OF THE CITY COUNCIL OF CHULA VISTA, CALIFORNIA
Held Thursday - 4:00 p m July 14, 1977
An adjourned regular meeting of the City Council of the City of Chula Vista, California, was
held on the above date beginning at 4:00 p.m. in the Council Conference Room, City Hall, 276
Fourth Avenue.

1. RECENT HISTORY - EL RANCHO DEL REY
a. Summary of City Director of Planning Peterson called the Council's atten-
Council actions on tion to three exhibits displayed on the wall - (1) on the
E1 Rancho del Rey right: the 1970 Plan of Record pertaining to the E1 Rancho
in the last few del Rey area; (2) in the center: a map representing the
months proposal by Otay Land Company dated November 12, 1976 upon
which the model was based; and (3) on the left: a "Com-
munity Sketch Plan" presented on March 31, 1977 by staff
after the Council had viewed the model and expressed dis-
satisfaction with it.
Mr. Peterson then reviewed some of the Council actions
taken in recent months including (1) the request that the
0ray Land Company prepared a model to show the grading that
would result from their proposal in 1976 (the center ex-
hibit) and which was completed in February, 1977; (2)
referring the model to the staff for report and recommenda-
tion regarding Council concerns that canyons were preserved,
but the hillsides were not; (3) referring three alternate
grading concepts presented by the staff in March, 1977 to
ACCORD; and (4) scheduling this conference after receipt
of a copy of the letter addressed to Mr. Carmen Pasquale
from Mr. Jim Hutchison, (dated June 9, 1977) in response
to the "Community Sketch Plan" (exhibit 3) and Grading
Concept No. 2, which the staff had recommended the Council
endorse as having merit for further investigation.
Plans rejected by Mr. Peterson s~ated that Mr. Hutchison apparently believed
Council and Developer the Community Sketch Plan and Grading Concept No. 2 were
final products which Would be recommended for adoption by
the Council, but this was not staff's intent. Staff felt
the Grading Concep: had merit, but did need refinement
and changes. In summary Mr. Peterson said that the Council
has rejected the Otay Land Company Land Use Plan (exhibit
2] and the developer has rejected the staff grading con-
cept and plan; howeyer, th~ ~taff and representatives of
the developer are still working together but he was not
optimistic that agreement would be reached.

Staff to make Mr. Peterson said it was his intent to meet the schedule,
presentation to if at all possible, and make his recommendation to the
Planning Commission Planning Commission in September or October pending the
report from ACCORD and the final report of the Consultant,
Mr. Cooke.
2. STAFF WORK WITH 0TAY LAND COMPANY

Company Mr. Pasquale stated it was their understanding that the
Council wanted to identify ridges and canyons and the
developer had gone one step further to include density to
see if the plan would be economically feasible.
Council discussion Council discussion ensued with staff and the developer
concerning the following:
(1) Mr. Hutchison's negative response to staff recom-
mendations of Grading Concept No. 2 and the Com-
munity Sketch Plan;
(2) The degree to which economic feasibility should be
considered simultaneously with planning;
(3) Council's direction to ACCORD in expanding their
involvement to include review and comment at key
points on the General Development Plan beyond
the 450 acres;
(4) Refinement and further testing needed on staff
Grading Concept No. 2; staff of Planning ,
and Public Works Departments concurred that con-
cepts and principles are valid, but they do need
more work (Mr. Hutchison had evaluated this as a
final plan);
(5) The goal is to work toward a revised General
Development Plan and identify ridges and canyons
to be preserved as a part of that Plan (Mr.
Pasquale suggested that rather than identify spe-
cific ridges and canyons, that total acres of
open space be considered);
(6) Comments from the City Attorney that the Council
should not consider specifics at this point as
the entire process must still go through the
Planning Commission with public hearings for
public input and comments before the Council can
make final decisions;
(7) That limited grading could be done on ridges as
long as the basic character of the topography is
not changed on the ridges to be preserved (Rancho
Robinhood given as an example);
(8) Presentation by Planning staff to Planning Com-
mission would be premature until report is received
from ACCORD and the final report by the Consultant
is made and accepted by the Council on the 450

Reports from Consultant In depth discussion continued regarding (1) problems in
and ACCORD next step identifying ridges and canyons to be preserved; (2) de-
in planning process lays and problems in maintaining a schedule; (5) economic
impact; and (4) what the best procedure is to attain the
goal of a revised General Development Plan. In summary,
Mr. Peterson said that the next step is for the Consultant
(Mr. Cooke) to make his report and recommendation and
for ACCORD to make their recommendation to the Council on
the 450 acres.
Motion to maintain It was moved by Councilman Hobel that the Council adhere
Revision 3 on the schedule to Revision 5 on the schedule - the latest one that indicates
the process will be finished in January.
No second to motion The motion died for lack of a second.
Motion to direct It was moved by Councilman Egdahl and seconded by Mayor
City Manager to move Hyde that the City Manager be directed to move this project
project forward as forward with all deliberate speed.

3. DISCUSSION
a. Status of Director of Public Works Robens said that since his
Assessment District report to the Council in September 1976, he has met with
bond counsel, assessment engineer and finance consultant,
and the only change in the report is the amount of bonds -
instead of 10 to 15 million dollars worth of improvements
included in the assessment district, 4 to 6 million would
be a more appropriate amount for the City to bond. The
City is responsible for the 1915 Act bonds and in the
event they are delinquent, the security of the bonds is
based on the ability of the City to loan annual payments
to the bond redemption fund.
City limited City Attorney Lindberg concurred with Mr. Robens' estimate
in bonds of 4 to 6 million dollars noting that the ability of the
City to levy a special tax to service the bonds would
have to be considered in the event of delinquency.
Assessment distric~ Mr. Robens explained that from the time the General

twe-~a~es would be to hire an engineer and legal counsel specifically
to handle the 1915 Act Assessment District and 1915 Act
bonds, and as soon as the Plan is approved to proceed with
the engineer's report and establish the district - which
cannot be done until the facilities and boundaries are
determined. Mr. Robens said it is a complex procedure
and does involve a public hearing process, which could
cause some delays; otherwise, there would be no loss of
time.
Reimbursement district In response to a question from Mayor Hyde, Mr. Robens said
recommended for Telegraph that for Telegraph Canyon Road, he would recommend that
Canyon Road a reimbursement district be used, and that the assessment
district be used for "H" Street.

Concern of developer Mr. Hutchison expressed the concern of the developer
regarding spread regarding the major improvements to go in and how it
of assessment could be spread against other benefitting properties,
particularly existing developments.
d. Development of Mr. Robens reported that for E1 Rancho del Rey No. 5,
reimbursement reimbursement procedures would be developed so that the
procedures developer, who is putting in all of Telegraph Canyon
Road adjacent to the development, would be reimbursed for
the portions that are supplemental to those he is required
to do. This should be completed in August.
c. Response to concern Mr. Roberts presented the Council with a written Summary
about development of Preliminary Information - Telegraph Canyon Road Cost
adjacent to Distribution Study, which included a diagram of the study
Telegraph Canyon Road area boundary. (Copy is on file in the City Clerk's Office.)
He briefly explained the report and said if the City
proceeds with the assessment district, the roadway can
be installed as development proceeds and there should be
no problem as long as it moves from west to east; however,
it is important to widen Telegraph Canyon Road.
Motion to amend It was moved by Councilman Hobel, and seconded by Council-
Resolution No. 8505 man Cox that the Council instruct staff to bring back an
to delete Telegraph amendment to Reselution No. 8505, referring to subparagraph
Canyon Road improvements 5 (page 2), to remove the Telegraph Canyon Road area from
the moratorium - pulling this aside as a reimbursement
district and allow applications for tentative maps to be
processed through normal procedures so development can
take place along Telegraph Canyon Road in that area.
Council discussion Council discussion followed regarding (1) the development
of everything south of "J" Street as it relates to theloverall
development plan which is in the process of being revised; (2)
ho~ this would complicate the assessment district process
for "H" Street~aompound~ng prpbl~s, (3) th~ C~uncil
is not far from a full consideration of the modification
of the General Development Plan.
Motion failed The motion failed by the following vote, to-wit:

7:00 p.m. session of the Council Conference to be held
