HomeMy WebLinkAboutRCC MIN 1991/11/18MINUTES OF A SPECIAL MEETING Resource Conservation Commission Chula Vista, California 6:00 p.m. Monday, November 4, 1991 Conference Room 1 Public Services Building CALL MEETING TO ORDER/ROLL CALL: Meeting was called to order at 6:04 p.m, by Chairperson Hall. Present: City Staff -Mary Ann Miller; Commissioners Fox, Ray, McQuade, Kracha. Absent: Ghougassian and Johnson. APPROVAL OF MINUTES: It was MSUP (Hall/McQuade- to approve the minutes of October 21, 1991. It was MSUP (McQuade/Hall) to approve the minutes of October 28, 1991 with one correction under Old Business, Line 4: "The motion was made at the October 21st meeting by McQuade, seconded by Hall, to nominate Tim Nader. This item was tabled and carried over to the next meeting." NEW BUSINESS: 1. Review of the final EIR on Scripps. Mary Ann Miller made the correction that this EIR is a final and not a draft. John Kracha has a conflict of interest on the Scripps project and was excused from discussion. Public Comments: - Wavne Wencke, Circinus Corporation, introduced the next four speakers to address the issues as they relate to the Environment, Traffic, Economics and Legal. - Philip Hinshaw, Adhinshaw Associates, was the Environmental Consultant who spoke on the displacement and relocation of businesses by the hospital project and on sewer capacity. - Arnold Torma, Entranco-Federhart, addressed the issues relating to traffic, specifically that which would be generated from the nearby mall. - Michael Jacobs, Vice-president with Circinus, addressed the economic issues. Although it is not a requirement of the CEQA process, he felt it should have warranted a response nonetheless. - Joe Solomon, Attorney, addressed the engineering aspects of the EIR. The foundation of the project is lacking due to the way it evolved and suggested it was done in an unlawful manner. He pointed out inconsistencies regarding the tax payments whether they should or may be required, the land use, and notice to businesses. - Jerrv Willits operator of the Fiesta Twin Theater, is in support of the EIR and requests the city go forward with the project. - August Carniglia, Roller Skateland, has been in escrow with his property and is unsure where he currently stands, but wants to see the Scripps project go on. Page 2 - ,lames Learv, Architect for Scripps, noted that it has 470 square feet per bed, with the national average of 1200-1600 square feet per bed. Scripps currently generates a lot of traffic within a few square feet. He responded to questions that were posed earlier. He agreed with the traffic problem, however did not understand comments about economics. The market area includes downtown Chula Vista and would attract all other areas demographically. - June Collins. Dudek & Associates, managed and prepared the EIR. She answered specific questions on traffic and other questions pertaining to the EIR. - Matt Peterson, attorney involved with CEQA processing, recommended certification of the EIR. - Mr. Wencke further requested RCC analyze both sides of the issue, given all the comments. He stated their company would not take three years to build the project, as previously stated, and could realize income immediately. - Raloh Kostant, Attorney, responded to the earlier discussion on Notice. - Charlie Harmon, operator of Arby's, noted he did not find out about the project until May 1990, when it originally came out in 1988. He never received Notice until October of 1990. City Attorney, Bruce Boooaard, responded to questions pertaining to the process of EIR's. The Public Comments were closed. Commissioners considered the above comments made by the public. After much discussion, it was then moved and seconded (Fox/Ray) to recommend certification of the final Scripps EIR and that the document complies with CEQA requirements; motion carried 4-0 (Kracha was abstained). 2. Item 2 of the agenda regarding Indwellers was deferred to a future meeting. 3. Review of Negative Declaration IS-92-05: It was moved and seconded (Ray/Fox) to issue the Negative Declaration with the criteria that there be a limited CUP and the applicant be reviewed every two years for its land use. An amendment to the motion was made (Ray/Fox) that the applicant pay for a review of the CUP every two years; motion failed 3-2 (no: McQuade, Kracha). A motion was made by McQuade to deny the project based on it not utilizing the whole house; motion died due to lack of a second. It was moved and seconded (Kracha/Fox) to issue the Negative Declaration; motion failed 3-2 (no: Ray/McQuade). It was moved and seconded (Fox/Hall) that the Negative Declaration be issued, noting specific comments of the commission; motion failed 3-2 (no: McQuade/Ray). It was moved and seconded (Ray/Fox) to issue the Negative Declaration with the condition that the applicant pay for CUP to be reviewed annually; motion carries 4-1 (no: McQuade. Page 3 4. Review of Negative Declaration IS-92-08: It was MSUP (Fox/Ray) to issue the Negative Declaration. 5. The item of Environmentalist of the Year with Tim Nader as nominee, was tabled from the meeting of October 28th. McQuade presented a list of qualifications of Mr. Nader. Further nominations were made as follows: Moved and seconded (Kracha/Ray) to nominate "Chula Vista 2000" Community Task Force. Moved and seconded (Ray/Fox) to nominate Robin Putnam, Community Development Specialist. After discussion of the above-named nominees, it was moved and seconded (Ray/Fox) to vote for all three nominees as Environmentalists of the Year; motion carried 5-0. 6. Items for the Planning Commission Agenda for the meeting of November 6, 1991 were reviewed with no action taken by Commission.
