HomeMy WebLinkAboutReso 1983-11277 RESOLUTION NO. 11277 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING MODIFICATION TO RANCHERO SECTIONAL PLANNING AREA PLAN - EL RANCHO DEL REY The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council in 1980 adopted Resolution No. 10102 approving the Ranchero Sectional Planning Area (SPA) plan, and WHEREAS, it is now desired to amend said SPA plan in order to modify the development standards in said Ranchero Sectional Planning Area, and WHEREAS, said amendment as contained in Exhibit A and B, attached hereto and incorporated herein by reference as if set forth in full, has been considered by the City Council at the public hearing on June 21, 1983. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby modify the Ranchero Sectional Planning Area Plan for El Rancho del Rey as shown on Exhibits A and B in accordance with Planning Commission Resolution No. PCM-83-4. BE IT FURTHER RESOLVED that the City Council hereby finds that said modification is not significant and requires no environmental impact report. SI~GLC FA:1ILY RESIDENTIAL: ZERO LOT LINE UNITS/42' LOTS All lots proposed to be developed for zero lot line units (units with ~wellin~s, accessory garage structures, and walls constructed on side lot lines) shall be governed by the provisions of the R-1-5 Sinrle ra~ily Residence Zone (Chapter 19.24, Title 19 of the Chula Vista ~:unicipa1 Code) except as specified below: 1. The provisions of Section 19.24.070 relating to lot coverage, lot area, lot width, and yard requireMents shall be amended as follows: a. PCM-83-4 RESOLUTION OF CITY OF COMMISSION RECOMMENDING APPROVE A MODIFICATION PLANNING AREA PLAN CHULA VISTA PLANNI NG THAT THE CITY COUNCIL TO THE RANCHERO SECTIONAL WHEREAS, a duly verified _application for a modification to the Ranchero Sect i ona 1 Pl anni ng Area plan was fil ed with the Pl anni ng Department of the City of Chula Vista on March 14, 1983 by James A. Hutchison & Associates representing El Rancho Del Rey, and WHEREAS, said application requested a change in the structure type for 76 lots (Lot 111 through lot 186 of the El Rancho Del Rey Unit No.6 subdivision) from single family attached dwellings with a common lot line (couplets) to single family detached dwellings with one side of the structure located on the side property line (zero lot line construction), and WHEREAS, the Planning Commission set the time and place for a hearing on said modification application and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city, and its mailing to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hearing, and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., April 13, 1983 in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and THEREFORE, NOW BE IT RESOLVED THAT THE PLANNING COMMISSION recommends that the City Council adopt a resolution approving the modification request subject to the following changes to the modified Development Standards dated March 31, 1983 as follows: 1. A minimum separation of 101 shall be required between dwellings. 2. The required 101 side and 151 rear yard shall be level areas (5% grade or less). 3. The owner or developer shall record covenants, conditions, restrictions, and easements on the zero lot line units for drainage, roof or eave projections; access for purposes of maintenance, repair, or remodeling of lot line structures, compatibility of materials, textures, and color; and related matters. Such deed restrictions and easements, which shall be recorded concurrently with the recordation of the subdivision map or maps creating designated zero lot line lots, shall be subject to the approval of the Director of Planning. -K- -(I d ?? ( ( 4. The required wall plan shall include a design to accommodate an increase in the front wall (41 high to 6') subject to approval of the Director of Planning. That a copy of this resolution be transmitted to the owners of the property and the City Council. Also that the proposed modification plans be transmitted to the City Council.
