CITY COUNCIL OF CHULA VISTA, CALIFORNIA
Held Thursday, November 9, 1978
An adjourned regular meeting of the City Council of the City of Chula Vista, California,
was held on the above date beginning at 4:00 p,m. in the Council Conference Room, City
Hall, 276 Fourth Avenue.
ROLL CALL:
Councilmen present: Mayor Hyde, Councilmen Egdal~ Gillow, Scott
Councilmen absent: Councilman Cox
Staff present: City Manager Cole, Assistant City Manager Asmus, City Attorney Lind-
berg, Director of Public Works Robens, Director of Planning Peterson

IN THE EL RANCliO be imposed on developments in this area plus the fact that
DEL REY SUBDIVISION developers have gone to Council indicating that the require-
ments were not appropriate. When the Specific Plan for E1
Rancho del Rey was adopted, the moratorium in the area
ceased.
Mr. Robens submitted a sheet entitled "Pertinent Sections
of Specific Plan of E1Rancho del Rey" which detailed cer-
tain requirements for development. He referred to the
staff's written analysis (9/5/78) which recommended avoiding
developments which place additional demands for east to
west travel in advance of the construction of East H Street.
Mr. Robens identified the capacity problems on Telegraph
Canyon Road and Otay Lakes Road, north of East H Street.
He noted the four SPAS on the map dividing the E1Rancho del
Rey Specific Plan area.
Recommendation for Rice Canyon, Del Centro, Del Rey and La Pinata: the recom-
Area 1 mendation is that no lands within this area be developed
prior to the involved developers' submittal of a program
for the full construction of East H Street between the
easterly limits of the Rice Canyon SPA and Otay Lakes Road.
Reimbursement District Director Robens commented that once a program is established
for the entire area which could be modified subsequent to
the introductions of specific plans.
Mr. Robens answered that there would be no way of knowing
the total dollar amount and therefore, there would be no
way of informing an individual developer of his assessment.
A "framework" however, can be worked outSdevelopment has to
follow the program.
Director Robens continued his presentation noting the bound-
ary areas of the four SPAS, developments proposed and in
the areas, developments along Otay Lakes Road and the off-
site requirements.
Sewer problems Mr. Robens noted that some of the areas of the North College
District would drain into the Rice Canyon sewer and need to
go in that direction; others that drain into the sewer in
Otay Lakes Road can go north from there. Staff's policy is
that there be no pumping stations - that these stations be
temporary and that the homeowners association pay for the
ongoing costs of the City's maintaining the pump station.

Area 2 Staff's recommendation for Area 2(North College, portion
of Parkside and the property on West side of Otay Lakes
Road, North of "H" Street): 1. Otay Lakes Road and off-
site widening: recommendation by the staff is to continue
with the present policy: a project could not be occupied
until the offsite widening is completed - along the 1200
feet of Otay Lakes Road.
City Manager Cole felt this was an unreasonable require-
ment that there ought to be a way of determining the par-
ticipation-an agreement providing for a future percentage
payment on the cost of the improvements or an outright de-
posit, and that the City would eventually make the improve-
ments when it decides it should be done.
Councilman Scott commented that if the traffic problem is
one of peak hours, then staff could work with the school
district to stagger the hours. Mr. Robens felt this
couldn't be done because the peak hours amount to about
three hours a day. He added that the staff is now pre-
paring the capital improvement program for next year and
they will look at, and do some estimates on, construction
in this area. If the Council deems this is an appropriate
project, they could take action to fund it.
Staff recommendation No. 2 Mr. Robens reported that the North College and a portion
of the Parkside SPA conform to the E1Rancho del Rey
Specific Plan unless Telegraph Canyon Road, Paseo Ranchero
and East "H" Street are constructed.
James Fairman Mr. Fairman said he has been working with the staff and
representing Gersten feels the general approach presented by them today is a
Company good one and they concur. They do have concerns about
Areas 3 and 4'indicating that they "should not be nailed
down~' -- that the policies should be "flushed out" ~ome
more giving the developers more input in what is going on.
In Area 2, they have some question of having this left in
an undevelopable stage until everythin~ occurs -there
should be some variation on that. I Mr. Fairman asked that
they be given a couple of weeks to meet and work with
staff on these problems prior to any Council action.
Carmen Pasquale, Mr. Pasquale agreed with the request to meet with the
Vice President Otay staff. If the City adheres to these areas the developers
Land Company should have some way to implement the developments in
those areas by certain conditions and requirements which
must be met, so that they do not have to wait for Area 1
to be developed before beginning construction in Areas 2
and 3: each should be able to stand on its own.
Jim Ashbaugh Mr. Ashbaugh noted that the area of his development ties
L & L Development in with the land owned by the church. The timing of de-
veloping his apartment site with that of the church, along
with the complications of getting access through the
school property,resolving the problems down to Telegraph
Canyon Road with the amount of improvements that would be
required to accomplish thiS, seems unrealistic to him.
Mr. Robens remarked that the present policy is that no
development occur until a program is completed for East
"}]" Street unless "this East "H" road goes in."
William Leeds Mr. Leeds said he appeared before the Codncil in January
L & L Development requesting that their 3-acre site be excluded from the
Company planning district. He asked again that his parcel be
excluded so that they can begin construction plans.
Mayor Hyde reiterated that the policy was one of no de-
velopment until the East H Street program is established.

Motion to accept staff'$ It was moved by May0rHyde and seconded by Councilman
~ecommendation Egdahl that the recommendations imposed by the staff be
accepted at this time.
Mr. Pasquale said that they do not disagree with the staff's-

recommendations but asked for time't6 meet with them and
discuss these matters.
Council discussion Councilman Scott felt the motion was premature and that
nothing would belost be continuing the matter.
Councilman Egdahl suggested the motion be changed to state '
that the reqommendations "be referred back, with the Coun-
cil*s concurrence, to a staff and developer conference to
be reported back to the Council with any changes."
Wording of motion changed Mayor Hyde modified his motion to change the word "accepted'
to "acceptable" for the 'first two recommendations presented:
the staff: (offsite widening of. Ota7 Lakes Road and the
North College and portion of Parkside SPA to conform to the
E1Rancho del Roy Specific Plan).
Motion carried . The motion, as modified, carried unanimously by those present

16, the Metropolitan Sewer item is on for discussion.
Scheduled for Nov. 16 It was moved by Councilman Scott, seconded by Mayor Hyde.
and unanimously carried by those present that the Metro-
politan Sewer matter be taken off the November 16 agenda
and No. 3 and 4 of the Specific Plan of the E1Randho d~l.
Roy west to east development be scheduled in its place.
ExecutiVe Session Itwas moved by Mayor Hyde, secondedby Councilman Cox and
unanimously carried by those present, that at the request
'of the City Manager, the Council meet'at 6:00 p.m.: next
Tuesday (November 14) tO go into Executive Session for
litigation and personnel negotiations.
ADJOURNMENT Mayor Hyde adjourned'the meeting at 5:40 p.m. to the meeting
scheduled for NovemSer 14, 1978 at 6:00 p.m.
