HomeMy WebLinkAboutReso 1984-11694 RESOLUTION NO. 11694 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA V 1ST A AND THE SOUTH COUNTY COUNC IL ON AGING FOR SHARED HOUSING PROGRAM AND AUTHORIZING THE MAYOR TO EXECUTE SAIO AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and SOUTH COUNTY COUNCIL ON AGING, for shared housing program in regard to the expenditure of City funds appropriated, dated the 3rd day of July, 1984, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor for the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. FULASZ, CMC, CITY CLERK of the City of Chula Vista, California, ) HEREBY CERTIFY that the above and foregoing is a full, true and correct copy of RESOLUTION NO.11694 ,and that the same has not been amended or repealed_ ITED (seal) City Clerk :-660 \'.01\"'. \l--~ \ AGREEMENT SETTING OUT TERMS ANO OBLIGATIONS OF SOUTH COUNTY COUNCIL ON AGING IN REGARD TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED THIS AGREEMENT, made and entered into this 3rd day of July, 1984, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter referred to as "City" and SOUTH COUNTY COUNCIL ON AGING, INCORPORATED, a non-profit organization, hereinafter referred to as "Grantee". WIT N E SSE T H WHEREAS, the City is currently involved in a Community Development Block Grant program, a principle goal of which is to benefit low and moderate income persons; and WHEREAS, the Grantee is equipped and willing to provide certain services to the City which will primarily benefit low and moderate income persons and has the necessary expertise in this field for completing the same; and, WHEREAS, the City is desirous of having those certain services, hereinafter enumerated, performed by the Grantee; and, WHEREAS, funding for the Grantee is contingent upon receipt of a Letter of Credit authorizing a drawdown of Block Grant funds from the U. S. Department of Housing and Urban Development (HUD); and WHEREAS, no expenditure may be made out of any appropriation awarded such a Grantee unl ess an agreement has been reached between the parties setting out the terms and obligations for the expenditure of such funds. NOW, THEREFORE, in consideration of the mutual obligations of the parties as herein expressed, the parties hereto agree as follows: 1. The term of this agreement shall be for a period of one (1) year, from July 1, 1984, to June 30, 1985, unless further modified to include other permitted expenditures of funds that are appropriated by the City Council. 2. The administration of the Grantee agrees to expend City-appropriated funds to meet bonified obligations incurred for services and supplies as delineated in Exhibit 1 to this agreement, incorporated herein as though fully set forth, for the period July 1, 1984, through June 30, 1985, for an amount not to exceed TWENTY THOUSAND DOLLARS ($20,000). 3. Payment of those City-appropriated funds shall be made to the Grantee upon request in quarterly installments in advance in roughly equal amounts. Excl udi ng the fi rst quarterly installment, installment requests shall be accompanied by documentation of previous quarter expenditures. ~ ,U / / <7 If, '/' 0, f 5? 4. The Grantee shall maintain all financial records for three years following the year in which they were active. 5. In exchange for those City-appropriated funds, the Grantee agrees to perform services as follows: A. Operate for the term of this agreement a SHARED HOUSING PROGRAM, whereby homeowners with addi t i ona 1 1 i vi ng space in thei r homes are matched with apparently compatible individuals seeking such housing. B. Disseminate information on the program, through media advertisement and other suitable means, to citizens of Chula Vista. C. Provide response within staff capability to all citizens of Chula Vista who seek information and/or seek services regarding shared housing. D. Establish a system for neutral meetings between homeowners and prospective home-sharers enabling both parties to meet one another without any risk taking or loss of privacy. E. Devi se contractual agreements between homeowners and home-seekers to relieve City and Grantee from any liability. F. Provi de Ci ty with a quarterly report to i ncl ude the following statistics relative to persons of Chula Vista served by the Grantee: (1) Annual gross income (2) Household size and configuration (3) Handicapped persons (4) Percent of income expended on rent (before placement) (5) Percent of income expended on rent (after placement) (6) Duration of placement (7) Residency of household (8) Census Tract of household 6. Performance of this agreement may not, by subagreement, be assigned to any other entity without prior written consent of the City. 7. The City Council of the City at its discretion may require the Grantee to provide or allow the City to undertake a complete financial audit of its records. 8. The Di rector of Community Development, or hi s/her desi gnated representative, shall represent the City in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the City. ~'\-\ ~-\\ 9. The President of South County Council on Aging, or his/her designated representative, shall represent the Grantee in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the Grantee. 10. The Grantee shall comply with Executive Order 11246, entitled "Equa 1 Employment Opportunity," as amended by Executive Order 11375 and as supplemented in Department of Labor regulations 41 CFR Part 60. 11. The contract may be terminated or suspended by the City after 60 days notice to the Grantee due to default by the Grantee or the Grantee 's inability to perform, regardless of whether such inability is due to ci rcumstances wi thi n or beyond the grantee I s control. Settl ement of any disputes shall be based on the laws of the State of California. 12. The parti es reserve the ri ght to pursue any remedy provi ded under Ca 1 iforni a 1 aw for remedy in instances where contractors vi 01 ate or breach contract terms. 13. Any program income deri ved from Block Grant funds must be used for the Shared Housing Program. IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed the day and year first herein above set forth.
