However, pursuant to the Brown-Act, no action can be taken by the Joint Board of Supervisors/City Council unless listed on the agenda. III. CONTINUED PUBLIC HEARING - OTAY RANCH Continue public hearing and County Board of Supervisors/Chula Vista City Council deliberation on any or all portions of the Final Program Environmental Impact Report and the Otay Ranch Project. It is anticipated that the public hearing will be continued to the Joint Board of Supervisors/Chula Vista City Council hearing of June 30, 1993 at 3:00 p.m. in the County Administration Center Board Chambers - Room 310. IV. ADJOURNMENT . Chula Vista City Council to its regular meeting on June 22, 1993 at 6:00 p.m. in the Council Chambers. . COUNCIL AGENDA STATEMENT Item Meeting Date 6/16/93 ITEM TITLE: Public Hearing: General Plan Amendment (GP A-92- 3), Prezoning (90-C), and General Development Plan (GDP 90-3); Joint Public Hearing with the County Board of Supervisors on the Otay Ranch Project SUBMITTED BY: Director of Plannin~ ~ REVIEWED BY: City Managt!J (4/5ths Vote: Yes_No.xJ The City Council and Board of Supervisors opened a joint public hearing to consider a proposed GPA, GDP and Pre-zoning for the Otay Ranch project on June 2, 1993. A summary description of the proposed project, as well as background information on the planning process, were presented by staff. The hearing was continued until June 16, 1993, in the City of Chula Vista Council Chambers. Accompanying this agenda statement is a 3-ring binder, which is also being distributed to the Board of Supervisors, that contains the City/County Staff Report and a discussion of identified issues. RECOMMENDATION: At such time as the City Council and Board of Supervisors are prepared to act on this project, staff's recommendations would be as follows: 1. Certify the Final Program EIR-90-01, and 2. Approve amending the text and diagrams of the Chula Vista General Plan per the exhibit entitled "City of Chula Vista General Plan Amendments" (Tab #5 entitled "City of Chula Vista General Plan Amendment" in the binder distributed to City Council for the June 16, 1993 public hearing), including the "Industrial Use Option", and 3. Approve the Otay Ranch General Development Plan, including Supporting Documents (RMP, Village Phasing Plan, Facility Implementation Plans and Service/Revenue Plan) and Errata Sheets, subject to modifying the RMP, Facility Implementation Plans and Service/Revenue Plan to conform to the final plan (with the "Industrial Use Option" for Village 3), and 4. Adopt an ordinance approving the Prezoning of 22,529 acres of the unincorporated Otay Ranch property to the PC (Planned Community) Zone, and 5. Direct staff to prepare and refer the proposed final version of CEQA Findings of Fact, the Mitigation Monitoring and Reporting Program, and the Statement of Overriding Page 2, Item Meeting Date 6/16/93 Considerations for the Otay Ranch Project back to the Commission for review and comment prior to City Council adoption of the final form of the project, if any, after adoption of items 2, 3, and 4 above. BOARDS/COMMISSIONS RECOMMENDATION: On May 18, 1993, the Chula Vista Planning Commission, after a total of 36 public hearings on the Draft Program EIR and proposed project (held jointly with the County of San Diego Planning Commission), recommended that in accordance with Resolution No. PCM-90-03 (contained in Tab #5 of the 3-ring binder transmitted herewith), that the City Council: 1. Certify Final Program EIR-90-01, and 2. Approve amending the text and diagrams of the Chula Vista General Plan for the Otay Ranch Project, including the "Industrial Use Option," subject to modifications (generally listed in Exhibit 1 to the resolution), and 3. Approve the Otay Ranch General Development Plan, including Supporting Documents (RMP, Village Phasing Plan, Facility Implementation Plans and Service/Revenue Plan) and Errata Sheets, subject to modifying the RMP, Facility Implementation Plans and Service/Revenue Plan to conform to the final plan (with the "Industrial Use Option" for Village 3) and to modifications (generally listed in Exhibit 1 to the resolution), and 4. Adopt an ordinance approving the Prezoning of 22,529 acres of the unincorporated Otay Ranch property to the PC (Planned Community) Zone, and 5. The County of San Diego Planning Commission also recommended that the Board of Supervisors adopt General Plan Amendments, including the Otay Ranch Subregional Plan (General Development Plan) for the Otay Ranch, subject to modifications. A discussion of the rationale for each Commission's recommendation is contained in the City/County Staff Report behind Tab #2 of the accompanying 3-ring binder. A summary of the differences between the Staff Recommended Plan and the Commission's Recommendations is included below. DISCUSSION: Transmittal of Documents Transmitted under this cover are the following documents: .\. Page 3, Item Meeting Date 6/16/93 1. "Otay Ranch Joint Hearing Binder": Contained within a large 3-ring binder is a detailed City/County Staff Report on the proposed project. Also contained in the binder are the City and County staff recommended General Plan Amendments, Planning Commission Recommending Resolution, Draft City Council Resolution and Ordinance, background information regarding outstanding major issues, and comments received from various citizen planning groups on the proposed project. 2. City/County Staff Recommended "General Development Plan/Subregional Plan" (dated October 5, 1992). 3. "Resource Management Plan" (dated July 31, 1992). 4. "Facility Implementation Plans" (dated November, 1992). 5. "Village Phasing Plan" (dated October 26, 1992). 6. "Service/Revenue Plan" (dated January 11, 1993). 7. "County of San Diego Board of Supervisors Agenda Statement" (dated June 16, 1993): Included for the City Council's information is the agenda statement for the County Board of Supervisors, prepared by the County of San Diego staff. The Board will also receive a copy of this agenda statement in their packet. Previously distributed under separate cover was the "Final Program Environmental Impact Report (FPEIR-90-01)" (distributed on December 18, 1992). Differences between Staff and Planning Commission Recommendations The following is a summary of where the Chula Vista Planning Commission recommendations differ significantly with the City Staff Recommended Plan for the Otay Ranch Project. A more detailed analysis, including a comparison with the County staff and Commission recommendations is contained in the City/County Staff Report (Tab #2 of the 3-ring binder). University and University Timing The Staff Recommended Plan identifies a generalized location for a university westerly of Wueste Road. The City Planning Commission recommends that the university location be expanded to include Villages 9 and 10. The Commission also recommends that the university land use be preserved within those villages until after completion of the first three phases of the Otay Valley Parcel. \ Page 4, Item Meeting Date 6/16/93 Southeast of the Lakes (Village 15) The Staff and Planning Commission agree with the proposed development areas within Village 15. However, the Commission recommends that the area be planned as a predominately estate- type residential community, substantially reduced in dwelling units from the Staff Recommended Plan (a reduction from 1,350 units to 516 units). San Y sidro East Rural Estate Area (Planning Area 17) The Planning Commission recommends the addition of 90 acres to the southeast corner of this development area which will result in approximately 9 single family homes (10 acre lots). EastLake Land Swap Area During processing of the Gtay Ranch Project the Gtay Vista Associates, L.P. (formerly Baldwin Vista Associates, L.P.) and the EastLake Development Company exchanged two parcels of land, both equally about 160 acres in size. The purpose of this exchange, or land swap, was to facilitate more cohesive planning of both the Dtay Ranch and the EastLake Greens project areas. Both parcels have been included in the environmental review and planning process, with the resultant EastLake-owned property included as part of the Otay Ranch Project only as a General Plan Amendment (GP land use designations only). A discussion of the proposed and recommended land use designations for the EastLake Land Swap is included in the Staff Report (Tab #2 of 3-ring binder). The County staff and County Planning Commission did not recommend any changes from their current General Plan for the Land Swap area due to its close relationship to the EastLake Greens development project. As a result, the Chula Vista Planning Commission elected to hold a separate continued public hearing on both the Land Swap area and a "companion" request (GP A- 93-04) proposed by the EastLake Development Company for a General Plan Amendment on 74 acres within the EastLake Greens SPA area, immediately adjacent to the Land Swap area. Staff recommends that a similar approach be taken by the City Council, and that the EastLake Land Swap portion of the Gtay Ranch Project be postponed to a regular City Council hearing date that would follow discussions by the Council on land use issues for the Gtay Ranch GDP (Dtay Valley Parcel). A public hearing notice will be issued separately for the EastLake Land Swap portion of the Gtay Ranch Project and the companion GP A request for the adjacent EastLake Greens (GPA-93-04).
