CVRC RESOLUTION NO. 2006-017
RESOLUTION OF THE CHULA VISTA REDEVELOPMENT
CORPORATION AUTHORIZING THE ISSUANCE OF COASTAL
DEVELOPMENT PERMIT NO. 06-078 FOR INSTALLATION OF
ABOVE-GROUND ELECTRICAL UTILITY INFRASTRUCTURE
BY SAN DIEGO GAS AND ELECTRIC (SDG&E) WITHIN
SDG&E'S ELECTRIC TRANSMISSION CORRIDOR, FOR THAT
PORTION LOCATED WITHIN THE CITY'S LOCAL COASTAL
ZONE, AS PART OF THE LARGER OTAY MESA POWER
PURCHASE AGREEMENT (OMPPA) PROJECT
WHEREAS, the City of Chula Vista Local Coastal Plan (LCP) has been certified by the
California Coastal Commission; and
WHEREAS, said LCP includes Coastal Development procedures determined by the
Coastal Commission to be legally adequate for the issuance of coastal development permits and
the City ofChula Vista has assumed permit authority of the Chula Vista Local Coastal Zone; and
WHEREAS, the California Public Utilities Commission (CPUC) granted SDG&E a
Certificate of Public Convenience and Necessity on June 30, 2005; and
WHEREAS, the CPUC, as lead agency responsible for compliance with the California
Environmental Quality Act (CEQA) for the project, certified the final Environmental Impact
Report (EIR) on June 30, 2005; and
WHEREAS, a coastal development permit application was filed for that portion of the
larger OMPPA Project located within the City's coastal zone and not specifically excluded
pursuant to Chula Vista Municipal Code Section 19.83, and
WHEREAS, a public hearing was duly noticed and conducted on March 23, 2006, in
accordance with said procedures; and
WHEREAS, the Chula Vista Redevelopment Corporation, as "approving authority", has
reviewed the project proposal to install above-ground electrical utility infrastructure by SDG&E
within SDG&E's electric transmission corridor, for that portion located within the City's local
coastal zone, as part of the larger OMPPA Project; and
WHEREAS, the City's Environmental Review Coordinator has reviewed SDG&E's
proposed coastal development permit application for compliance with CEQA and determined
that the proposed project was adequately covered in SDG&E's OMPPA Transmission Project
EIR in conformance with the certified Local Coastal Program.

NOW, THEREFORE, BE IT RESOLVED that the Chula Vista Redevelopment
Corporation finds that the installation of the above-ground electrical utility infrastructure by
SDG&E conforms with the certified local coastal program and that the required conditions set
out below carry out the certified local coastal program based on the following facts:
I. The certified Local Coastal Program requires completion of that portion of the
SDG&E OMPPA Transmission Project located within the City's local coastal
zone to be constructed in conformance with the plans, specifications, terms and
conditions approved in granting the permit. The plans, specifications, terms and
conditions for the proposed OMPP A Project were approved by the CPUC.
2. The project is located within SDG&E's existing electric transmission corridor and
will not interfere with coastal access or coastal traffic circulation.
BE IT FURTHER RESOLVED that the Chula Vista Redevelopment Corporation grants
Coastal Development Permit No. 06-078 and approves the project subject to the following
conditions:
TERMS OF GRANT OF PERMIT
I. SDG&E shall implement all mitigation measures identified in the Final SDG&E
OMPPA Transmission Project EIR (State Clearinghouse #2004071138) and
associated Mitigation, Monitoring, and Compliance and Reporting Program
relevant to the portion of the OMPPA Transmission Project located within the
City's local coastal zone.
2. SDG&E shall adhere strictly to the plans for the project as approved by the
CPUC.
3. If construction has not commenced within one year from the date of the final
approval of the application for a coastal development permit, the permit shall
expire. Application for extension of the permit shall be made to the City Director
of Community Development prior to the expiration date.
4. SDG&E shall defend, indemnify and hold harmless, the City and Redevelopment
Agency, and the ChuIa Vista Redevelopment Corporation, their elected and
appointed officers and officials, agents, and employees, from all legal or equitable
claims challenging the issuance of the permit, as well as any claims for damages
for personal injuries or property damage allegedly caused by the activities
conducted pursuant to this permit.
