HomeMy WebLinkAboutReso 1983-11215 RESOLUTION NO. 11215 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR ROBINHOOD MALL CONDOS, CHULA VISTA TRACT 83-2, 1665-1667 BRANDYWINE AVENUE - ROBERT AND PATRICIA CASEY The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declaration, IS-81-48 , and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accor- dance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Robinhood Mall Condos and has recom- mended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-83-2 adopted on the 23rd day of March , 19 83 , a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. PROJECT LOCATION: South of 1655 Brandywine Ave. PROJECT APPLICANT: Robert E. Casey 3648 Main st. Chula Vista, CA 92011 CASE NO: 15-81-48 DATE: June 25, 1981 A. Project Settinq The proposed project site consists of 0.8 acres of vacant land south of 1655 Brandywine Ave. The project site is presently part of a 1.66 acre parcel, partially developed with a neighborhood cOIT~ercial shopping center. Vacant land is located to the east, an RV storage ~'ard to the south, and comdominiums to the west across Brandywine Ave. There are no rare or endangered species located in the project vicinity. Expansive soils are known to exist in the project vicinity. E1R-73-8, Brandywine Planning Community (Robinhood Point Subdivision) identifies the presence of the La Nacion Fault zone, approximately 100 ft. to the east or the project site. The project site which was previously graded for future commercial construction also serves as access to the RV storage yard to the south. B. Project Descriotion The applicant proooses to amerid the approved General ~evelopment Plan for the project site which consisted of retail commercial floor space, in order to construct a 14 unit apartment complex. The proposed development consists of two 3 story structures, parking for 33 cars, and apprc~riate private open space and landscaping. Access to tho RV storace lot to the south will continue to be provided across the project site. C. Compatibilitv with ~nn~nq and plans The proposed project sit0 is a part of a 108 acre Planned Community (Robinhood Point). Residential density (gross) within this nreviouslv aDoroved Dlan amounts to 2.7 dwelling units per acre. The proposed project will be compatible with the General Plan upon approval of the revised General Development Plan. D. Identification of environmental effects 1. Soi Is Expansive soils have been identified in a ~ecent soils report prepared on the subject property (Woodward-Clyde Consultants May 1979). Recormendations contained in the report should be incorporated into any development of the project site. 2. Geolocy The location or the La Nacion Fault zone was identified Ln EIR-73-S. The EIR advises that no residential structures be constructed with~n the fault zone (identified on the Robinhood Point subdivision ~ap). Since commercial structures were previously proposed ~est of the fault zone and this proposed project will not have any structures located within the fault zone, no additional geological investigation will be required. 3. Dra in.:1ce Sur:ace drainage from the commercial site to the north presently traverses the subject site at two locations via concrete low- flo\v ditches. This runoff will be rerouted with this proposal, in order to reach Brandywine Ave. Approval by the Landscape Architect and City Engineer will be required for the design of these systems. 4. Noise The commerclal development to the north has its trash receptacles located adjacent to the subject site. Nuisance noise levels may be experienced within the proposed private open space areas. A 6' hiGh zoning wall is proposed for the northerly property line dividinG the commercial and residential land uses which should hc~lEJ in reducing these impacts. 5. i\esth(~tics Since par~inq lot lighting for the adjacent development is located at the subject propertys northerly boundary, special emphasis sh0uld be placed on providing some shielding of excess alare on th(~ cro~osed aoartment units. Develop~ent of the project site shall conform to recommen- dations contained within the soils investigation (Woodward-Clyde Consultants, May 1979) to ensure stable construction. 2. Inte~nal site surface drainage plans shall be approved by the City Engineer and the City's Landscape Architect prior to construction of the project. 3. Patio sunshade structures shall be constructed for units 11 through 14 fo~ sc~eening of parking lot pole lights. Specifications shall be subject to zoning requirements. 4. The develope~ shall submit letters from the local school districts assuring that adequate classroom space is available to developrr.ent. F. FindinGs or InsiGnificant Impact 1. The project >vill not adversely effect any natural or man- made environ~ental features present in the project setting, nor \~ill the project generate any pollutants that will have a potential to signi:icantly degrade the quality of the environ- ment or curtail the range of the environment which supports the bios,:'s te",. 2. The project lS in conrormance with the long range goals or the Cit7 0: Chula Vista and will not therefore attain short term to the disad\'antage of long range goals. 3. The pro~osed apartments will not have any impacts that are antici~atcd to interact and cause any substantial cumulative affect on the cn~iron"'ent. 4. PCS-83-2 RESOLUTION OF CITY OF CHULA VISTA PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR ROBINHOOD MALL CONDOMINIUM, CHULA VISTA TRACT 83-2 WHEREAS, a duly verified application for a tentative subdivision map was filed with the Planning Department of the City of Chula Vista on January 27, 1983 by Robert E. and Patri ci a F. Casey to subdi vi de 1.66 acres located at the southeast corner of Brandywine Avenue and Sequoia Street into two lots and construct a 14-unit condominium project on lot 2, and WHEREAS, Section 66473.5 of the State Map Act provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted general plan or specific plan for the area, and WHEREAS, the Planning Commission set the time and place for a hearing on said tentative subdivision map application and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hearing, and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., March 23, 1983 in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Commission found that the project would have no significant environmental impacts and re-adopted the Negative Declaration issued on IS-81-48. NOW, THEREFORE, BE IT RESOLVED that the PLANNING COMMISSION finds from the facts presented to the Planning Commission that the tentative subdivision map for Robinhood Mall Condominium, Chula Vista Tract 83-2 is in conformance with the General Plan of the City of Chula Vista, based on the following: 1. The site is physically suitable for the residential and commerc i a 1 deve 1 opment and the propos a 1 conforms to all standards established by the City for such projects. 2. The design of the subdivision will not affect the existing improvements streets, sewers, etc. -- which have been designed to avoid any serious problems. ,KZ / /c/)5 3. The project is in substantial conformance with the Chula Vista General Plan Elements as follows: a. Land Use - The proposed project is in keep; ng with the General Development Plan of the Point Robinhood Planned Community lone. b. Circulation - The project will not require the extension or dedication of streets. c. Housing - The project will provide additional housing choices in this segment of the community. d. Conservation The site has been previously graded, therefore, there wi 11 be no loss of natural habitat or vegetation. e. Park and Recreation, Open Space - The developer is required to pay the Park Acquisition and Development fee prior to recordation of the final map. f. Seismic Safety - The La Nacion fault line and boundary line abut the subject property. g. Safety - The site is well within the response time of the fire station located on East Oneida. h. Noise - The units are required to meet interior noise levels as determined by the Uniform Building Code. i. Scenic Highway - The adjacent streets are not designated as scenic routes. j. Bicycle Routes - The existing streets can accommodate bicycle traffic. k. Public Buildings - No public buildings are planned on the project site. 4. Pursuant to Section 66412.2 of the Subdivision Map Act, the Commission certifies that it has considered the effect of this approval on the housing needs of the region and has balanced those needs against the public service needs of the residents of the City and the available fiscal and environmental resources. BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSION recommends that the City Council approve the tentative subdivision map for Robinhood Mall Condominium, Chula Vista Tract 83-2 subject to the following conditions: 1. Grading plans shall be submitted and approved by the City Engineer prior to approval of the Final Map. - 2 - k~)/c//5 2. The developer shall obtain a construction permit for the curb outlets and driveway construction with public right of way prior to approval of the Final Map. 3. The developer shall record Covenantst Conditions and restrictions (CC&R's)t subject to the approval of the City Councilt concurrently with the recordation of the final map. 4. The City of Chula Vista shall be made a part of the CC&R's which shall include but not be limited to the following: a. Prohibition against outside radio and television antennae. b. Provisions for maintenance of all common areast buildingst fencing or walls and private utility systems. The Planning Commission directs that this resolution be forwarded to the City Council and a copy be sent to the applicant.
