HomeMy WebLinkAboutRCC AGENDA PK 1989/11/06September 19, 1989 File # - Council Referral # 1695 TO: The Honorable Mayor and City Council VIA: John Goss, City Manaqer FROM: John Lippitt, Director of Public Work SUBJECT: Off-Road Vehicles and Illegal Activities in Open Space Areas Mr. Ray Rafael who lives near the intersection of East "J" Street and Paseo Ranchero has complained about illegal and dangerous activities in the open space areas at the foot of "J" Street. Staff has reviewed the situation and concurs that there has been considerable dumping on the property in that area. In the property closest to "J" Street which is owned by the Chula Vista School District, there has been illegal dumping of items such as old mattresses, washing machine parts and dirt, broken concrete and other miscellaneous construction materials. In addition, the developer of the condominiums in which Mr. Rafael is living has used the area as a dump site and has a considerable amount of trash still remaining on that site. The City has started to work with the developer of the condominiums and has furnis}ied the developer with the materials to put up the guard rail ,end posts on the south side of "J" Street to prevent access to the School District property. In addition, the contractor has removed most but not a11, of the material that he had previously dumped on the site. In a meeting with the City Engineer, John District, indicated that ho ~,dould send out truck for a day or tt:'o in order to clean remair,iny site as possible. Hoc:~ever, he School District does not have sufficient constant policing. Linn of the School t~:-o worF:ers with a up as much of the indicated that the funds to maintain Honorable Mayor -2- September 19, 1989 Regarding the dumping aspect, the guard rail and construction at the site has effectively prevented vehicles from getting off the road and that slow down the dumping. The Parks Director has indicated that there is also a problem with kids shooting on the site. Kids from the neighborhood will go into the site and wander down into the canyon, some of which may be owned by the School District, but other which may be owned by other property owners including McMillin, and will shoot at small animals or targets. Short of assigning more police personnel just to patrol the site it does not appear that there will be an effective way of policing that problem. McMillin has also been working to prevent access to the open space from other locations where vehicles could get off of roads. Once access to the road is removed dumping should slow down although we have found that people become very innovative in getting access to open space areas in order to dump trash. A short informative paragraph concerning the problems that everybody shares from the illegal dumping could appear in a quarterly newsletter in an attempt to educate the residents of Chula Vista about the problem. POLICE REFERRAL DETAIL John: At its 9/5/89 meeting, the City Council, in response to an oral communication from Mr. Raphael regarding illegal and dangerous activities in the open space areas at the foot of J Street, referred to staff for a report back within 2 weeks regarding options and enforcement. It is noted that the City Engineer has set up a meeting with the School District in order to establish their cooperation in resolving the problem. It is also noted -that there is sufficient question about whether the problem is on open space or private property owned by McMillin Development and the School District. In addition to access options such as barricades or guardrails, the enforcement question needs to be addressed. Part of the motion also included a request by Councilman Nader that the staff report be reviewed by the Resource Conservation Commission.
