ITEM NO.1-a. RESOLUTION - APPROVING AGREEMENT WITH THE COUNTY OF SAN DIEGO
FOR THE LEASING OF PROVENCE PARK AND ASSOCIATED
COUNTY-OWNED PARCELS
b. RESOL UTION - APPROVING OWNER PARTICIPATION AGREEMENT BETWEEN
THE REDEVELOPMENT AGENCY AND THE COUNTY OF SAN
DIEGO RELATING TO THE OTAY LANDFILL
c. RESOLUTION - APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND THE COUNTY OF SAN DIEGO FOR SETTLEMENT
OF COUNTY LAWSUIT REGARDING THE OTAY VALLEY ROAD
REDEVELOPMENT AREA
Member Scott suggested that these items be held over until Tuesday night,
September 11, pending Member Malcolm's return.
Mr. Dave Foreman, 1653 Pt. Cabrillo Court, Chula Vista, briefly discussed a
few of the C it izens Act ion Network's object ions to the owner part ic ipat ion
agreement with the County: 1) amb igu ity of the agreement, 2) ill ega 1 ity of
the agreement, 3) the agreement const itutes a de facto amendment to the
Redevelopment Plan, 4) the agreement is contrary to the Redevelopment Plan.
Chairman Cox indicated that a response to CAN's concerns has been prepared by
the City Attorney and was mailed out this afternoon to Dr. Lichty. A copy of
this response was given to Mr. Foreman at this time.
In response to Member Scott's quest ion regard ing the City's contro 1 of the
property, Agency Attorney Harron stated that the County is mainly concerned
with the tax increment.

In answer to Member McCandliss' question, Agency Attorney Harron stated that
the City does not have land use regulation of the landfill. However, it does
have a policing power.
MSUC (Scott/McCandliss) to hold over Items la, lb, and lc to follow the City
Council meeting on September 11.
DIRECTOR I S COMMENTS
Execut ive Director Goss requested a Closed Session for personnel and
litigation measures.
MEMBERS' COMMENTS
MSUC (Cox/Moore) to adjourn to Closed Session for matters of personnel and
litigation.
ADJOURNMENT AT 8:25 p.m. to the rescheduled meeting of Tuesday, September 11,
1984, following the regular City Council meeting. The Record ing Secretary
was excused and the Executive Secretary reported Closed Session ended at
8:40 p.m.
