HomeMy WebLinkAboutRDA Reso 1987-0789 RESOLUTION NO. 789 RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROVING AN AGREEMENT WITH CALTRANS FOR CONSTRUCTION OF NEW ON-OFF RAMP FACILITIES AT 1-5 AND E STREET WITHIN THE BAYFRONT REDEVELOPMENT PROJECT AREA 'e Redevelopment Agency of the City of Chula Vista does hereby resolve as ,ollows: , WHEREAS, the Redevelopment Agency of the City of Chula Vista has developed the Specific Plan for the Bayfront Redevelopment Project; WHEREAS, the Specific Plan for the Bayfront Redevelopment Project lls for the reconfiguration of the on and off ramp facilities north of "E" Street the west side of 1-5; and WHEREAS, the California State Department of Transportation EalTrans) has agreed to construct said on-off ramp facilities subject to the ~ncy agreeing to certain conditions; and WHEREAS, an agreement containing said conditions has been prepared .d submitted by CalTrans and reviewed by Agency and City staff and is attached 'reto as Exhibit A. '& NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of e City of Chula Vista that the agreement with CalTrans for the construction of new on-off ramp facil ity at I -5 and "E" Street withi n the Bayfront Redevelopment ,oject Area, attached hereto and incorporated herein as though fully set forth, is ereby approved. BE IT FURTHER RESOLVED that the Chairman is hereby authorized to e,cute said agreement on behalf of the Agency. RECITALS 1. STATE contemplates the construction of freeway facilities on Interstate Route 5 from 0.3 mile south to 1.0 mile north of "E" istreet in Chula vista and on State Route 54 from Interstate Route 5 to Interstate Route 805 referred to herein as the PROJECT. 2. AGENCY has requested that STATE incorporate into the PROJECT . a loop ramp, referred to herein as the RAMP connecting westbound "E" Street to southbound Interstate Route 5 and is willing to ,provide the necessary I additional right SECTION I of way for same. 'STATE AGREES: 1. To modif:! the plans for the PROJECT to include the RAMP as shown on Exhibit "A" attached and made a part of this agreement; and to bear the entire cost thereof. 2. To furnish to AGENCY, at STATE'S expense, map(s) tion (s) of additional right of way determined by required to accommodate construction of the RAMP. and de scrip- STATE to be SECTION II AGENCY AGREES: 1. To acquire in STATE'S name, at no expense to STATE, the aforementioned additional right of way with legal possession rights by June 1, 1987. The acquisition shall be subject to the STATE'S prior examination and approval of the title to be acquired 'l~/--t by AGENCY in STATE'S name. This shall be accomplished by afford- ing STATE the opportunity to examine acquiring documents and escrow instructions prior to delivery of required property to the STATE. 2. At no cost to STATE, to make all arrangements for removal and/or relocation of all utiliti~s, both above and below ground, from said additional right of way. (a) To relocate utility facilities to STATE'S specifications per Caltrans Encroachment Manual and the manual on high and low risk underground facilities within highway rights of way. (b) To comply with the terms and conditions as stated in Caltrans Right of Way Procedural handbook - Volume 5 Utilities. (c) To comply with the terms and conditions of the master con- tracts between the STATE and the utility companies when determin- ., ing liability for relocation costs. 3. Not less than four (4) months prior to STATE'S bid advertis- ing date for the PROJECT to furni sh evidence to STATE, in a form acceptable to STATE, that: (a) Condemnation proceedings have been filed involving any un- acquired parcel(s). (b) AGENCY has secured all necessary court orders for possession of any unacquired parcel(s) with an effective date of June 1, 1987 and will prosecute to complet.ion, as soon thereafter as possible, all court proceedings for the acquisition of any such parcel. (c) Said right of way has been cleared of all utili ties or that arrangements have been made to coordinate such clearance during construction of the PROJECT. 4. In the event that any hazardous waste materials are found on , said additional right of way, AGENCY will bear the entire cost .to remove such materials as such costs are incurred by STATE. 5. To facilitate the application and processing of all necessary CITY/AGENCY approvals and permits, including a Coastal Development Permit. .'{ ,0;' -3- SECTION III :IT IS MUTUALLY AGREED: .~ ',1. That all, obligations of STATE under the terms of this AGREE- c~NT are subJect to the appropriation of resources by the Legisla- :ture and the allocation of resources by the California Transporta- tion commission. That upon completion of all work under this AGREEMENT, owner- 'ship and title to all materials, equipment, and appurtenances installed will automatically be vested in the STATE and no further agreement will be necessary to transfer ownership to the STATE. this AGREEMENT shall terminate upon completion and accep- the PROJECT by STATE and final acquisition of any parcel(s) pursuant to SECTION II, Article 3 (b), or on December 31, 1990 ;hichever is earlier in time.
