WALTER SHAW FOR PRIVATE WATER SERVICE THROUGH CITY OPEN SPACE AND AUTHORIZING THE MAYOR TO EXECUTE SAID GRANT OF EASEMENT The City Council of the City of Chula Vista does hereby resolve as follows: That the City of Chula Vista does hereby grant certain easement to Dr. Walter Shaw for private water service through City open space a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized to execute same for and on behalf of the City of Chula vista. The Grantor herein agrees that no buildings and/or structures will be erected, walls constructed, fences built nor trees planted upon the easement herein described. No changes in the existing grade will be made without prior written approval of the Grantee; or encroachment by other utilities public or private, unless Grantee authorizes in writing. The Grantee herein agrees that the water service line will be installed at least 30 inches below surface grade and that the trench backfill will be sufficiently compacted to prevent washing out.
