmental effects. Subsequent revisions in the proj ect design have been implemented to reduce these effects to a level of less than significant. The project, as revised, now avoids or mitigates the potentially significant environmental effects previously identified, and the preparation of an Environmental Impact report (EIR) will not be required. A Mitigated Negative Declaration has been prepared in accordance with Section 15070 of the CEQA Guidelines. Specific mitigation measures have also been set forth in the Mitigation Monitoring Program which is included in Attachment "A". The following impacts have been determined to be potentially significant and are required to be mitigated to a level of less than significant. A discussion of each of these potentially significant impacts from the proposed project follows. SIGNIFICANT, BUT MITIGABLE IMPACTS Land Use/Community Character Impacts Land use impacts associated with the proposed day-care facility are primarily related to community character issues. Community character impacts reflect the compatibility of the ~ ,,;:, :fI -5- proposed day-care facility with surrounding land uses and conditionally-permitted uses on site. Surrounding land uses consist of single-family residential uses and open space to the south, single- and multi-family residential to the west, open space and industrial uses to the north, and the KOA Campground to the east. Surrounding zoning is "R- 3" Residential and "IL" Limited Industrial to the north, "A" Agriculture and "R-l" Single-family residential to the south, and R-l and R-3 P20 Residential to the west. The proposed day-care facility is not allowed by right in the R-3 zone and, therefore, is subject to a conditional use permit. The conditional use permit process provides a mechanism by which potential land use impacts can be addressed, monitored and enforced. If conflicts occur, measures can be taken to enforce compliance with the condi t ions of approval or to revoke the permi t . The CUP process also provides an annual review process so that neighbors can express any concerns they may have about the project after it has been in operation. The buildings on site were previously approved, through a conditional use permit process, for a residential psychiatric hospital. The facility housed approximately 56 mentally- disturbed children and approximately 100 daytime administrative and other staff. Since that facility vacated the premises in 1991 and moved its operation to another Chula Vista location, a number of code enforcement complaints have been filed on the property. The entire site was vacant for approximately one year before the MAAC facility moved in. During that time, neighbors filed complaints with the City about the inadequate maintenance of the grounds and the use of the site by transients. With the approval of a day-care facility on the site and the associated grounds maintenance and on-site security, it is anticipated that these types of complaints will be alleviated in the future. With compliance to the conditions of project approval for the day-care facility, as provided in the CUP (CUP 93-25), enforcement mechanisms exist to monitor potential land-use conflicts and reduce disturbances to the surrounding community. Any future complaints raised by the community regarding the day-care facility operations will be reviewed by Code Enforcement and Planning Department staff and an annual review process will allow community input once the project is in operation. Revocation proceedings will commence if code enforcement violations occur or if project conditions are not followed (see Section F) . ~,~~ -6- Through compl iance to the conditions of approval for the conditional use permit and adherence to the mitigation measures cited herein, potentially significant land use and community character impacts will be less than significant. Traffic/Circulation and Parkinq Impacts Site ingress and egress will be provided by an existing curb cut on N. Second Avenue. Access to the site will be limited to the northern-most existing driveway. The northerly driveway will be slightly reconfigured to allow for better si te distance at the proj ect entrance and to reduce any potential traffic safety hazards. The driveway entrance redesign will be conducted to the satisfaction of the City Engineer. The slope to the north of the existing driveway will be graded to widen the driveway, and a retaining wall will be placed on the graded slope to prevent erosion. Widening the driveway entrance will increase site distance for drivers exiting the site. The driveway entrance to the facility must be marked and posted to the satisfaction of the City Engineer. Currently, N. Second Avenue north of "C" Street is 40 feet wide from curb-to-curb. The existing average daily trips (ADT) on N. Second Avenue north of "C" Street is 7,360 ADT. In accordance with the City's Circulation Element of the General Plan, N. Second Avenue is a two lane Class II Collector (52'wide curb-to-curb) with a Level of Service "C" (LOS C) design of 12,000 ADT. The periods of peak traffic generation for the project will occur during the early morning (6:00 a.m. to 8:00 a.m.) and late afternoon and early evening (4:00 p.m. to 7:00 p.m.) drop off and pick up hours. Drop off and pick up will be facilitated within the site boundaries at the main building entrance in the central portion of the site, in order to keep traffic moving smoothly and to prevent traffic from backing up on Second Avenue. The amount of traffic generated by the facility operating with 250 children would be 1,250 trips per day (5 trips per day per child). The 1,250 ADT generated by the project will increase the existing trips on N. Second Avenue to 8,610 ADT. However, even with this increase in trips, the Level of Service will remain at LOS "C", which is within the acceptable range of LOS in accordance with the City of Chula Vista adopted policies. 0> ..:J5 -7- Therefore, based on the traffic analysis conducted by the City's Traffic Engineer, as well as historical traffic data for this roadway segment, no adverse traffic impacts are anticipated with implementation of the project. With compliance to the mitigation measures listed in Section F of this document, traffic and circulation impacts will be reduced to below a level of significance. PARKING IMPACTS: The existing parking areas on site will be restructured to accommodate the project and to meet the City's minimum parking standards. A total of 30 parking spaces are required to accommodate the 30 day-care staff (1 space per staff member) , and 25 spaces will be required to meet the City's standard of 1 space per 5 children. This results in a parking demand of 55 spaces total to meet City parking standards. A total of 65 off-street parking spaces are available on the project site. A total of 37 parking spaces will be provided on the Chula Vista Connection site, and an additional 18 parking spaces will be shared with the adjacent MAAC facility to accommodate teachers and staff. The remaining 10 parking spaces on site will be reserved for the MAAC facility. The off-street parking demand generated by the day-care facility will be handled completely on site. With a redesign of the existing parking areas to City standards, the project will exceed the City's minimum parking standards, and parking impacts will be less than significant. Noise Impacts The proposed project would utilize existing buildings for the provision of day-care facilities during the hours of 6:00 a.m. to 7:00 p.m. Monday through Friday. No day-care services will be allowed on weekends. Noise impacts expected from the proposed project are associated with the daily outdoor play activities which will be provided for the children. Because of the character of the surrounding community and its predominantly residential nature, the day-care facility could create potential noise impacts to surrounding residential uses. The closest residence is over 250 feet west of the day-care facility. Existing, ambient noise levels from State Route 54 are a predominant background noise source in the project area. All of the outdoor play areas will be located along the northern and eastern portions of the site. The applicant had ~.~ tP - 8- proposed a play area along the western side of the property, however, staff requested the applicant to relocate this play area on site to avoid impacts to residents to the west. To reduce noise impacts, outdoor play activities will be limited to two groups of no more than ten children at anyone time in the same play area. By staggering outdoor play activities, the number of children playing outside at the same time will be limited to a total of 20 children at one time. Mitigation of noise impacts will also be provided by adherence to the State-mandated teacher to student ratio of 1 teacher per 10 children. Compliance with the State of California and County of San Diego licensing requirements will ensure that children are adequately monitored so that playtime will be structured to reduce disturbance to surrounding residents. Outdoor play activities will be limited to a one-hour period (approximately 1:00 p.m. to 2:00 p.m.) on Monday through Friday. The facility will be closed on weekends. Intermittent vehicular noise impacts will occur with project implementation during periods of peak traffic activity. Vehicular noise impacts will be limited to the morning drop off and the late afternoon and evening pick up hours. Temporary vehicular noise impacts will occur between the hours of 6:00 a.m. and 8:00 a.m. and 4:00 p.m. and 7:00 p.m. Monday through Friday. No vehicular traffic impacts will occur on weekends. With compliance to these mitigation measures, potential noise impacts will be reduced to below a level of significance. Site Safetv and Securitv: Potential site safety and security impacts are associated with the special needs for a day-care facility to provide for on- going monitoring of the children to ensure their safety. Due to the large size of the facility and the numerous rooms which will be utilized throughout the day, mitigation measures are required to ensure the safety of the children at all times. In order to ensure the overall safety and security of the facility, a live-in security guard and his family will be housed on site twenty-four hours a day to monitor and maintain the grounds. To ensure the safety and security of the children attending the facility, the State-mandated student to teacher ratio of 1 teacher per 10 children will be required. Facility staff will be required to be licensed and approved by the State of Ca~ifornia and the County of San Diego to provide quality day-care services for the children. To encourage further site security and safety, surveillance cameras will be posted throughout the facility to monitor the entire facility, at all times. To prevent harm to any children on site, a fence will be constructed around the perimeter of the project to separate it from the adjacent MAAC facility and to prevent children from straying off site. Fencing will also serve to prevent children from falling down the slopes situated along the northern and eastern property boundaries. With compliance to the mitigation measures listed in Section F of this document, potential site safety and security impacts will be reduced to below a level of significance. Parks and Recreation Impacts The proposed project will provide the availability of day-care services to disadvantaged populations. As a result, children .::>~ ~ CO -10- from low-income families in the Chula Vista area will be provided with educational, as well as recreational opportunities which would otherwise not be available to them. The proposed project will provide a positive parks and recreational benefit to Chula Vista residents. Recreational opportunities will be provided for children from areas typically under-served by park and recreational facilities. On-site recreational opportunities will be provided by the use of a playhouse, basketball facilities, small playground area, 2 enclosed play areas, ping-pong facilities, and an indoor arts and crafts room. Parks and recreational opportunities provided by the facility are expected to have a positive impact upon the community. Visual and Cultural Impacts Visual impacts are associated with the configuration of the site on top of a gently-sloping knoll which makes the site visible from the adjacent residential community. In recent years, residents in the area have filed code enforcement complaints with the City regarding trash piling up and inadequate maintenance of the grounds on site. Visual impacts may also occur at the project entrance in conjunction with the minor grading required to configure the driveway to inprove traffic safety for site ingress and egress. To p::covide additional visual site screening, the applicant will be required to submit a detailed landscape plan to the City Landscape Architect for approval. In addition, failure to adequately maintain the grounds on site will result in the revocation of the use permit. A retaining wall shall be required to reduce potential soil erosion and visual impacts from grading at the project entrance. Cultural impacts are associated with the historic buildings on site. These structures are considered to be of historic value by the Chula Vista Historical Society, although they are not designated historic structures according to the .City of Chula Vista Historical Sites. list. In order to reduce potential cultural impacts, no alterations will be allowed to the exterior architecture or color of the buildings without obtaining approval by the Director of Planning. The designated drop off and pick up area for the children will be at the facility's main entrance on site. 5. Parking areas on site will be re-striped and reconfigured in accordance with City standards. A total of 55 parking spaces on site will be reserved for the Chula Vista Connection day-care facility, and a total of 10 spaces will be reserved for the MAAC project. Noise MitiGation: 1. Outdoor play activities will be limited to a one-hour period in the afternoon, Monday through Friday between 1:00 p.m. and 2:00 p.m. 2. Outdoor play groups shall be limited to two groups of ten at any given time, for a maximum of twenty children outside during each structured playtime. 3. The hours of operation for the proposed day-care facility shall be limited to 6:00 a.m. to 7:00 p.m. Monday through Friday. No day-care services will be allowed on weekends. 4. The proposed project will be required to comply with the Chula Vista Noise Ordinance Requirements specifying an exterior noise level for all residential receiving land uses of 45 dbA between 10 p.m. to 7 a.m. weekdays and 10 p.m. to 8 a.m. weekends and 55 dbA 7 a.m. to 10 p.m. weekdays and 8 a.m. to 10 p.m. weekends. Site Safetv and Securitv Mitiqation: 1. A live-in security guard will be housed on site on a twenty- four hour a day basis to monitor the grounds. Surveillance cameras will be posted throughout the facility to monitor the entire facility, at all times. 2. Licensing from the appropriate State of California and County of San Diego licensing agency(ies) shall be obtained for the facility. :;~'I -13 - 3. A 6-foot high perimeter fence shall be constructed around the facility to separate it from the adjacent MAAC project and to prevent children from straying off site onto N. Second Avenue or the adjacent slopes along the north and east property boundaries. 4. All conditions of the Chula Vista Fire Department and the Chula Vista Building Department shall be complied with. Visual and Cultural Mitiqation 1. To provide additional visual screening, the applicant will be required to submit a detailed landscape plan to the City Landscape Architect for approval. 2. Failure to adequately maintain the grounds on site will result in the revocation of the use permit. 3. No alterations will be allowed to the exterior architecture or color of the buildings on site without obtaining approval by the Director of Planning. Any proposed structural modifications will require approval by the Building and Housing Department. 4. A retaining wall will be required for the graded area at the project entrance to reduce potential soil erosion and visual imFacts. 5. A grading permit is required if over 250 cubic yards of soil is required to be excavated to redesign the project entryway. Mandatorv Findinas of Sianificance: Based on the following findings, it is determined that the project described above will not have a significant environmental impact and no environmental impact report needs to be prepared. 1. The project has the potential to substantially degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of the major periods of California history or prehistory. .::>~ '5 .2. -14- With implementation of the mitigation measures set forth in Section F of this document, the proposed project will not degrade the quality of the environment or affect fish or wildlife species or cultural resources. 2. The proposed day-care facility will not create short-term environmental goals to the disadvantage of long-term environmental goals, since the proposed proj ect will provide parks and recreational opportunities for children from disadvantaged families and improve the overall maintenance of the site. 3. The project has possible effects which are individually limited but cumulatively considerable. As used in the subsection, "cumulatively considerable" means that the incremental effects of an individual project are considerable when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects. The proposed day-care facility will not create cumulative impacts, since the mitigation measures set forth in Section F of this document will reduce potential impacts to below a level of significance. 4. The environmental effects of a project will cause substantial, adverse effects on human beings, either directly or indirectly. No human health impacts were identified in the initial study, therefore, it is not expected that the project could have any adverse effects upon the human population. The project would be implemented on a parcel of land which has been previously graded and developed, therefore, no significant landform alteration will be necessary. Minor site grading will occur at the project's driveway entrance to allow for better site distance, however, a retaining wall will be required to prevent soil erosion. If over 250 cubic yards of soil are excavated, a grading permit will be required through the Chula Vista Engineering Department. 2. Air (NO) The proposed conditional use permit will not directly create an increase in air emissions. The project will generate approximately 1,250 ADT, which is within the acceptable LOS C standards, according to the City Traffic Engineer. Therefore, no significant adverse air quality impacts will be created. 3. Water (NO) The proposed day-care facility will not affect or be affected by water quality or water availability impacts. No significant impacts to water movements or resources would occur with implementation of the proposed facility. Therefore, no water quality impacts will occur, at this time. Compliance with the Sweetwater Authority's comments regarding adequate water availability to meet fire flow requirements shall be enforced by the Chula Vista Fire Department. 4,5 Plant and Animal Life (NO) The zoning text amendment to allow a day-care facility for a maximum of 250 children from disadvantaged families will not adversely impact biological resources. No proj ect - specif ic biological impacts will occur with implementation of the proposed project. Therefore, no direct biological impacts are expected. .:i /5 S -2- 6. Noise (YES) Potential noise impacts will occur with implementation of the proposed project. The provision of day-care facilities for approximately 250 children could create noise impacts to surrounding residential uses, especially during periods of outdoor playtime activities. Outdoor play will occur Monday through Friday from approximately 1:00 p.m. to 2:00 p.m. The playground facilities on site are located predominantly along the northeastern portion of the site. No play would occur at the western portion of the site nearest to the residences. Background ambient noise levels in the project vicinity are already significant from the State Route 54 freeway traffic noise. However, in order to ensure that noise impacts are below a level of significance, outdoor play time shall be limited to the hours of 1:00 p.m. to 2:00 p.m. Monday through Friday. Outdoor playtime shall be structured so that the number of children In each play group is limited to 10 children each, for a maximum of 20 children at play at any given time. 7. Liqht and Glare (NO) The proposed proj ect will be implemented in an existing building which has already been provided with lighting facilities. No new sources of light and glare will occur with project implementation. Therefore, light and glare impacts are not significant. 8. Land Use (YES) The proposed project would allow for the provision of day-care facilities as a conditional use in the R-3 zone. Potential land use impacts are associated with potential compatibility impacts with the adjacent MAAC project, a residential recovery home, as well as conflicts with the adjacent residential uses in the project vicinity. The site is presently partially vacant and under-utilized, therefore, the proposed project would represent an intensification of the current land use. However, the site has been used in the past as a Residential psychiatric Hospital, which housed approximately 56 children, with up to 100 administrative and miscellaneous staff. ~ ' 3" -3- If problems relating to the compatibility of the day-care facility with adjacent residential uses occur, enforcement proceedings will begin. If resolution of code enforcement violations does not occur, the conditional use permit could be revoked, at the discretion of the Director of Planning upon notification to the applicant. 9. Natural Resources (NO) The proposed project will not create a substantial increase in the rate of use of any natural resources. The project would be implemented in an existing building on an already developed parcel of land wi thin the City, therefore, proj ect implementation will not require any new natural resources. 10. Risk of Upset (NO) The proposed project will not involve the use of any hazardous materials nor be associated with any hazardous waste issues. The regulation of hazardous waste is handled by the County of San Diego Hazardous Materials Management Division (HMMD). The potential for risk of upset impacts at the project level would require compliance with HMMD's standards for the safe handling of hazardous substances. However, no hazardous wastes or materials are expected to be used for the day-care facility, therefore, risk of upset impacts are not deemed to be significant. 11. Population (NO) The proposed project will not create a substantial change to the demography of the City. The proposed project would allow a day-care facility in an existing, under-utilized building. Therefore, implementation of the project will serve the needs of the existing population of Chula Vista by providing day- care services to disadvantaged families that would not be able to afford such services. 12. Housinq (NO) Implementation of the proposed project will not create significant changes to the existing housing stock within the City. The project site already exists as an under-utilized building and the acreage on site provides an adequate size for children to play freely. Therefore, the proj ect will not create a significant increase in the need for additional housing nor affect existing housing stock within the City. ~":s? -4- 13. Transportation/Circulation (MAYBE) Potential traffic/circulation impacts are anticipated with implementation of the proposed proj ect. During periods of peak activity in the morning and evening hours when children are being dropped off and picked up from the facility, traffic impacts could occur. The project will generate 1,250 ADT. The potential for traffic/circulation impacts was analyzed by the City's Traffic Engineer. According to their analysis, project implementation would not create adverse traffic and circulation impacts to the surrounding circulation network, with approval of the facility for 250 children. Project implementation will not cause a reduction in the Level of Service on surrounding roadway segments. Therefore, the LOS will remain LOS C, and the project will comply with the City's adopted policies. 14. Public Services (NO) A) Fire Protection: Implementation of the proposed day-care facility will not create direct impacts to fire safety or fire flow requirements. Implementation of the day-care facility will require compliance with standard Chula Vista Fire Department requirements. The Chula Vista Fire Department commented on the initial study that the applicant will be required to submit plans showing the location of a fire alarm system and sprinkler system. Fire drills shall be conducted once a month, and no day- time sleeping or napping areas shall be allowed above the first floor unless the building is sprinklered. B) Police Protection: Implementation of the proposed project will not create direct impacts to police services. Implementation of the day-care facility will require compliance to Chula Vista Police Department requirements. Therefore, no adverse public services impacts pertaining to police protection will occur with the proposed project. C) School Facilities: Implementation of the proposed project will not create direct impacts to school facilities. The project will provide on-site educational opportunities for children from disadvantaged families, therefore, no adverse public services impacts pertaining to school facilities will occur. ~~-ft!) -5- D) Parks/Recreation: Implementation of the proposed project will not create direct impacts to parks and recreational facilities. Implementation of the project will create new recreational opportunities for children from disadvantaged families. Therefore, no adverse public services impacts pertaining to parks/recreational facilities will occur with implementation of the proposed project. E) Maintenance: Implementation of the proposed project will not create a need for additional public facilities maintenance requirements. Therefore, at this time, no public facilities maintenance impacts will occur. F) Water: Implementation of the proposed project will not create a need for additional water resources. Water availability has already been provided to the project site. No significant increase in water consumption will be created by project implementation. The Sweetwater Authority commented on the proposed project (February 23, 1993) and indicated that a letter of service availability will be required to ensure that adequate fire flow is available to the facility. Therefore, with compliance to the conditions of project approval and the mitigation measures set forth in the Mitigated Negative Declaration, the proposed project will not create adverse water impacts. 15. Enerqv (NO) The proposed project will not require the use of substantial amounts of fuel or energy resources. Implementation of the project will not create a need for substantial amounts of energy, therefore, the proposed project is not associated with any substantial energy impacts. 16. Compliance with Threshold Standards (YES) Fire/EMS The Threshold Standards require that fire and medical units must be able to respond to calls within 7 minutes or less in 85% of the cases and within 5 minutes or less in 75% of the cases. This Threshold Standard does not apply to the proposed zoning text amendment, since no specific project implementation will occur, at this time. M>...~I -6- The project site is 1.5 miles away from the nearest fire station and is associated with a 3 minute response time, therefore, the proposed project will meet the Threshold Standards. Police The Threshold Standards require that police units must respond to 84% of the Priority 1 calls within 7 minutes or less and maintain an average response time to all Priority 1 calls of 4.5 minutes or less. Police units must respond to 62.1 % of Priority 2 calls within 7 minutes or less and maintain an average response time to all Priority 2 calls of 7 minutes or less. The proposed project will meet the Threshold Standard. Traffic The Threshold Standards require that all intersections must operate at a Level of Service (LOS) "C" or better, with the exception that Level of Service (LOS) "D" may occur during the peak two hours of the day at signalized intersections. Intersections west of 1-805 are not to operate at a LOS below their 1987 LOS. No intersection may reach LOS "E" or "F" during the average weekday peak hour. Intersections of arterials with freeway ramps are exempted from this policy. The proposed project will meet the Threshold Standard, since the LOS will remain at LOS C. Parks/Recreation The Threshold Standards for Parks and Recreation is 3 acres/l,OOO population. The proposed project is exempt from this Threshold Standard. Drainage The Threshold Standards require that storm water flows and volumes not exceed City Engineering Standards. Individual projects will provided necessary improvements consistent with the Drainage Master Plan (s) and City Engineering Standards. The proposed project will meet the Threshold Standard. ;-~Ol, -7- Sewer The Threshold Standards require that sewage flows and volumes not exceed City Engineering Standards. Individual projects will provide necessary improvements consistent with Sewer Master Plan (s) and City Engineering Standards. The proposed project will meet the Threshold Standard. Water The Threshold Standards require that adequate storage, treatment, and transmission facilities are constructed concurrently with planned growth and construction. The proposed project will meet the Threshold Standard, with compliance to the requirements of the Sweetwater Authority regarding adequate fire flow to serve the project. 17. Human Health (NO) The proposed day-care facility will not create any human health hazards. No potential risk of upset impacts will occur on site, since no hazardous materials will be allowed to be stored on site. Therefore, implementation of the proposed project will not create any significant impacts to human health. 18. Aesthetics (NO) Implementation of the proposed day-care facility will not result in the obstruction of any scenic vista or view open to the public nor will it result in the creation of an aesthetically offensive site open to the public. The project site has been previously graded and developed, and only minor grading will occur at the project entryway. The site is presently under-utilized, and implementation of the project could result in an increased level of maintenance than has existed since the building was vacated in February of 1991. 19. Recreation (MAYBE) The proposed project will not create the need for additional parks or recreational facilities. Implementation of the day- care facility will not result in any impacts to the quality or quantity of existing recreational opportunities within the City. ~, #.3 -8- The potential exists for the project to actually improve the recreational opportunities that presently exist for children from disadvantaged families. 20. Cultural Resources (NO) The proposed project will not result in the destruction or alteration of any historic or archeological and paleontological resources. The project would be implemented on an already graded and developed site within the City, with only minor grading occurring at the project entryway. No significant cultural resource impacts will occur. The historic structures on site are not listed as historic structures by the City of Chula Vista Historical Sites List. 21. Mandatorv Findinqs of Siqnificance (NO) The proposed day-care facility does not have the potential to degrade natural or cultural resources. The project will not have short - term to the disadvantage of long- term environmental impacts. The project is not associated with any cumulative impacts, with compliance to the conditions of project approval and the mitigation measures stated herein. The project will not have environmental impacts which will cause adverse effects to human beings directly or indirectly. Therefore, this environmental determination concludes that a Mitigated Negative Declaration shall be prepared for the proposed project. ~.. ~~ ATTACHMENT A MITIGATION MONITORING AND REPORTING PROGRAM IS 93-27 In compliance with AB 3180, this Mitigation Monitoring and Reporting Program (MMRP) has been prepared to address the monitoring of implementation of those mitigation measures set forth in the Mitigated Negative Declaration pertaining to IS 93-27, the Stillwagon Day-Care Facility, located at 73 N. Second Avenue, Chula Vista. AB 3180 requires monitoring of potentially significant environmental impacts. There is a 6-inch A.C. water main located on the east side of North 2nd Avenue, adjacent to the proposed development. In addition, on the eastern portion of the parcel, there is a 4-inch steel main in easement #3-SW-39 which becomes a 6-inch cast iron main in easement #3-SW-45. These easements state that no buildings and/or structures will be erected, walls constructed, fences built, trees planted, grades changed or encroachments by other utilities, public or private shall be placed upon the easement. Also, the Authority's records indicate that there are three existing water services which appear to serve the property. Enclosed is a copy of 1/4 SEC. 135 map which show these facilities and easements. At this time, we cannot comment on the adequacy of the existing system to provide fire protection for this project. As plans develop for strur.:tures, the Owner must submit a letter to the Authority from the appropriate fire agency stating fire flow requirements. Based on this requirement, this project may result in the need for new water systems or substantial alteration to the existing water system. The Authority recommends that your Agency work with ours to determine if the existing water facilities are adequate to meet the added demands prior to issuing a building permit. In particular, if this childcare center is to accomodate 60 DAY children, might that involve some 40 or 50 cars dropping children off at about the same time? And the obvious problem would involve the entrances and the exits from those driveways. Exiting from the north driveway especially would be dangerous with the curvature of Second Avenue at that spot. Will the childcare center traffic all have to use the north driveway? Or can they also use the south driveway where the MAAC project is located? It appears that one can drive around the property -- entering the north driveway and exiting the south driveway (or vice versa). Will that be possible? In any case, I hope that a part of the Initial Study will include the traffic problems that would be inherent with dozens of cars dropping children off all at the same time at that particular site and with the curvature of Second A venue as it is at that point. ;It:-}lY;~/: .:(, ~I RESOLUTION NO. PCC-93-25 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA GRANTING A CONDITIONAL USE PERMIT TO ESTABLISH A DAY NURSERY AT 73 NORTH SECOND AVENUE IN THE R-3 ZONE FOR A MAXIMUM OF 250 CHILDREN AND LIVE- IN SECURITY WHEREAS, a duly verified application for a conditional use pennit was filed with the City of Chula Vista Planning Department on January 29, 1993 by Ms. Elizabeth Annette Stillwagon of Chula Vista Connection Neighbors Helping Neighbors; and WHEREAS, said application requests authorization to establish a day nursery at 73 North Second Avenue (APN 569-3]0-26 - the old Southwood Psychiatric site) in the R-3 Zone for a maximum of 250 children, and to place a live-in security guard on-site; and WHEREAS, the Planning Director set the time and place for a hearing on said conditional use permit application and notice of said hearing. together with its purpose. was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within and beyond I :000 feet of the exterior boundaries of the property at least 2] days prior to the hearing; and WHEREAS, the hearing was held at the time and place as advertised, namely June 23. 1993 at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed; and WHEREAS. the Commission found that the project would have no significant environmental impacts and adopted the Mitigated Negative Declaration issued on IS-93-27. NOW, THEREFORE the Planning Commission of the City ofChula Vista does hereby make the following findings as related to PCC-93-25: I. That the project will have no significant environmental impacts and adopt the Mitigated Negative Declaration issued on IS-93-27. The Planning Commission hereby finds that the Project will have no significant environmental impacts in that the Project does not have: A. The conditional approval of PCC-93-25 will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the project vicinity or injurious to property or improvements in the project vicinity in that the facility has historically been used as a children's institution, and there will be 24 hour security and a fence surrounding the facility. 4. Tbat tbe proposed use will comply witb tbe regulations and conditions specified in tbe code for sucb use. The conditional approval of PCC-93-25 complies with the regulations and conditions of the Municipal Code in that the project is conditioned to comply with the requirements of all applicable City departments and will not generate excessive traffic nor require extra on-site parking. ,;J, ~-" Resolution PCC-93-25 Page #3 5. That the granting of this conditional use permit will not adversely affect the general plan of the City or the adopted plan of any government agency. The conditional approval of PCC-93-25 will not adversely affect the General Plan of the City or the adopted plan of any government agency in that the project confonns to the proposed Public/Quasi Public land use designation of the General Plan Amendment for the Lower Sweetwater Special Study Area. BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSION hereby grants conditional use pennit PCC-93-25 subject to the following conditions whereby the applicant shall: I. Remove the pole barricade in the drive next to the ground level enclosed patio off of the south wing so as to ensure access by emergency response personnel and other vehicular traffic. 2. The northemldo\\TI-hill driveway and parking areas shall be redesigned and/or reconfigured as shown on the site plan to the satisfaction of the City Engineer. 3. Stripe all parking spaces in accordance with City standards. Teachers and staff who drive shall park in the southeastern parking lot. 4. Obtain and maintain licensing for a day nursery for a maximum of 250 children from the appropriate State of California and/or County of San Diego licensing agency(ies). Loss of State California or County licensing shall be grounds for revocation of the conditional use pennit. 5. Comply with all requirements of the Chula Vista Fire Department and the Chula Vista Building Department. 6. Submit a landscape plan prepared by a landscape architect for review and approval by the City Landscape Architect. 7. This pennit shall be subject to any and all new, modified, or deleted conditions imposed after adoption of this resolution to advance a legitimate governmental interest related to health, safety or welfare which City shall impose after advance written notice to the pennittee and after the City has given to the pennittee the right to be heard with regard thereto. However, the City, in exercising this reserved right/condition, may not impose a substantial expense or deprive Pennittee of a substantial revenue source which the Pennittee can not, in the nonnal operation of the use pennitted, be expected to economically recover. .:?" This conditional use permit shall become void and ineffective if not utilized within one year from the effective date thereof, in accordance with Section 19.14.260 of the Municipal Code. This permit, and parking in particular, shall be monitored by staff and reviewed by the Zoning Administrator on the anniversary date of the opening of operations to ensure parking, circulation and access are adequate. In the event a problem exists and cannot be rectified by staff, the permit will be scheduled for review and reconsideration by the Planning Commission.
