HomeMy WebLinkAboutReso 1984-11683 RESOLUTI ON NO. 11683 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA EXTENDING THE AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND ANTHONY CIOTTI FOR SERVICES RELATIVE TO THE CITY'S COMMUNITY HOUSING IMPROVEMENT PROGRAM~ (CH I P) The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has heretofore by Resolution No. 11448 approved an agreement with Mr. Anthony Ciotti, a copy of which is attached hereto and incorporated herein as though fully set forth, for services relative to the Community Housing Improvement Program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that said agreement is hereby extended for a period of two (2) months, from July 1, 1984, to August 31, 1984, under the same terms and conditions of the original agreement. .~ / ') /' ' " f / . FULASZ, CMC, CITY CLERK of the City of Chula Vista, California, iEREBY CERTIFY that the above and foregoing is a full, true and correct copy of RESOLUTION NO. 11683 ,and that the same has not been amended or repealed. ~D City Clerk ( seal) 660 ( ( AGREEMENT THIS AGREEMENT is made by and between the City of Chu1a Vista (hereinafter called the "CITY") and Anthony Ciotti (hereinafter called "REHABI LI T A TI ON CONSULTANT"). RECITALS -------- WHEREAS, the City desires to retain Rehabilitation Consultant in connection with the implementation of Community Housing Improvement Program (hereinafter called "CHIP") as financed from the Community Development Block Grant Program of the Federal Government; and, WHEREAS, Rehabilitation Consultant is ready, willing and able to provide such expertise to further the CHIP program, NOW, THEREFORE, BE IT RESOLVED that the parties agree as follows: 1. The above recitals are incorporated herein as if set out in full. 2. The City agrees to retain Rehabilitation Consultant for services connected with the CHIP program as described herein. 3. Rehabilitation Consultant shall perform those administrative services relating to the City's CHIP program, including but not limited to as-required day-to-day consultation with the Housing Rehabilitation Inspector, offi ci a 1 s of the Bu il ding and Hous ing Department and Commun ity Deve 1 opment Department; promoting the CHIP program in designated neighborhoods of the City, meeting and participating in negotiations with property owners and the designated financial institutions including Fund Control institutions; providing counseling services to property owners with regard to the program; recommend and make changes to the CH IP manual as approved by either City Council or City CHIP Loan Committee; determine eligibility of homeowner, lender, contractor, fund control and various City agencies to expedite rehab il itat ion process; present loan package requests to City Loan Committee or Trailer Loan Committee for approval; act as recorder for City Loan Committee and Trailer Loan Committee; perform final inspection for fund release in all rehabilitation work. 4. All services performed by Rehabil itation Consultant shall be conducted in connect ion with and under the supervi s i on of the Director of Community Development. 5. Rehabilitation Consultant shall be paid the sum of $1,766.00 per month, reflecting a 12% cost of living adjustment, due and payable on the first of each month for the services provided pursuant to this agreement commencing July 1, 1983 and terminating June 30, 1984 unless otherwise agreed upon to extend by mutual consent of both the Rehabilitation Consultant and the A!-/ /t11'3 , ~ . . ( ( City Council. Rehabilitation Consultant shall also be reimbursed for necessary out-of-pocket expense such as travel in connection with the duties previously described. Rehabilitation Consultant shall not undertake City expense out-of-town (Chu1a Vista/San Diego area) travel without prior approval of the City Community Development Director. 6. Rehabilitation Consultant shall submit a bi-week1y statement to the Community Development Director detailing the actual number of hours worked and a monthly statement to the Community Development Director detailing the serv ices performed. The Commun ity Deve 1 opment Director sha 11 rev i ew these statements prior to authorizing monthly payment. It is the expectation of the City that the Rehabilitation Consultant will work a minimum of 1600 hours annua 11y. The Commun ity Deve 1 opment Director wi 11 quarter 1y eva 1uate the number of hours worked by the Rehabil itation Consultant and shall report significant deficiencies to the City Council with recommendations regarding termination of contract. 7. Rehabilitation Consultant shall notify Community Development Director in writing of any proposed absence exceeding eight (8) consecutive work ing hours. If unexpected absences due to illness occur, Rehabil itation Consultant shall notify Community Development Director as soon as possible. 8. This Agreement is subject to unilateria1 termination by either the Rehabilitation Consultant or the City Council by 30-day written notice.
