RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING THE SUMMARY VACATION
OF A PUBLIC SERVICE EASEMENT IN LOTS 324 AND
325 OF HIDDEN VISTA VILLAGE SUBDIVISION
NO FEE
The City Council of the City of Chula Vista does hereuy
resolve as follows:
WHEREAS, Chapter 4, of Part 3, of Division 9, of the
Government Code authorizes the legislative body of a local agency
to summarily vacate a public service easement when the date of
dedication or acquisition is less than five years, and more than
one year immediately preceding the proposed vacation, and the
easement was not used continuously since that date, and
WHEREAS, the developers of Hidden vista Village
Subdivision granted the City of Chula Vista sewer and access
easements within Lots 324 and 325 of Subdivision Map No. 10051,
and
WHEREAS, subsequent to the recordation of the map, the
land was sold to Financial Scene, Inc., who has proposed to build
condominiums in a different layout than proposed by the original
developers of Hidden Vista Village, and
WHEREAS, the public service easements, as described on
Exhibit "A", were acquired by the City on March 4, 1981, and have
not been used, and
WHEREAS, Financial Scene, Inc., as the new developers of
the project, propose public service casements different from those
presently granted to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that the public service easements of
Hidden Vista Village Subdivision, more particularly described in
said Exhibit "A", be, and the same is hereby vacated.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and she is hereby authorized and directed to
record this resolution in the office of the County Recorder of San
Diego County.

BE IT FURTHER RESOLVED that from and after the date the
resolution is recorded, the public service easement vacated by
this resolution shall no longer constitute a public service
easement.
