RESOLU'rION NO. 10952
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND GARY WILLIAMS TO PROVIDE OPEN SPACE
CONTRACT COORDINATION
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
.the City of Chula Vista that that certain agreement between THE
CITY OF CHULA VISTA, a municipal corporation, and Gary Williams
to provide open space contract coordination

dated the~ 20th day of July , 19 82, a copy of which
is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.

AGREEMENT
THIS AGREEMENT is made by and between the City of Chula Vista
(hereinafter called the "CITY") and Gary Williams (hereinafter called
"CONTRACTOR").
R E C I TAL S
WHEREAS, the City desires to retain an independent contractor to
coordinate the activities of the City's four open space district contractors
financed through ten special assessments districts and administered by the
City and,
WHEREAS, the Contractor is ready, willing and able to provide such
expertise to protect the City's interest in the successful administration and
operation of the Open Space Districts' concept, purpose and goals.
NOW, THEREFORE, BE IT RESOLVED that the parties agree as follows:
1. The above recitals are incorporated herein as if set out in full.
2. The Ci ty agrees to retain the Contractor to oversee the Open
Space Districts program as described herein.
3. The Contractor agrees to:
A. oversee, inspect and administer grounds maintenance
contracts;
B. receive, investigate and resolve or evaluate service
complaints and requests;
C. keep records, prepare purchase requisitions and reports;
D. enforce contract specifications;
E. research the usefulness and cost effectiveness of new and
alternative contract methods and specifications;
F. make recommendations to minimize maintenance costs through
landscape design changes;
G. assist in budget preparations and planning;
H. advise contractors on horticultural subjects such as pest
disease, irrigation, turf and plant material management;
I. rate the performance of contractors;

J. read plans and specs; keep existing plans and specs updated;
K. attend evening and/or weekend homeowners association
meetings;
L. assist with minor repairs and make emergency repairs and
may be requ i red to supervi se and plan the activities of
assigned employees; and,
M. maintain effective working rel at i onshi ps with the public,
other City departments and employees and contractors.
4. The Contractor shall be paid the sum of $890 per month due and
payable at the end of each month for 1982 and terminating June 30, 1983 unless
an extens i on is agreed upon by the Contractor and the City Counc i 1. Travel
expenses shall be reimbursed at the rate of $75.00 per month, for the first
three months. At the end of three months this amount may be increased to
$90.00, depending on the Contractor's average monthly mileage experience.
7. This Agreement is subject to unilateral termination by either
the Contractor or the Parks and Recreation Director by 30 day written notice.
IN WITNESS WHEREOF this Agreement is executed this 20th day
of July 1982.
