RESOLUTION NOo 4952
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
ACCEPTING GRANT OF EASEMENT FROM ESTHER AND LEWIS A. CRANK
FOR TEMPORARY STREET PURPOSES
The City Council of the City of Chula Vista does hereby
zesolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain grant of
easement for temporary street purposes for Tidelands Avenue
executed by Esther and Lewis A. Crank
dated the 18th day of October , 19 68, a copy of which is
attached hereto and by this reference made a part hereof, the same as
`though fully set forth herein be, and the same is hereby accepted by
the City of Chula Vista for temporary street purposes

FOR. A VALrJABLE COTiSIDERATION, recei-pt of which is herel-~y acknew-
edged, the undersigned do herehv grant to tY.e City of Chula Vista, in the
ounty of San Diego, State of. California, an easement and right-of-wa_y for,
nd the right to construct, maintain, overate, replace or remove a street
n, upon, over and across that certain real property situated in the County
~f San Diego, State of California, more particularly described as follows:.
• A strip of land, 50 feet in width, lying within the Southerly
[alf. of Quarter Section 172 of Rancho de la Nacion according to recorded
9zr, t.hereoE No. 1G6 on file in '.he O.`.fi~e o` the County Pecorder, County
~f San Diego, State of California, the centerline of said strip being de-
scribed as follo~s~s:
Fseginninq at the center of said Quarter Section 172, thence zVest-
:r1y, along the Northerly line of said Southerly Half of. Quarter_ Section
172, being the centerline of "F" Street a distance of 50 feet; thence
southerly, at right angles to said Northerly line a distance of 40 feet
Fro the Southerly line of "F"' Street and the TF.UE POINT OF I<EGINNING; thence

the beginning of a tanaen.t 560 foot radius curve to the right; thence

radius curve to the right; thence Southerly, along the arc of said curve,

Southerly, tangent to said curve, 209.89 feet to the Southerly line of
said Quarter Section 172 and. the centerline of "G" Street;
Excepting therefrom that portion 1_ying Southerly of a line that

said easement and right-of-wac and. to deposit tools, implements and. otY;er
materials thereon by said City of Chula Vista, its oFficers, agents and
employees and by anv contractor, his agents a.nd employees engaged by said
City, whenever and wherever necessary for. the purposes above set forth.
It is f.u11y understood and agreed by the parties hereto that Grantee sY~all.
..indemnify and hold Grantor harmless against all claims for damage or suits
for loss, including costs and attorney's fees, arising from in~urv to any
persons or property or life, caused by or resulting from acts or omissions
by Grantee, its successors or assigns, arising from the construct-on,
.operation or maintenance of the aforementioned street. or in usi.nq, oneratinn
or traveling over the land within the hereirabove described Grant of Easement
It is further understood and agreed by the parties hereto that the aforemen-
aioned Ternpor.ary Easerae.nt for street purposes shall be in fu') force and
effect for a period of ten (10) years from the date of accepta.lce of saic?
