HomeMy WebLinkAboutReso 1984-11695 RESOLUTION NO. 11695 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENTS BETWEEN THE CITY OF CHULA VISTA AND EDGAR MONROY L., CONTRACT ASSOCIATE TRAFFIC ENGINEER, AND MARWAN YOUNIS, CONTRACT ENGINEER (LAND DEVELOPMENT) AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that those certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and EDGAR MONROY L., Contract Associate Traffic Engineer, an~5~RWAN YOU~IS~ Contract Engineer (Land Development), dated the C~ttPay of un Ju1 y 1984, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same are hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreements for and on behalf of the City of Chula Vista. HED ( seaJ) City Clerk C-660 PERSONAL SERVICES AGREEMENT THIS AGREEMENT is made at Chula Vista, California, as of June 25, 1984, by and between the CITY OF CHULA VISTA, a municipal corporation ("City" 1 and EDGAR MONROY L. ("Contractor" l, who agree as follows: 1. Subject to the terms and conditions set forth in this Agreement, Contractor shall provide to the City the services described in Exhibit A, which is, by this reference, incorporated herein. Contractor shall provide said services at the time, place, and in the manner specified in Exhibit A. 2. Payment. City shall pay contractor at the rate of $22.00 per hour for services rendered pursuant to this Agreement. Said amount shall be the total compensation paid for work performed under this Agreement. Contractor shall provide City with worked pursuant to this Agreement. paid bi-weekly. 3. Exemption from Civil Service. It is expressly agreed and understood by City and Contractor that this Agreement and the rendition of services hereunder is specifically exempted from Civil Service of the City of Chula Vista. The parties to this Agreement agree that Contractor is a professional person, in business for himself, and that the relation created by this contract is that of employer-independent contractor. Contractor is not an agent or employee of the City and is not entitled to the benefits provided by the City to its employees, including but not limted to health insurance and unemployment insurance. a weekly statement of the total hours Compensation for said hours shall be 4. Harron, Clty Attorn~ Oated: June 25, 1984 WPC 1094E f(I({V<, EXHIBIT "A" SCOPE OF WORK It is intended that the contractor provide professional services to the City to facilitate the expeditious processing of new and ongoing transportation programs. traffi c engi neeri ng implementation and Contractor shall: 1. Work approximately 40 hours per week and generally be available for work during normal working hours, Monday through Friday each week, hol idays excepted, at the City of Chula Vista Engineering Department office, or at such other suitable place designated by the City Engineer. 2. Conduct traffic investigations and prepare related studies, surveys and reports. 3. Prepare and develop functional plans and specifications for traffic signals and signal systems, street lighting and traffic control deveices. 4. Analyze traffic flow data including speed and volume analysis, signing and channelization studies and signal coordination. 5. Provide technical assistance in the City's transportation planning program. Subject to the terms and conditions set forth in this Agreement, Contractor shall provide to the City the services described in Exhibit A, which is, by this reference, incorporated herein. Contractor shall provide said services at the time, place, and in the manner specified in Exhibit A. 2. Payment. Harron, Clty Attornef Dated: &_ 2~ -84 WPC 1050E ;(2-//6 ys- EXHIBIT "A" SCOPE OF WORK It is intended that the Contractor apply his full time to the expeditious impl ementati on and processi ng of pl ans, cal cul ati ons, improvements for subdivisions, and other professional and technical duties. Contractor shall: 1. Be available for work from 8:00 a.m. through 5:00 p.m., Monday through Friday each week, holidays excepted, at the City of Chula Vista Engineering Department Office, or at such other suitable place designated by the City Engineer. 2. Revi ew maps and plans for subdi vi si ons and subdi vi si on improvements submitted to the City of Chula Vista, to insure compliance with City specifications, policies and procedures, and special conditions applied at the tentative map and planned development stages. 3. Revi ew maps and plans and ca 1 cul ati ons for subdi vi si ons and subdi vi si on improvements in order to eval uate thei r adequacy and accuracy and the application of sound engineering judgment.
