RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING CHANGES TO COUNCIL
POLICY NO. 453-02 RELATED TO THE DEVELOPMENT OF
AFFORDABLE FOR SALE HOUSING FOR LOW-INCOME
BUYERS
WHEREAS, the City Council has demonstrated its commitment to creating
homeownership opportunities for low-income buyers be establishing Policy No. 453-02; and
WHEREAS, the Policy has been in effect for two years and staff and developers have
assessed the effectiveness of the Policy in its current format and proposed several modifications;
and
WHEREAS, the following changes have been recommended and approved:
I. A preference be allowed for those households, who at the time of application, are
residents of the City ofChula Vista; and
2. The preference for households with at least one member who is employed within
the City of Chula Vista be modified to remove the one year employment
requirement and require only that the individual be employed within the City at
the time of application; and
3. The Purpose section, as written within the Policy, should be modified to clearly
state that there is a requirement that buyers meet the definition of a first-time
homebuyer, which shall be defined as any individual who has not owned, or had
ownership interest, in any property during the last three years; and
4. Language within the Development Guidelines section shall be modified to more
effectively explain the steps required to determine the City's second trust deed
amount and the equity share amount; and
5. Language under Program Requirements 4 shall be removed and staff shall be
authorized to consider other factors in the selection of tenants with equal points,
including household size and special needs or disabilities, which will negate this
need for a special marketing period to larger household sizes; and
6. Language under Program Requirements 5 shall be modified to reflect that
participating homebuyers must be pre-qualified by the designated lender, as
chosen by the developer although, the homebuyer may ultimately obtain hislher
first mortgage from any licensed mortgage broker or lender of hislher choosing.
The homebuyer shall notify City staff in writing if a different lender is being
proposed. Notification must occur at least 30 days before the expected escrow
closing, as determined by the developer; and

WHEREAS, in accordance with the requirements of the California Environmental
Quality Act (CEQA) the Environmental Review Coordinator reviewed the proposed project for
compliance with CEQA and determined that the activity is not subject to CEQA at this time.
NOW THEREFORE BE IT RESOLVED that the City Council does hereby authorize the
proposed modifications to City Council Policy No. 453-02 related to the development of
affordable for sale housing for low-income buyers.
