RESOLUTION NO. 11315
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AMENDING CIVIL SERVICE RULE 2.02B
REGARDING VACATIONS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, a recent California Supreme Court decision,
Suastez v. Plastic Dress-Up Company, has made the City's rules
regarding vacation payoff obsolete, and
WHEREAS, the Director of Personnel has proposed a
wording change that would bring our Civil Service Rules into
compliance with the Supreme Court ruling.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that Civil Service Rule 2.02B regarding
vacations be, and the same is hereby amended as shown in Exhibit
"A", attached hereto and incorporated herein by reference as if
set forth in full.

Vacation Schedules: Vacation schedules shall be arranged by the
appointing authorities with particular regard to the needs of the
department and, so far as possible, with the wishes of the
employee. Vacation time may commence any day of the week and shall
consist of consecutive working days, exclusive of intervening paid
holidays, with full pay for such time as the employee would have
been paid if at work for the City for the same period of time;
provided that the appointing authority may, in his discretion,
divide the employee's vacation time if the needs of the service so
require or permit.
