OF THE CITY COUNCIL OF CHULA VISTA, CALIFORNIA
Held Thursday April 8, 1976
An adjourned regular meeting of the City Council of the City of Chula Vista, California
was held on the above date beginning at 4:00 p.m. in the Council Conference Room, City Hall,
276 Fourth Avenue.
Mayor Pro Tempore Scott called the meeting to order and announced that the meeting would
be adjourned to the Council Chambers for the convenience of the public. The meeting recon-
vened in the Council Chambers at 4:05 p.m. with the following
Councilmen present: Councilmen Scott, Hobel, Hyde, Egdahl
Councilmen absent: Mayor Hamilton
Staff present: City Manager Cole, City Attorney Lindberg, Director of Planning
Peterson
REPORT ON STANDARDS FOR On January 13, 1976 the City Council directed the
BOARDING/LODGING HOUSES staff to develop a set of guidelines for the
AND COMMUNITY HOUSEHOLDS operation of boarding/lodging houses. Director
of Planning Peterson summarized the results of
staff research and study, noting that there is
a slight conflict in the present City Zoning
Ordinance and the definition of boarding/lodging
house in the Housing Code. Staff recommends that
the Zoning Ordinance be amended to conform with
the Housing Code.
Staff recommendations Additional staff recommendations presented by
Mr. Peterson were:
(1) Usable open space of 200 square feet per
resident
(2) One bathroom for every three bedrooms or
fraction thereof
(3) In cases of five or less boarders, lodgers,
or residents, one off-street parking space
for each car owned by a resident; for more
than five residents in a facility, the
Planning Commission to determine what the
required parking spaces should be, based
on number of bedrooms with a minimum of one
parking space for each bedroom
(4) Each facility to be inspected by the City at
least once a year and the Planning Commission
review the use permit every three years
(5) Additional requirement (covered by the
Housing Code) of minimum sleeping area for
each person - 70 square feet for the first
two persons and 50 square feet for each
additional person.
Question of phraseology of Councilman Hyde questioned the phraseology of
"community households" "community households" used in Exhibit "A", item 1.
He felt this use negated previous Council action
indicating that community households would not be
allowed in R-1 or R-2 zones - only single families.
Director of Planning Peterson explained that part
of staff effort was to as nearly as possible,
Justified by facts, treat the communal household
the same as the lodging houses and boarding houses.
Council discussion The Council discussed in-depth definitions of
"community household"; parking space requirements
and related problems; number of persons permitted
per bedroom; definition of "principal residents"
and "principal residence"; and definitions of lodg-
ing and boarding houses.

Councilman Hyde suggested that a definition be
determined for lodging and boarding houses and
then that these types of dwellings not be per-
mitted in the R-1 and R-2 zones, but only in
R-3 zones or other appropriate areas; and that
finite standards be established geared to the
capacity of the facility.
Motion to delete Item 1 A It was moved by Councilman Hyde and seconded by
of Exhibit "A" - Proposed Councilman Egdahl, that Item 1 A in Exhibit "A"
Ordinance Changes (Proposed Ordinance Changes) be deleted and not
have community households, lodging or boarding
houses in the R-2 zone.
Councilman Hyde asked permission to read the
statement he was referring to in his motion:
"I am recommending deletion of the following
statement in the proposed instrument, 'Community
Households and lodging and boarding houses for
not more than five persons' (would be allowed
in the R-2 zone as a conditional use). I am
moving that we not allow that."
Motion carried The motion carried unanimously by those present.
Motion to amend Item 2 A It was moved by Councilman Hyde and seconded by
of Proposed Ordinance Mayor Pro Tempore Scott, that in Item 2 A amending
Changes - Exhibit "A" Section 19.28.030 - accessory uses in the R-3
Zone - the words "community houeehold" be deleted,
the balance of the wording to remain as "lodging
and boarding houses for not more than five persons."
In answer to a query from Councilman Hobel of the
Council members as to how they proposed to address
"community households," City Attorney Lindberg
stated he had advised the Council to look for
a generic term that covers all living arrangements
of this nature which are very similar to the
boarding/lodging house arrangement.
Motion carried The motion carried by the following vote, to-wit:
AYES: Councilmen Hyde, Egdahl, Scott
Noes: Councilman Hobel
Absent: Mayor Hamilton
Motion to delete Item 4 - It was moved by Councilman Hyde, and seconded by
of Exhibit "A" - Proposed Councilman Egdahl, to delete the entire section
Ordinance Changes under Item 4, amending Section 19.62.050 -
Number of spaces required for designated uses -
relating to parking requirements.
Motion carried The motion carried by the following vote, to-wit:

Motion to delete Item 5 It was moved by Councilman Hyde, seconded by
of Exhibit "A" - Proposed Councilman Egdahl and unanimously carried by
Ordinance Changes those present, to delete Item 5, in its entirety,
"Add to Definitions, Section 19.04.055, Community
Household."
Motion to delete wording It was moved by Councilman Hyde and seconded by
in Item 3 B, Exhibit "A" - Mayor Pro Tempore Scott, to delete under Item 3
Proposed Ordinance Changes B the terms "Community Households or."

Motion to delete term It was moved by Councilman Hyde, and seconded by
"Corm~aunity household" in Mayor Pro Tempore Scott, to delete the words
Item 6 "Cormmunity Household" from the title in Item 6 -
"Add new Section 19.58.111 (Uses). [19.58.111
~m~y=~~ lodging and boarding houses.]
And in the paragraph following, to delete the
words "Co~nunity households and". (~m~m~y
~~=~m~ lodging and boarding houses which
house six or more residents not rslatsd by blood,
marriage or adoption shall adhere to the following
criteria:)
Motion carried The motion carried by the following vote, to-wit:

Motion for parking requirements It was moved by Councilman Hyde and seconded by
Mayor Pro Tempore Scott, that the requirement for
parking should provide that in determining the
number of parking spaces for lodging and boarding
houses, one parking space be required per bedroom
in addition to the basic parking requirements for
the dwelling. (7 bedrooms - 9 parking spaces.)
Discussion of motion Discussion followed coucerning criteria for
apartment house parking, definition and use of
rooms as bedrooms, required parking per bedroom,
using square footage as a reverse criteria, and
basic parking requirements per dwelling.
Revised motion It was moved by Councilman Hyde, and seconded by
Mayor Pro Tempore Scott, that the staff prepare
for this Section (Item 6 A) parking requirements
which would provide the basic household offstreet
parking requirements of two spaces, plus one
additional parking space per bedroom; and the
Planning Commissiom would have the authority to
increase the number of parking spaces beyond that
minimum if the design plan of the dwelling would
permit an occupancy which would generate a need
for more parking spaces, Tandem parking spaces
would not be authorized.
Motion clarified Councilman Egdahl asked if Councilman Hyde's intent
was that the circumstances requiring additional
parking spaces would be based on the building
capacity rather than the people occupying the
building. Councilman Hyde answered affirmatively.
Motion carried The motion carried unanimously by those present.
Motion for It was moved by Councilman Hyde that the draft
classification include a requirement that rooms within a house-
of bedrooms hold, not classified as bedrooms which lent them-
selves to conversion to bedrooms, would be
classified as bedrooms for parking space require-
ments.
No second to motion The motion died for lack of a second.

Motion to delete It was moved by Councilman Hyde, seconded by
boarding/lodging Councilman Egdahl, and unanimously carried by
houses from the those present that staff be instructed to bring
R-1 zone back a modification of the Ordinance to delete
boarding houses and lodging houses from the
R-1 zone as well as the R-2 zone.
Mayor Pro Tempore Scott expressed concern on
the use of the State's definition in the Building
Code for the proper number of people per bedroom.
He felt it was an improper use and inappropriate
for Chula Vista.
Motion for criteria for It was moved by Mayor Pro Tempore Scott that
planning in Chula Vista criteria be set up for what is best for planning
in the City of Chula Vista and not something that
has been set up by the State Building Code.
Motion carried Councilman Hyde seconded the motion, adding that
staff should re-examine the criteria for occupancy
density, The motion carried unanimously by those
present.
Matter referred to staff Mayor Pro Tempore Scott stated that the matter
and Planning Commission should now be referred to staff for a draft
and should also be referred to the Planning
Co~ission. The Council concurred.
Question of City Attorney Councilman Hobel asked of the City Attorney now
that the Council is back to "boarding houses/
lodging houses" is it legally possible to state
within the City that no boarding house/lodging
house can be located closer than one mile to
each other on the radius.
City Attorney Lindberg stated he did not have a
ready answer, but that he would question it.
He said there is the clear possibility of deter-
mining that certain commercial uses, specifically
filling stations and bars, might be prohibited
within certain distances because of the type of
traffic that particular use generates.
Motion for study It was moved by Councilman Hobel, seconded by
Councilman Hyde and unanimously carried by those
present that staff - City Attorney - be asked to
bring back an answer to the question.
Mayor Pro Tempore Scott stated that when the
preliminary draft is completed, copies should
be made available through the City Clerk's
office to those persons interested.
APPOINTMENT TO PARKS AND It moved Councilman seconded

those present that Mr. Edward Thornton be
appointed to the Parks and Recreation Commission.
ADJOUR/qMENT Mayor Pro Tempore Scott adjourned the meeting at
5:41 p.m. to April 13, 1976 at 7:00 p.m.
