OF THE CITY OF CHULA VISTA, CALIFORNIA
Held Thursday - 4:00 p.m. November 17, 1977
An adjourned regular meeting of the City Council of the City of Chula Vista, California,
was held on the above date beginning at 4:00 p.m. in the Council Conference Room,
City Hall, 276 Fourth Avenue.
ROLL CALL
Councilmen present: Mayor Hyde, Councilmen Hobel, Cox, Egdahl, Scott (arrived at
4:12 p.m.)
Councilmen absent: None
Staff present: City Manager Cole, Assistant City Manager Asmus, City Attorney
Lindberg, Assistant City Attorney Harron, Director of Public
Works Robens, Director of Planning Peterson
1. EPA HEARING ON METRO- Director of Public Works Robens distributed a memorandum
POLITAN FACILITIES prepared by Senior Civil Engineer Harshman concerning the
PLAN - NOVEMBER 17, 1977 November 17th Environmental Protection Agency (EPA) Hear-
ing on the Metropolitan Facilities Plan, outlining the
hearings, purpose, alternative selected by San Diego,
project description, current status of project, modifica-
tion of regulations and response time. City Manager Cole
stated that Mr. Harshman will be in attendance at the
hearing and will prepare a written report.
Councilman Hobel asked what the proposal of San Diego would
be in relation to Tijuana. Director of Public Works Robens
explained that the government of Tijuana has recently
approved a treatment olan for Tijuana; however, he was not
certain of any proposal for the area as of this time.
Councilman Cox, referring to Alternate Number 4 -
Project Description, asked if there were any site locations
suggested, should this plan be implemented. Director of
Public Works Robens answered that at this point in time
no specific sites have been chosen.
2. "H" STREET EXTENSION Prior to Mr. Robens presentation, City Manager Cole told
the Council that staff is reviewing assessment districts
for possible consideration and other funding, but pri-
marily reimbursement districts. Mr. Cole also advised
that the discussion of hiring a private consultant with
relation to the grading of said area would be presented
prior to adjournment of this meeting.
While referring to a map, which designated several areas
as "A" through "G", Director of Public Works Robens told
the Council how the developers could take part in the
extension of "H" Street using a "disbursement district"
method (i.e. each area would be required to complete a
portion of so many lineal feet). Mr. Robens said that
staff had investigated the possibility of utilizing fed-
eral monies for the completion of "H" Street, however,
this project did not qualify for Block Grants, FAU or FAS.
~]r. Robens explained that two submissions were made to
FAU (Federal Aid Urban); however, it was recognized after
the second submission that the request would have been
placed at the bottom of the list.
I~r. Robens further explained that this area is not a
federal and secondary route, and, therefore, would not
qualify for FAS (Federal Aid Secondary) funding.

The main reason is that it does not have any traffic at
this point and there are not any "connecting links" which
would qualify this area for the required points.
Motion re assessment It was moved by Councilman Hobel and seconded by Council-
districts man Cox that the City no longer consider "assessment
districts" for this area.
Discussion of motion Mayor Hyde noted that he would not be in favor of com-
pletely abandoning the use of assessment districts.
Councilman Hobel said that he would amend the motion to
state "as a viable option at this time."
Carmen Pasquale Mr. Carmen Pasquale advised the Council that it would be
Otay Land Company more costly and time-consuming for his firm to use the
assessment district. Mr. Pasquale stated that the use of
reimbursement districts would be less costly and would
accomplish the overall project much faster than the use
of the assessment districts.
Clarification of Staff is directed to no longer pursue the creation of a
motion broad assessment district for this area, but this does not
preclude the use of assessment districts at a later time.
Motion carried The motion carried unanimously.
Use of "Reimbursement Mr. Robens explained the method of utilizing "reimburse-
Districts" ment districts" (i.e. Area "A" would be required to
complete a specified portion of improvement along "H"
Street). The amount of improvement would be based on the
density. Mr. Robens stated that the development must go
from west to east to protect the existing road districts
on Telegraph Canyon Road. City Manager Cole said develop-
ment from west to east is required to preclude the need
for sewerage pump stations.
Mr. Pasquale told the Council that if the developer could
be guaranteed a specific density, "H" Street could be com-
pleted at one time. Mr. Pasquale stated that he did not
feel either plan would work (i.e. assessment or reimburse-
ment) without the proper density.
In answer to a query from Councilman Scott, Mr. Pasquale
stated that their required density would be 8,300 units
(this would include multi-family, family cluster and
single family dwellings - approximately 3 per acre) - ~ot
including E1 Rancho del Rey, Unit #5.
Director of Planning Peterson commented that the City
discussed a density figure of 5,700 units, but staff is
currently studying the plan to arrive at a mutually agree-
able figure with the developer.
General discussion ensued with regard to the density,
terrain, and economics.
Mr. Hutchison suggested building a four-lane highway
rather than the proposed six-lane highway thereby saving
both the City and the developers funds and possibly making
the completion of "H" Street that much quicker.
Motion for development It was moved by Mayor Hyde and seconded by Councilman
of "H" Street Egdahl that staff be directed to prepare a resolution pro-
viding for the development of "H" Street, which would com-
mence at 1-805 and proceed eastward and that "reimbursement
districts" be established at appropriate intervals to pro-
vide financing of said construction and that no develop-
ment will occur east of 1-805 until decision for develop-
ment of "H" Street has been provided for.

Amendment to motion City Attorney Lindberg suggested that the word "benefitted"
be inserted after the word reimbursement", thereby, read-
ing "and that reimbursement/benefitted districts .... "
Mayor Hyde agreed to add this to the motion; Councilman
Egdahl agreed to the second.

prepared by staff).

Modification of It was moved by Councilman Hobel, seconded by Councilman
Resolution No. 8505 Cox and unanimously carried that staff be directed to
come back to Council on Tuesday, November 29, 1977 with
a recommendation for a modification of Resolution No. 8505
as it relates to the area parallel to Telegraph Canyon
Road and at the junction of Telegraph Canyon Road and
Otay Lakes Road.
Mr. Ray Watt !~r. Watt asked the Council to remove the moratorium on
Developer the 450 acres in order to proceed with the development
of that land. Mayor Hyde told Mr. Watt that the 450 acres
is, at the moment, in the overall plan and is being re-
viewed by staff, and that the City is going to review the
entire undeveloped land (including the 450 acres) before
Council approves any change in the olan.
Engineering Consultant Mr. Robens informed the Council that the City had received
for grading consideration four proposals with regard to the feasibility for the
development plan. Mr. Robens asked the Council to approve
the reduced scope of grading and road alignments to make
sure the effects are known for the grading of the canyon,
and to insure the utilities would work. The costs
incurred would be approximately $7,000.
Motion for resolution It was moved by Councilman Hobel, seconded by Councilman
Egdahl and unanimously carried that an agreement be
brought back to Council on November 22, 1977.

ADJOURNMENT Mayor Hyde adjourned the meeting at 5:45 p.m. to the
joint meeting with the Planning Commission and ACCORD
at 7:00 p.m., November 17, 1977 in the Children's Section
of the Library.
