HomeMy WebLinkAboutcc min 1976/03/10 MINUTES OF AN ADJOURNED REGULAR MEETING OF TBE CITY COUNCIL OF CHULA VISTA, CALIFORNIA Held Wednesday March 10, 1976 A regular adjourned meeting of the City Council of the City of Chula Vista, California, was held on the above date beginning at 4:00 p.m. in the Council Conference Room, City Hall, 276 Fourth Avenue, with the following Councilmen present: Councilmen Hyde, Hobel, Egdahl Councilmen absent: Mayor Hamilton, Councilman Scott Staff present: City Manager Cole, Assistant City Manager Asmus, City Attorney Lindberg, Assistant to City Manager Wittenberg City Clerk Fulasz opened the meeting at 4:07 p.m. announcing that both the Mayor and Mayor Pro Tempore were absent. She asked for a motion to appoint an Acting Mayor Pro Tempore to chair the meeting. ACTING MAYOR PRO It was moved by Councilman Hobel, seconded by TEMPORE APPOINTED Councilman Egdahl and unanimously carried by those present that Councilman Hyde be appointed Acting Mayor Pro Tempore. UNANIMOUS CONSENT ITEM: RESOLUTION NO. 8087 - The Director of Public Works requested that the FINDING THAT IT IS TO THE trees and other plant materials required for the CITY'S BEST INTEREST TO landscaping of the areas surrounding the new PURCHASE TREES AND OTHER Library should be se2ected by the Landscape PLANT MATERIALS FOR Architect and Purchasing Agent for quality and LANDSCAPING THE LIBRARY appropriateness in relation to the Architect's SITE WITHOUT COMPLIANCE Landscape Plan. The City Manager recommended WITH THE BIDDING PROCEDURE that this be done since it will be necessary to select the trees and other plant materials from several suppliers in Southern California. Resolution offered Offered by Council.man Hobel, the reading of the text was waived unanimously by those present, passed and adopted by the following vote, to-wit: AYES: Councilmen Hobel, Hyde, Egdahl Noes: None Absent: Mayor Hamilton, Councilman Scott MIDDLE MANAGEMENT PROPOSAL City Manager Cole explained the Middle Management Proposal noting that on February ll, 1976 the Council approved this program in concept. He referred to his memo to the Council dated March 4, 1976 in which he listed 34 positions eligible for this classification. Charts were displayed depicting these key positions in each department and the Council was presented with a copy of the orgamizational charts in the City plus a set of criteria for defining Top Management and Middle Management positions. BARGAINING GROUPS Councilman Hobel questioned who in the group were still members of bargaining units. Mr. Cole stated that the Engineers are forming a unit at the present time. In this group (middle management) there would be the Traffic Enoineer and the two Senior Engineers, but they ar~ not participating members of the bargaining unit. Any other designated middle management position would be expected to drop out of bargaining units with City Council Meeting -2- Harch 10, 1976 the exception of the Police Captains who belon~ to the Police Officers Association for the benefits received from the association - they do not participate in the bargaining sessions. Purpose of meeting Acting Mayor Pro Tempore Hyde stated that the meeting was called to (t) consider a plan for establishing a middle management echelon in the City structure; (2) does the Council accept the rationale that there should be a middle management plan; (3) who is going to be in it. Motion to accept plan It was moved by Councilman Egdahl, seconded by Acting Mayor Pro Tempore Hyde and unanimously carried by those present to approve the creation of a Middle Management group. Added to motion Councilman Egdahl added to the motion: "with precise details as to who will be included - to be decided. A resolution is to be brought back for Council action." Motion carried Actin§ Mayo~ Pro Tempore Hyde agreed to the second and the motion carried unanimously by those present. Resolution for benefits Assistant City Manager Asmus indicated a separate resolution will be submitted to the Council covering the benefits - this is tied in to up- coming budget. Definition of Top and Assistant to the City Manager Wittenberg Middle Management explained the difference between Top and Middle Management: Top Management tends to plan and control in a general sort of way whereas Middle Management tends to implement and supervise. Assistant Department Heads There are three Assistant Department Heads included in the Middle Management group: Assistant Fire Chief, Assistant Director of Public Works and Assistant Director of Planning. Because of a recent Charter change, these positions can be listed as unclassified, and because of their job functions and responsibilities, they qualify as Top Management. Council discussion ensued as to the duties and responsibilities of these three persons - whether they sit in on Top Management meetings - make decisions - and other aspects of the Top Management role. Assistant City Manager Asmus explained that these three positions were placed in Middle Management because all Top Management people are unclassified all of the Middle Management group are classified. This was weighed heavily in the decision of whether to put the three assistant department heads in Top or Middle Management, as well as their role in assisting the Top Management. Mr. Asmus added that these positions really fit "down the middle" of the criterion sheet, not fitting perfectly with either the Top or Middle Management groups Motion to place Assistants It was moved by Councilman Egdahl, seconded by in Middle Management Acting Mayor Pro Tempore Hyde an~ unanimously carried by those present that, at this point, (because they are still classified employees) these three persons are to be kept in the Middle ~lanagement consideration and status and that the City Council Meeting -3- March lO, 1976 Council address classified versus unclassified for those three at a future time, and at that point, whether they will be in Middle or Top Management. City Manager Cole noted that the change ~0 place these positions in the unclassified category can be made at any time. Acting Mayor Pro Tempore Hyde commented that he would find it difficult to move one person from one category to another merely on whether he is classified or unclassified. Councilman Hobel remarked that after hearing the staff's comments, he is not convinced that this "top planning function" should be moved from Middle to top Management. MIDDLE MANAGEMENT Councilman Hobel questioned how many of the DESIGNATIONS ~4~ positions are still in the bargaining units. Assistant City Manager Asmus said the Tree Maintenance Supervisor is still in and technically, cannot get out of the MOU (Memorandum of Under- standing - Employees Association) until June 30 although he is no longer paying dues. The Senior Engineers stopped paying their dues a year ago. Battalion Chiefs In answer to Councilman Hobel's question, City Manager Cole explained that one of the conditions of Middle Management is that the positions receive no overtime. The Battalion Chiefs, however, are eligible for overtime and are included in the Middle Management because of their unique s~heduling of work, but they are not included in the Middle Management benefits. Councilman Egdahl indicated his reluctance to create all kinds of exceptions to this proposal. Acting Mayor Pro Tempore Hyde asked that this exception be delineated in the resolution. Administrative titles Councilman Hyde questioned the rationale of including the Administrative Assistants and Assistant to the City Manager. City Manager Cole and Assistant to City Manager Wittenberg discussed the roles of Assistant to City Manager, Administrative Assistants, Admin- istrative Analysts, Personnel Analysts and Administrative Aides. Deputy City Clerk Acting Mayor Pro Tempore Hyde asked the rationale of including this position. Mr. Asmus asked that the City Clerk be allowed to comment on this. He explained that this position deals with Top Management to a considerable degree especially in the absence of the City Clerk. The Deputy has oonsiderable responsibilities under the State Codes, in her relationship to the City Clerk and in her dealings with the legislative body - the City Council. City Clerk Fulasz explained the supervisory duties and responsibilities of the Deputy, noting that she is unclassified. City Council Meeting -4- March 10, 1976 Personnel Assistant Acting Mayor Pro Tempore Hyde questioned including this position. Mr. Asmus explained that that position performs a role similar to that of Assistant to the City Manager in its relationship of that positio~ to the Personnel Director. Senior Recreation Supervisg~~ In response to Council's questions, Mr. Asmus explained the span of responsibilities for this position. Motion to include positions It was moved by Councilman Hobel, seconded by Councilman Egdahl and unanimously carried by those present that the 34 positions listed from "A" through "V" in the City Manager's report dated March 4, 1976 be approved (for Middle Management). BENEFITS Assistant City Manager Asmus stated that the staff will now develop the benefits and present these at budget time, HEALTH INSURANCE City Manager Cole remarked that he has had requests from these employees to authc, rize taking the equivalent of the money the City pays to the Travelers Instance Company and pay this to Kaiser Foundation Health Plan. The Council discussed whether Travelers requires a certain number of employees under their Plan. Mr. Asmus said that this was discussed with Travelers and they indicated they would not lose enough members to make any difference. Motion to accept positions It was moved by Acting Mayor Pro Tempore Hyde, as Middle Management seconded by Councilman Hobel and unanimously carried by those present that a resolution be brought back indicating the City Council's acceptance of the proposal for a creation of a Middle Management group within the City Manaqe- ment structure consisting of members indicated in "B" (City ManaQer's report dated March 4, 1976) plus the three Assistant Department Heads. MOTION REGARDING HEALTH It was moved by Councilman Egdahl, seconded by INSURANCE PLAN Acting Mayor Pro Tempore Hyde and unanimously carried by those present that the Top and Middle Management positions be given the privilege (of designating whether they prefer membership in the Kaiser Foundation Health Plan). TELEGRAM TO LEGISLATORS The Council was given a copy of the telegram sent to Assemblyman Wadie Deddeh and Bill Craven opposing AB 3000 (Peace Officers). ADJOURNMENT Acting Mayor Pro Tempore Hyde adjourned the meeting at 5:35 p.m. to the meeting scheduled for Thursday, March 11, 1976 at 2:00 p.m. joint meeting with the San Diego County Board of Supervisors. dMF:mf
