RESOLUTION NO. 10888
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, CALIFORNIA RECITING THE FACT OF THE SPECIAL
MUNICIPAL ELECTION HELD ON THE 8th DAY OF JUNE, 1982,
DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS
ARE PROVIDED BY LAW
The City Council of the City of Chula vista does hereby
resolve as follows:
WHEREAS, a regular general municipal election was held
and conducted in the City of Chula vista, County of San Diego,
State of California, on Tuesday, April 13, 1982, as required by
the Charter of the City of Chula vista, and
WHEREAS, at said election for Seat No. 4 of said City,
no candidate received a majority of the votes cast therefor and in
accordance with Section 300 of the Charter of the City of Chula
vista, a special runoff election was conducted on Tuesday, the 8th
day of June, 1982, and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by the law; that voting
precincts were properly established; that election officers were
appointed and that in all respects said election was held and
conducted and the votes cast thereat, received and canvassed and
the returns made and declared in time, form and manner as required
by the provisions of the Elections Code of the State of California
for the holding of elections in cities, and
WHEREAS, as a result of said election, the City Clerk of
the City of Chula Vista canvassed the returns of said election and
has certified the results to this City Council, said returns are
received, attached and made a part hereof as Exhibit A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA
VISTA CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That there were 73 voting precincts esta-
blished for the purpose of holding said election consisting of the
regular elections precints in the City of Chula Vista.

SECTION 2. That said special municipal election was held
for the purpose of election of one member to the office of
Council (Seat No.4) for a full term of four years.
SECTION 3. That the whole number of votes cast in said
Ci ty including absent voter ballots was 20,197.
SECTION 4. That the names of persons voted for at said
election are as follows:

That the number of votes given at each precinct to each
of such persons above named is as shown in Exhibit "A", attached
hereto and made a part hereof by reference.
SECTION 5. The City Council does declare and determine
that:
David L. Malcolm was elected as Member of the City Council
(Seat No.4) of said City for a full term of four years.
SECTION 6. The City Clerk shall enter on the records of
the City Council of said City, a statement of the results of said
election, showing:
(l) The whole number of votes cast in the City;
(2) The names of the persons voted for;
( 3 ) For what office each person was voted for;
(4) The number of votes given at each precinct to each
person.
SECTION 7. That the City Clerk shall immediately make
and, upon compliance by the person elected with the provisions of
Section 11565 and Section 11568 of the Elections Code of the State
of California, shall deliver to the person so elected a Certifi-
cate of Election signed by her and duly authenticated; that she
shall also administer to such person so elected the Oath of Office
prescribed in the State Constitution of the State of California
and shall have him subscribe thereto and file the same in her
office. Whereupon, said person so elected shall be inducted into
the office to which he has been elected.

SECTION 8. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in
the book of original Resolutions of said City, and shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed adopted.

CITY CLERK'S CERTIFICATE OF CANVASS
I, Jennie M. Fulasz, City Clerk of the City of Chula Vista,
California, County of San Diego, State of California, duly
authorized by Resolution No. 10726 adopted by the City Council
of said City on the 22nd day of December 1981, do hereby certify
that I have canvassed the returns of the Special Municipal Election
in the city of Chula Vista, California, which was consolidated with
the State Primary Election held on June 8, 1982 and find that the
total number of ballots cast was 17,365. The total number of
votes cast for the candidates for the office of City Council,
Seat No.4 was as follows:

The total number of precincts in the City was 73.
That attached hereto and made a part hereof is a list of the
number of votes received in each precinct for the candidates voted
on and the total number of votes received in the election. Further,

voters elected the following person to the office of City Council,
Seat No.4:
