RESOLUTION NO. 11284
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING SEWER REPAYMENT DISTRICT FOR PROPERTIES
ON THE NORTH SIDE OF 00 BLOCK OF EAST "H" STREET
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Mr. and Mrs. Steven Tatreau, the owners of the
property at 35 East "H" Street (Assessor's Parcel No. 574-391-22)
have recently constructed an eight-inch sewer main extended across
East "H" Street to serve their property, and
WHEREAS, the total cost to the owners for the design,
survey staking, and construction of the extension was $11,605.00,
and
WHEREAS, after deducting the amount of benefit received
by the developer, plus the 5% to be retained by the City for the
costs incurred in administrating the reimbursement district, the
maximum amount to be repaid to the owners is $8,222.25 plus
interest, and
WHEREAS, the City Engineer has prepared a repayment
diagram marked as Exhibit "A", attached hereto and incorporated
herein by reference as if set forth in full, whereby properties
benefitted from the construction of the sewer and who did not
participate in the construction of the sewer will reimburse the
City at the time they connect to the City sewer system, which
diagram has been prepared in accordance with the provisions of
Section 13.16.170 of the Chula Vista Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chu1a Vista does hereby approve the sewer repayment
district for properties on the north side of the 00 block of East
"H" Street and authorizes the payment of $8,222.25 from Assessor's
Parcel Nos. 574-391-18, 574-391-19, 574-391-20 and 574-391-21 and
reimbursement of said amount to Mr. and Mrs. Tatreau at the time
of connection by the owners.

Section 13.16.17~ of the Chula Vista Munici~a1 Code provides that the City Enf)ineer shall determine
a pro~r sewer charge against tfuse )r(nerties benefitting but not contributinl) to the construction
costs of the sewer facilities in;tal1ed. The City Council may, by resolutjon, ado~t the recommenda-
tions of the City En~ineer.
I herewith oresent to the City Council my recommendation re')ardinl) the amounts to be char'Jed at the
time of connection.

5. Incidental expenses incurred by City to obtain reimbursement for developer:
$8,655 x 5.00% = $432.75
6. r~ximum amount to be reimbursed to developer: $8,655.00 - $432.75 = $8,222.25 (plus 'nterest).
7. Interest Charges:
To the connection char'Jes as shown in Item 2 above, sim'lle interest of 7% per annum (1.75%
'ler quarter) is to be added at the time of payment of the connection charl)es and prior tJ
bein') served by the subject sewer. The interest is to be calculated on a ouarterly basis
and shall include the total number of full quarters from January 1, 1983, up to, but not
including, the nU3rter in which oayment of such char'Jes is made.
8. Life of Anreement: The oblination to re'lay the builder shall be ten (10) years and shall have
commenced January 1, 1983.
9. All monies collected 'lursuant to this a~reement shall be de'losited jnto ~ccount No. 220-4022.
