Proiect Settine DATE: September 28, 1993 The project setting consists of a 400' lineal section of the Telegraph Canyon Creek within the floodplain that runs east of the AT&T building located at 865 Third Avenue. Adjacent uses include residential to the east across the creek, commercial to the west across Third Avenue, commercial to the south and north. B. Proiect Description The project consists of the repair and reconstruction of approximately 400 lineal feet of the existing drainage channel east of the AT&T building located at 865 Third Avenue including rip-rap at the southerly and northerly portion of the channel and concrete in addition to the reconstruction of a parking lot and a block wall due to stormwater erosion damage. The project is within the 100-year floodplain. As the maintenance and repair of channels usually falls under the responsibility of the City, the reason that AT&T is wanting to complete this work is in order to proceed prior to the fall and winter rains, insure that the repairs and reconstruction are completed before the existing erosion can get worse. The public works department is in the process of having the environmental analysis completed on the reconstruction and temporary repair of other areas of the creek done simultaneously. The discretionary actions for this project include the issuance of a City grading permit and the granting of permits by the Army Corp of Engineers(404 permit) for a project within the floodplain, a streambed alteration permit from the California Department of Fish and Game, and certification from the Regional Water Quality Board. C. Compatibiliri with Zoning and Plans The current plan designation on the site is retail-commercial. The zoning is CC-Retail and Service Commercial. This project is consistent with Section 5.3 of the Public Facilities Element of the Chula Vista General Plan which states, "Collecting and conveying stormwater from present and future developed area is essential to protecting lives and property." This proposed project is consistent with that policy. Identification of Environmenta] Effects An initial study conducted by the City of Chula Vista deternned that the proposed project will not have a significant environmental effect, and the preparation of an Environmental Impact Report will not be required. A Negative Declaration has been prepared in accordance with Section 15070 of the State CEQA Guidelines. Although there are no potentially significant environmental impacts as part of this project the applicant is required to obtain the necessary permits prior to the installation of the improvements. E. Mitieation necessary to avoid significant effects The proposed project is not associated with any significant or potentially significant environmental impacts, therefore, no project specific mitigation will be required. However, the applicant will be required to obtain the necessary permits from the Army Corp of Engineers and the California Department of Fish and Game prior to the installation of repairs. F. Findings of Insignificant Imnact Based on the following findings, it is determined that the project described above will not have a significant environmental impact and no environmental impact report needs to be prepared. 1. The project has the potential to substantially degrade the quality of the environment, substantially reduce the habitat of a f-sh or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of the major periods of California history or prehistory. The proposed project, the construction of repairs to a section of Telegraph Canyon Creek and to an adjacent parking lot does not have to potential to reduce the habitat or a fish or wildlife species. The site was reviewed by a biologist and it was their conclusion that the project is expected to result in anon-significant loss of approximately .O8 acre of very low quality wetland values. The biological survey provided data to conclude that the channel is predominantly unvegetated and where vegetation does occur along the bottom of the channel, the vegetation is typically various weed species. The biological report further found that the impact of the proposed project is not significant to fish or wildlife species. There are no known historical or prehistorical resources on the site. 2. The project has the potential to achieve short-term environmental goals to the disadvantage of long-term environmental goals. The project consists of the repair and construction of approximately 4001ineal feet of the existing drainage channel east of the AT&T building located at 865 Third Avenue. The -3- project involves the installation of rip-rap and concrete in the channel in addition to the reconstruction of a parking lot and a block wall due to stormwater erosion damage. The project will repair the Telegraph Creek, decreasing erosion and stormwater damage along the designated channel. The project is in compliance with the General Plan objective to maintain the 100-year flood plain. Short-term and long-term environmental goals. The short-term goal is to repair an extremely damaged area of the creek before the fall rains come, the damage worsens and other property is impacted. The long-term environmental goals are to provide a channel which will carry the water within its boundaries and permit the growth of the natural environment around it. 3. The project has possible effects which are individually limited but cumulatively considerable. As used in the subsection, "cumulatively rnnsiderable" means that the incremental effects of an individual project are rnnsiderable when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects. No, the project does not have the possibility of having any impacts which are individually limited, but cumulatively considerable because the project will on by an incremental and cumulative level provide a positive environmental impact on the area. 4. The environmental effects of a project will cause substantial adverse effects on human beings, either directly or indirectly. The project, the repair of a channel, parking lot and block wall will not cause substantial adverse effects on human beings, either directly or indirectly. G. Consultation 1.
