HomeMy WebLinkAboutRDA Reso 2005-1909 RDA RESOLUTION NO. 2005-1909 RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROVING AN AGREEMENT WITH FULLER FORD AND ATOMIC INVESTMENTS INC. FOR DEDICATION OF RIGHT-OF- WAYS, LOT LINE ADJUSTMENT, AND ASSIGNMENT OF OPTION TO PURCHASE THE SHINOHARA PROPERTY, WHICH IS LOCATED WITHIN THE CHULA VISTA MERGED REDEVELOPMENT PROJECT AREA WHEREAS, increased development activity within the Otay Valley community has prompted the need to widen portions of Main Street, generally between Fuller Ford at 520 Auto Park Drive and the Chula Vista Crossings Project at 4501 Main Street; and WHEREAS, to facilitate future development and address anticipated traffic and circulation needs for the community, an agreement has been negotiated between the Agency, Fuller Ford, and Atomic Investments Inc.; and WHEREAS, to facilitate the needed improvements to Main Street, Fuller and Atomic have agreed to dedicate to the City an approximately 10-ft wide right-of-way over the northern portion of their respective properties; and WHEREAS, in exchange for the Fuller dedication, the Agency has agreed to assign to Fuller its Option to Purchase the Shinohara property, which is located just south of the Fuller property; and WHEREAS, in exchange for the Atomic dedication, Fuller has agreed to transfer to Atomic a 22.5-ft. portion of the western side of their property; and WHEREAS, the agreement between the Agency, Fuller, and Atomic benefits the community and the Otay Valley Area; and WHEREAS, Agency transfer of its Option to Purchase the Shinohara property allows for the dedication of necessary right-of-ways to widen portions of Main Street, which will improve circulation and traffic conditions for future and ongoing development activity within the Otay Valley community; and WHEREAS, the agreement will also provide the opportunity for Fuller to pursue development of the underutilized Shinohara property into a higher and better use; and WHEREAS, the Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed project was adequately covered in a previously adopted Final Environmental Impact Report (FEIR)-04-03; and RDA Resolution No. 2005-1909 Page 2 NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of Chula Vista that the Redevelopment Agency does hereby approve in the form presented the agreement between the Redevelopment Agency of the City of Chula Vista, Fuller Ford, and Atomic Investments Inc. for Dedication of Right-Of- Ways, Lot Line Adjustment, and Assignment of Option to Purchase the Shinohara Property, a copy of which shall be kept on file in the Office of the City Clerk. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby authorized to execute said agreement for and on behalf of the Redevelopment Agency of the City of Chula Vista.
