HomeMy WebLinkAboutReso 1983-11310 RESOLUTION NO. 11310 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING SIXTH AMENDMENT TO AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE SAN DIEGO UNIFIED PORT DISTRICT FOR GROUNDS AND COMFORT STATION MAINTENANCE AT THE "J" STREET MARINA IN SAN DIEGO UNIFIED PORT DISTRICT PROPERTY AND AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT The City Council of the City of Chula vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula vista that that certain Sixth Amendment to an Agreement between THE CITY OF CHULA VISTA, a municipal corpora- tion, and THE SAN DIEGO UNIFIED PORT DISTRICT, for grounds and comfort station maintenance at the "J" Street Marina in San Diego Unified Port District property, dated the 5th day of July 1983, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. I BE IT FURTHER RESOLVED that the Mayor of the City of Chula vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula vista. Box 1087 Chula Vista, California 92012 SIXTH AMENDMENT TO AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE SAN DIEGO UNIFIED PORT DISTRICT FOR GROUNDS AND COMFORT STATION MAINTENANCE AT THE "J" STREET MARINA IN SAN DIEGO UNIFIED PORT DISTRICT PROPERTY THIS AMENDED AGREEMENT, made and entered into this 5thday of July , 1983, by and between THE CITY OF CHULA VISTA, a municipal corporation, hereinafter called "CITY", and THE SAN DIEGO UNIFIED PORT DISTRICT, a political subdivision of the State of California, hereinafter called "DISTRICT"; WIT N E SSE T H : WHEREAS, the San Diego Unified Port District and the City of Chula vista executed an agreement for maintenance of Port District property at the "J" Street Marina on September 28, 1977, and WHEREAS, said agreement provided for the agreement to be extended on mutual agreement of both parties with allowance for adjustment of maintenance costs, and WHEREAS, both parties mutually agree to extend said agreemen t. NOW, THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED by and between the parties as follows: 1. MAINTENANCE TO BE PROVIDED See attached Exhibit "A". 2. EXCEPTIONS TO DUTIES It is understood and agreed that the cost for maintenance as set forth in Paragraph 1 of this agreement does not cover materials, or labor, or repairs of the structures, building or landscaping as a result of major vandalism or destruction from any cause whatsoever. Such repairs or replacements shall be con- sidered to be over and above ordinary maintenance and will be performed by City forces only after approval by the District and actual costs for material and labor involved in such repairs will be billed to the District. CONSIDERATION In consideration of the foregoing performance by the City, the District shall pay to the City the sum of $62,806 for the fiscal year 1983, payment to be made quarterly on July 1 and October 1, 1983 and January 1 and April 1, 1984. 4. TERM AND TERMINATION The term of this agreement shall be from July 1, 1983 to and including June 30, 1984, unless either party shall have given the other party written notice sixty (60) days prior to date of cancellation; provided, however, said term shall be extended from year to year, based on mutual agreement of both parties as to the annual costs of maintenance which may be adjusted annually, prior to July I of each fiscal year, to reflect changing cost factors thereof. At the point at which the Chula vista Employees' Association and the City have agreed upon a new Memorandum of Understanding, an amendment to the agreement reflecting salary and/or benefit changes will be sent to the Port Districtr and Chula vista City Council for approval. ** Parking lot & streets will be swept every other week November 1 - May 31 and weekly June 1 - October 31. R-ll?/D Exhibi t II A" - Page 2 Service Description: Restroom cleaning, painting and repair Litter control Weeding - including the rock and/or earth slopes Mowing Edging Pruning and trimming Irrigation repair Spraying - herbicides and insecticides Planter bed renovation and plant material replacement F~rtilizing and aerifying Equipment maintenance All of the above will be performed at a frequency which will provide a level of maintenance consistent with the highly used and visible areas existing in the City of Chula vista. Attached Exhibits "A-I" and "A-2" display the areas of maintenance covered by this agreement.
