RESOLUTION NO. 11292
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ENDORSING THE TELEGRAPH CANYON CREEK
FLOOD CONTROL PROGRAM UNDER CONSIDERATION BY THE
U. S. ARMY CORPS OF ENGINEERS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, Act of Congress, Public Law 228, 77th Congress, approved
August 18, 1941, authorized the Chief of Engineers to take surveys for flood
control in the drainage areas of all streams in San Diego County, California,
flowing into the Pacific Ocean; and
WHEREAS, a flood-control project for Telegraph Canyon Creek, San
Diego County, California, is being considered in documents under preparation
by the District Engineer, U. S. Army Engineer District, Los Angeles, at Los
Angeles, California, for flood control along said creek; and
WHEREAS, protection against flood damage would be provided to
property along the one mile reach of Telegraph Canyon Creek downstream from
Fourth Avenue to San Diego Bay, all in the City of Chula Vista and the County
of San Diego, California, by channel improvement under consideration for
construction by the United States; and
WHEREAS, Section 3 of Public Law 738, 74th Congress, provides that no
money appropriated shall be expended on the construction of any project until
States, Political Subdivisions thereof, or any other responsible Local
Agencies have given assurances satisfactory to the Secretary of the Army that
they will assume certain enumerated obligations; and
WHEREAS, Article 4, Chapter 7, Part 2, Division 2, Title 3 of
California Government Code commencing with Section 25680 and California
Government Code Sect ion 6500 et. seq. authori zes the County of San Di ego to
cooperate with the United States in the construction of flood control projects;
NOW THEREFORE, BE IT RESOLVED by the City Council of the Ci ty of
Chula Vista that it go on record reaffirming its support of the Telegraph
Canyon Creek flood control program under consideration by the U. S. Army
Engineers; and
BE IT FURTHER RESOLVED, that the Board of Supervisors of the County
of San Diego, California, are hereby requested to give the assurances required
by the U. S. Army Engineers to provide the local cooperation necessary for the
construction of the project; and
BE IT FURTHER RESOLVED, that it declares it a policy and intent of
this Council to enter into negotiations prior to actual construction to
determine a mutually equitable apportionment of costs to each local agency
including the County, to reimburse the County of San Diego as appropriate for
betterments in highways, roads, streets, bridges, recreational facilities,
utilities and irrigation and drainage facilities for which the State or
Federal agencies declare the costs beyond their responsibility.
BE IT FURTHER RESOLVED, that the City Clerk of the City of Chula
Vista be, and is hereby directed to forward a certified copy of this
Resolution to the Board of Supervisors, County of San Diego.
