A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACKNOWLEDGING RECEIPT OF A RESOLUTION OF THE CHULA VISTA REDEVELOPMENT AGENCY RELATING TO THE PROPOSED OTAY VALLEY ROAD REDEVELOPMENT PLAN AND PRO- JECT AREA; CONSENTING TO HOLD A JOINT SPECIAL PUBLIC HEARING THEREON BY THE AGENCY AND THE CITY COUNCIL; SETTING A DATE FOR SUCH HEARING; AND PROVIDING FOR THE GIVING OF NOTICE THEREOF WHEREAS, the Chula Vista Redevelopment Agency has prepared a proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area and transmitted said 'documents to the Planning Commission for their report and recommendation; and WHEREAS, the City of Chula Vista has prepared a written report pursuant to the Environmental Quality Act of 1970, as amended, regarding environmental impact of the proposed Redevelopment Plan, and WHEREAS, the proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area and the draft Environmental Impact Report have been submitted to the appropriate County and State agencies for review, comment, and report pursuant to the California Redevelopment Law and the California Environmental Quality Act of 1970, as amended; and WHEREAS, the California Community Redevelopment Law (Section 33355 and 33458 of the California Health and Safety Code) authorizes a joint public hearing on the proposed Redevelopment Plan and Project Area with the consent of the City Council of the City of Chula Vista and the Chula Vista Redevelopment Agency; and WHEREAS, the Chula Vista Redevelopment Agency on November 15, 1983, adopted Resolution No. 458 consenting to a joint special public hearing with this City Council and has requested the City Counci 1 to consent to a joint public hearing and set the time and place for same; and WHEREAS, the City Counci 1 of the City of Chula Vista has received from the Chula Vista Redevelopment Agency Resolution No. 458 ,the proposed Otay Valley Road Redevelopment Plan and Project Area, and the Environmental Impact Report. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL OF THE CITY OF CHULA VISTA, AS FOLLOWS: Section 1. The City Council of the City of Chula Vista does hereby receive and fi le all resolutions, reports, and documents as are herein set forth. Section 2. The City Council of the City of Chula Vista hereby consents to a joint special public hearing with the Chula Vista Redevelopment Agency to consider adoption of the proposed Redevelopment Plan and the approval and cer- t ifi cat i on of the fi na 1 Environmental Impact Report, and further, hereby establishes the time, date, and place for said public hearing at 7:30 p.m., December 20, 1983, at the Chula Vista City Hall, 276 Fourth Avenue, Chula Vista, California. Section 3. The City Clerk of the City of Chula Vista in cooperation with the Executive Director of the Chula Vista Redevelopment Agency, shall: a) Publish the notice of said joint special public hearing once per week for four (4) consecutive weeks in the Chula Vista Star News, said publication being a newspaper of general circulation within the Chula Vista community. b) Mail the notice of said jOint public hearing to the last known as sessee of each parce 1 of 1 and in the area des i gnated in the aforesaid redevelopment project plan at his last known address as shown on the last equalized assessment roll of the County of San Diego; or to the owner of each parcel of land within such boun- daries as such ownership is shown on the records of said County recorded thirty (30) days prior to the date the notice is published. Copies of the notices shall also be mailed to the governing bOdy of each of the taxing agencies which levies taxes upon any property in the Project Area designated in the proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area. Section 4. The City Clerk of the City of Chula Vista shall forthwith transmit a copy of this Resolution to the Chula Vista Redevelopment Agency and the Planning Commission of the City of Chula Vista to ,form by /'71-zcwh , J. " CHULA VISTA REDEVELOPMENT AGENCY RESOLUTION NO.Lf458 A RESOLUTION OF THE CHULA VISTA REDEVELOPMENT AGENCY REQUESTING AND CONSENTING TO HOLDING A JOINT SPECIAL PUBLIC HEARING TO CONSIDER FINAL APPROVAL AND ADOPTION OF THE OTAY VALLEY ROAD REDEVELOPMENT PLAN AND PROJECT AREA; AND APPROVAL AND CERTIFICATION OF THE FINAL ENVIRONMENTAL IMPACT REPORT WHEREAS, the Chu I a Vi s ta Redeve I opment Agency has prepared a proposed Redeve I opment PI an for the Otay Vall ey Road Redeve I opment Project Area and transmitted said documents to the Planning Commission for their report and recommendation; and WHEREAS, the City of Chula Vista has prepared a written report pursuant to the Environmental Quality Act of 1970, as amended, regarding the environ- mental impact of the proposed Redevelopment Plan; and WHEREAS, on October 25, 1983, the Chula Vista Redevelopment Agency ad- opted Resolution No. 456 entitled: "A RESOLUTION OF THE CHULA VISTA REDEVELOPMENT AGENCY PRELIMINARILY APPROVING THE OTAY VALLEY ROAD REDEVELOP- MENT PLAN AND PROJECT AREA SUBJECT TO FURTHER REVIEW AND PUBLIC HEARING; DIRECTING THE SECRETARY OF THE AGENCY TO TRANSMIT REQUIRED REDEVELOPMENT DOCUMENTS TO THE APPRO- PRIATE COUNTY AND STATE AGENCIES; APPROVING THE DRAFT ENVIRONMENTAL IMPACT REPORT; AND DIRECTING STAFF TO TRANSMIT THE REQUIRED NOTICE OF COMPLETION" WHEREAS, the Ca Ii forn i a Commun ity Redeve I opment Law (Sect i on 33355 and 33458 of the California Health and Safety Code) authorized a joint public hearing on the proposed Redevelopment Plan for the Otay Valley Road Project Area with the consent of the City Council of the City of Chula Vista and the Chula Vista Redevelopment Agency. f I NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE CHULA VISTA REDEVELOPMENT AGENCY, AS FOLLOWS: Section 1. The Chula Vista Redevelopment Agency hereby consents to a joint public hearing with the Chula Vista City Council to consider adoption of the proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area and the approval and certification of the final Environmental Impact Report, the time, date and place for such hearing to be determined by the Chula Vista City Council. .4/- .~ ~ . The Executive Director of the Chula Vista Redevelopment Agency, upon receipt of evidence that the Chula Vista Council has consented to a joint public hearing and established a date therefor shall: a) Publish the notice of said joint public hearing once per week for four (4) consecutive weeks in the Chula Vista Star News, said publication being a newspaper of general circulation with the Chula Vista community. b) Mail the notice of said joint public hearing to the last known assessee of each parcel of land in the area designated. in the afore- said redevelopment project plan at his last known address as shown on the last equalized assessment roll of the County of San Diego; or to the owner of each parcel of land within such boundaries as such ownership is shown on the records of said County, recorded thirty (30) days prior to the date the notice is published. Copies of the notices shall also be mailed to the governing body of each of the taxing agencies which .levies taxes upon any property in the project area designated in the proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area. Section 3. The Executive Director shall forthwith transmit a copy of this Resolution to theChula Vista City Council and to the Planning Commission of the City of Chula Vista.
