I The City Council of the City of Chula Vista does hereby

resolve ~s follows:
I WHEREAS, an application for a conditional use permit
was filed with the Planning Department by Richard Zogob requesting
pernlissi6n to develop a 13-unit senior housing project on approxl-
mately Ol23 acres of property located at 411-415 Park Way in the
R-3 zone! and
;
j WHEREAS, the Planning Commission, at their meeting of
September 14, 1983, considered said conditinal use permit and
granted ~pproval subject to the conditions contained in their
Resolution No. PCC-83-24, and

I WHEREAS, in accordance with the attached Negative
Declaration, IS-83-29, the proposed conditional use permit will
not havela significant impact upon the environment and the City
Council hereby certifies that the Negative Declaration was
preparedfin accordance with the California Environmental Quality
Act, as amended, and .
I WHEREAS, the Council considered the further condition
of requit:ing the installation of "grab bars" in bathrooms as a

safety measure for elderly tenants.

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve Conditional Use. Permit
PCC-83-4 to construct a 13-unit housing project at 411-415 Park
Way subject to the conditions set forth in Planning Commission
Resolutibn No. PCC-83~2:4 adopted on the 14th day of September,

The project involves 10,400 sq. ft.. of property which presently contains
two s i ngl e-~ami ly dwe 11 i ngs located at 411 and 415 Park Way. Adj acent 1 and
uses consist of single.family dwellings located to the east and west,
single-famil~ and multiple.family located across Park Way to the south, and a
natural drainage channel (unlined) to the north.

The project site is void of any significant wildlife and there are no
significant i natural or manmade resources present. Silt and uncompacted
.topsoils have been identified on the project site and no geologic hazards are
known to exist in the project vicinity.

B. Project Description
I
. The applicant proposes to remove or raze two existing single-family
dwellings an'd construct a 16.unit, senior citizen residential development. A
total of seven on-site parking spaces are proposed.

C. Compatibility with Zoning and Plans
The prop1osed project is zoned R~3 (Multiple Family) and would permit a
maximum of s'ix conventional units. The project wi 11 result in a total of 16
senior citiz~n apartments which will require the approval of a conditional use
permit by thk' Planning Commission and City Council. The project, as proposed,
is compatible with the General Plan.

Associates, ]April 1983) which identifies the presence of loose silty sand
underlain wi1th dense, sandy clay. Recommendations have been included in the
soils report which, when implemented into the project, will reduce these
adverse soil conditions to a level of insignificance.

and senior citizen facilities which could adequately serve residents of this
project. No ~itigation will be required.

E. Findings ~f Insignificant Impact
1. The Is itei s void of any natural or manmade resources, and there are
no' geologic hazards present on the site. Adverse soii conditions
have been identified on' site, however, proposed recommendations
con~ained in a soils investigation prepared by C. H. Wood and
Assobates, April 1983, will reduce environmental impacts to a level
of i~significance.

2. The i proposed senior citizen residential development is consistent
with the General Plan and associated elements and is not anticipated
to ~chieve short?term to the disadvantage of long?term environmental
goa 1's;

3. No impacts are anticipated to occur which could interact to create a

SENIOR HOUSING DEVELOPMENTS POLICY
No. 10763 on February 2, 1982
OBJECTIVE I
To provider rental tenancy standards which will assure that housing units
developed under a conditional use permit as part of a Senior Housing
Deve10pmentl are established and maintained for the exclusive use of low or
moderate income senior residents.

STANDARDS I

1. Renter IAge. To rent a Senior Housing Development unit, the renter/
occupan[t must be 60 years of age or 01 der.,

* 2. Renter household income. Tenant income shall be equal to or less than 80%
of the Icurrent HUD-pub 1 i shed SMA (area) medi an income. Ca1 cu1 ated income
will include reasonable yield from liquid assets. The median income will

be upda~ed annually.

3. Renter Ii ncome certifi cati on. Income el i gi bil ity shall be determined for
all ren~ers by the County Housing Authority or.a similar agency. The unit
owner ~ill request referral s from the County Housing Authority' sSection 8
Existin'g waiting list. If that list is insufficient, the owner will pay
income Idetermination fees for applicants not on the Housing Authority's
waiting list.

** 4. Unit rental rate. The rental price shall not exceed the current published
Section tl Existlng program fair market rents for unit size,less HUD-
pub1 ish'ed utility allowances for specific util ity configurations. Rental
rates rilay be increased wi th annually published increases in Section 8

5. Continu'ation of affordability. A deed restriction shall, bind the owner
and an~ successors to malntalning maximum rents at or below the published
Section,8 fair market rents for a period of 25 years. Additionally,
conversion of the project to condominiums would be prohibited during that
period.

1983, by Richard Zogob, and

WHEREAS,' said appl ication requested the development of a 13-unit
seni or hous1i ng proj ect on approximately 0.23 acres of property located at
411-415 ParK Way in the R-3 zone, and

WHEREAS, the Planning Commission set the time and place for a hearing
on said conditional use permit application and notice of said hearing,
together wi1th its purpose, was given by its publ ication in a newspaper of
general circulation in the city and its mailing to property owners within 300
feet of thelexterior boundaries of the property at least ten days prior to the
heari ng, and .

WHEREAS, the hearing was held at the

7:00 p.m., September 14, 1983 in the

before the Planning Commission and said

WHEREAS, the Commission found that the project would have no
significantll environmental impacts and adopted the tJegative Declaration issued

If security fencing and gates are used, a "Knax" bax with keys
ta .open the gates shall be installed and keys pravided ta the
Fire Department.
2. A 3 1/2 faat high screening wall in frant .of the parking shall
be pravided unless the frant setback is maunded.
3. A grading plan shall be submitted cancurrent with an applicatian
far a building permit.
