HomeMy WebLinkAboutOrd 1963-847 ORDINANCE NO. 847 --- AN ORDINANCE OF THE CITY OF CHULA VISTA, CALIFORNIA, DECLARING THAT PARKING DIS- TRICT NO. 1 OF THE CITY OF CHULA VISTA IS FORMED AND DESCRIBING THE ACQUISITIONS AND IMPROVEMENTS TO BE MADE THEREFOR. WHEREAS, on February 6, 1963, a petition for the formation of a parkins district in the City of Chula ViStR, California, under the provisions of the Parking District Law of 1951 (Part 4, Division IS of the StreetG and High- ways Code of the State of California) was fjled in the office of the City Clerk; and WHEHEAS, the City Clerk examined said petition and thereafter certified to this City Council that said petition was Gigned by tIle requiRite number of slgners; and WHEREAS, thereafter this Cj. ty Counci 1 adopted Resolution No. 3040, finding that said petition is sufficient; approving sRid petition and certificate; agreeing to inata]l and maintain or to continue to maintain porlcing meters em certain public ways within the district as proposed in said petition; finding and determining that the public Interest, convenlence and necesslty require that such meters be lnstalled and maintalned or continued to be malntained as proposed in satc1 petitlon; and dlrecting the City Engineer to malee and 1'l1e wlth the City Council a report showtng the matters specified in Sectton 35257 of said Streets and Htghways Code; and WHEREAS, thereafter this City Council adopted Ordinance No. 829, declaring and agreeing that certain described lands owned by the City of Chula Vista shall, for all purposes of said proposed parking district, be held, used and treated in all respects the same as parkinr: places to be acquired with the proceeds of bonds to be issued under said Law; and WHEREAS, thereafter the City Engineer did make his report and file the same with this City Council; and WHEREAS, on May 14, 1963, this City Council adopted its Resolution No. 3115, declaring its intention to form said parking district, to be known and designated as the "Parking District No.1 of the City of Chula Vista" and fixed a time and place for hearing on the proposed formation of said dis- trict; and WHEREAS, copies of said Resolution No. 3115 were publil,hed and mailed as provided by law and said hearing was held at the time and place so fixed; and WHEREAS, at the hearing provided for by said Resolution No. 3115, all persons desiring to be heard were fully heard and all protests and objections made or filed were fully heard and the same have been overruled and denied by order entered on the minutes, and said hearing has been duly concluded; and WHEREAS, this City Council has determined by order entered on its minutes that written objections or protests objecting to the formation of said district have not been VO ~ 47 2. made by the owners of taxable real property in said district having an assessed valuation of more than one-half of the assessed valuation of all taxable real property in said district; and WHEREAS, it is the opinion of this City Council that all of the land in the proposed district, as described in said Resolution No. 3115, will be benefited by the pro- posed project; and WHEREAS, this City Council, during the course of said hearing procured and received such evidence and in- formation as it deems necessary and adequate to enable it to determine, and it does hereby find and determine, that there is public need for the parking facilities described in said Resolution No. 3115, that the proposed district approximately covers the contiguous area needing such facilities, that all of the property within the proposed district will be benefited thereby, and that the proposed acquisitions and improvements are located and designed in the manner most compatible with the greatest public good and the least private injury; NOW, THEREFORE, the City Council of the City of Chula Vista, DOES ORDAIN as follows: :-' Section 1. That it is hereby declared that a parking district designated as "Parking District No. 1 of the City of Chula Vista" is formed under and pursuant to the Parldng District Law of 1951, and the exterior bound- aries of said district are hereby established as follows: ()O~~r 3. All that portion of Quarter Sections 136, 137, i I II 138 in the City of Chula Vista, County of San Diego, State of Ca1ifornia, according to Map thereof No. 505, f'i1ed in the off'ice of the Recorder of San Diego I' ~, County, described as follows: Beginning at a point on the Northerly 1ine of "E" Street, being also the Southerly 1ine of Lot 30 of Quarter Section 136, distant thereon 25 feet from the Southeasterly corner of said Lot 30; 1 _ Thence Northerly, parallel with the Easterly line of said Lot 30, 165 feet; 2 _ Thence Westerly, along the Norther1y line of the Souther1y 165 feet of said Lot 30, a distance of 595 feet more or less to the Easter1y line of Third Avenue, being also the Ylesterly line of said Lot 30; 3 - Thence Southerly along said Easterly line 23.75 feet to the Northerly line of the Southerly 141.25 feet of Lot 31 of Quarter Section 136, and its Easterly prolongation; 4 _ Thence Westerly along said Northerly 1ine and the prolongation thereof, 537 feet more or 1ess to the Easterly line of the Westerly 162.35 feet of said Lot 31; 5 - Thence Northerly along said Easterly line 50 feet to the Northerly line of the Southerly 191.25 feet of said Lot 31; ~DS 4 7 4. 6 - Thence Westerly along said Northerly line 132.35 feet to the Easterly line of Garrett Avenue, said line being also 30 feet Easterly of and parallel to the Westerly line of ssid Lot 31; 7 - Thence Southerly along said Easterly line of Garrett Avenue, 411.25 feet more or less to the Southwesterly corner of Lot 3, Block C of Thompson 's Subdivision, Map No. 1197, filed in the office of the County Recorder of San Diego County; 8 - Thence Easterly along the Southerly line of said Lot 3 and its Easterly prolongation, 132.5 feet to the centerline of the alley in said Blocl~ C; . 9 - Thence Southerly along the centerline of said alley and its Southerly prolongation 800 feet more or less to the Northerly line of Mohnikes Subdivision, according to Map thereof No. 1284, filed in the office of the County Recorder of San Diego County; ;' 10 - Thence Westerly along said Northerly line 132.81 feet to the Easterly line of Garrett Avenue; 11 - Thence Southerly along the Easterly line of Garrett Avenue, 290.40 feet to the Northerly line of "F" Street; 5. 0(;; 7/17 12 - Thence Westerly along the Northerly line of "F" Street, 20 feet; 13 - Thence Southerly along the prolongation of the Easterly line of Garrett Avenue, according to Map thereof No. 820, filed in the office of the County Recorder, 440 feet more or less, to the Southerly line of Center Street; 14 - Thence Easterly along the Southerly line of Center Street, 163.86 feet to the Westerly line of Landis Avenue; 15 - TIlence Southerly, along the Westerly line of Landis Avenue and its Southerly prolonga- tion, 290 feet more or less to the Southerly line of Madrona Street; 16 - Thence Easterly along said Southerly line to an intersection with the Southwesterly right- of-way line of the San Diego and Arizona Eastern Railway, as recorded in Book 789, Page 25 of Deeds, Records of said County, said right-of- way line being a non-tangent curve to the right, having a radius of 450 feet; 17 - Thence Southeasterly along the arc of said curve to the Northerly line of Parkway, being a line parallel with and 40.00 feet Northerly, measured at right angles from the Southerly line of Lot 26 of Quarter Section 137, according to Recorded 6. Section 2. That a general description of the lands in the City of Chula Vi sta, County of San 'biego, to be acquired in fee simple for use as public parking places is as follows: Parcel A-l: All that portion of Lot 6 in Quarter Section 137 of Rancho de la Nacion, according to Recorded Map thereof No. 505 on file in the office of the County Recorder of San Diego County, described as follows: OrA 4/ 9. 'I" Commencing at a point which is North 18026' West, 66.20 feet from a point North 71022' East, 11[5.80 feet from the Southwesterly corner of said Lot, said point of commencement being the North- westerly corner of the land conveyed by W. J. S. Browne and Harriet S. Browne to F. J. Norton by deed recorded in Book 7L~7, Page 31 of Deeds, records of said San Diego County; thence North 18026' West, 66.00 feet to a point in the Southerly line of the land conveyed by W. J. S. Browne and Harriet S. Parcel A-2 - The Westerly 125 feet of the Easterly 265 feet of the Southerly 237 feet of Lot 7 of Quarter Section 137 of Rancho de la Nacion, according to recorded Map thereof No. 505 on file in the office of the County Recorder of San Diego County. Parcel A-3: TIle Westerly 125 feet of the Easterly 265 feet of the Southerly 200.30 feet of Lot 10 of Quarter Section 137 of Rancho de la Nacion, according to Map thereof No. 505, on file in the office of the County ReCOl'der of San Di.ego County. Parcel A-4: Lot 13 of Block II of Chula Vista Villa Tract No. 2 according to recorded Map thereof No. 1206 on file 1.n the office of the County Recorder of San Diego County. Parcel A-5: Lots 2 and 3 of Block 6 of Chula Vista Villa Tract No.2, according to recorded Map thereof No. 1206, on file in the office of the County Recorder of San Diego County. 11. O()~~ 7 Section 3. That a general description of the improvements to be made and constructed on said parking places hereinabove described is as follows: 1. Clearing and grading all parcels, including concrete removal and the removal of existing build- ings and other obstructions as necessary. 2. Preparing and compacting subgrade on all parcels. 3. Paving all parcels with asphaltic material, together with suitable base. 4. Construction of portland cement driveways to provide ingress to and egress from said parking places. 5. Removal, construction and reconstruction of sidewalks, curbs and gutters on all parcels as re- quired. 6. Construction of curb islands and wheel barriers on all parcels. 7. Painting stall lines and directional lines and arrows and installation of appropriate traffic and information signs on all parcels. 8. Installation of lighting systems on all parcels. 9. Construction of retaining wall on Parcel A-5. DO <64 7 12. , " 10. Construction of chain link fence on Parcel A-5. 11. Acquisition and installation of parking meters on all parcels. 12. Any necessary work and materials appurtenant to any of the foregoing or necessary to comply with city ordinances. Section 4. That this City Council hereby finds and determines that the public interest and necessity require the acquisition and construction by the City of Chula Vista of the parking places herein described, that the property described in Section 2 is necessary therefor, and that the acquisitions and improvements herein described are planned and located in the manner which will be most compatible with the greatest public good and the least private injury. Section 5. That the City Attorney of the City of Chula Vista is hereby directed to bring an appropriote action or actions in the name of the City of Chula Vista for the condemnation of the lands to be acquired for use as parking places, as set forth in Section 2 hereof; provided, however, that the City may contract for the purchase of any of said lands or procure options to purchase any of said lands, and if all or any portion thereof can be acquired by contract or under option, at a price which this City Council deems satisfactory, such lands or such portions thereof need not be included in said condemnation actions, or if included therein need not be condemned. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause this ordinance to be published once in the CHULA VISTA STAR-NEWS, n newspaper of general circulation printed and published in the City of Chula Vista.
