TEMPORARY CONNECTJON AND SEWAGE TRANSPORATJON AGREEMENT
This Agreement is made by the City of San Diego, a municipal corporation,
herein called "San Diego" and the Montgomery Sanitation District, a .County
Sanitation District, herein called "Montgomery~' and the City of Chula Vista,
a municipal corporation, herein called nChula Vista".
RECJTALS
A. Whereas, San Diego formed the San Diego Metropolitan Sewerage System (herein
called "Metropolitan"), which commenced operation in 1963, and which provides
transmission, treatment and disposal of sewage to several cities and sanitation
districts located within the County of San Diego, including the Montgomery San-
itation District and the City of Chula Vista; and
B. Whereas, Montgomery and Chula Vista have constructed the Date-Faivre Trunk
sewer to transport sewage from Montgomery and Chula Vista to Metropolitan; and
C. Whereas, a portion of the incorporated territory within the boundaries of San
Diego is so situated that sewage therefrom can flow by gravity through the Date-
Faivre Trunk system to Metropolitan, and
P. Whereas, the parties desire to set forth and agree upon terms and conditions
of an interim connection to the Date-Faivre Trunk sewer located in Montgomery
to serve land within San Diego, and
E. Whereas, the parties hereto are in agreement that all sewage originating in
San Diego which is ultimately discharged to Metropolitan through Date-Faivre
sewer system shall be charged against San Diego's capacity rights in Metropolitan
and shall be deducted from Montgomery's and Chula Vista's metered sewage flow;
and
Now, therefore in consideration of the recitals and the mutual obligations of the
parties as herein expressed San Diego, Montgomery and Chula Vista agree as follows:
1. STANDARD FOR CONNECTION
All connections to the Date-Faivre Trunk system shall be made in such manner as
Montgomery's and Chula Vista's engineer may specify.
",
2. LIMITATJONS ON TYPE AND CONDITION OF SEWAGE
A. San Diego shall not discharge into the Date-Faivre Trunk any sewage or waste
which does not meet the standards established by Montgomery and Chula vista under
appropriate ordinances, rules and regulations governing the discharge of sewage
and wastes into Chula Vista and Montgomery's sewer system, and San Diego shall also
comply with the applicable statutes, rules and regulations of agencies of the United
States of America, the State of California, and the County of San Diego having jur-
isdiction over the collection, transmission, treatment and disposal of sewage and
wastes.
"
B. San Diego shall not allow excessive infiltration or any surface or storm waters
to be discharged into its sanitary sewer system nor shall San Dieqo allow cooling
water or other unpolluted industrial waste to be discharged into such sewer without
the written consent of District and City of Chula Vista thereto.
3. COMPENSATION
San Diego shall pay Montgomery and Chula vista for capacity rental and operation
and maintenance cost for the area defined in Exhibit "A" at the same rates and
calculated in the same manner as agreed upon for the Otay International Center
project.
4. UNMRTERED SEWAGE
Where transported sewage is unmetered, the volume transported per month is established
as 265 (g/d/EDU) gallons times the number of single family dwelling units, times the
number of days in the month, or the equivalent thereto in sewage effluent, connected
to Date-Faivre Trunk system. San Diego shall keep current records of the number
and type of structures whose sewage flow into Montgomery's and Chula's sewer system
for use in computing unmetered volume, and shall mail such records to the Montgomery
Sanitation District quarterly for billing purposes.
5. USE AND CAPACITY
Sewage flow from the herein described property shall be deducted from Montgomery's
and Chula Vista's meter readings prior to reporting monthly flows. Said flow shall
be considered San Diego's Metropolitan capacity useage and not Montgomery's or Chula
Vista's capacity. The total number of EDU's allowed by this agreement shall not exceed
212 EDUs.
6. LIMIT ON APPLICATION OF AGREEMENT
The terms and conditions provided for herein shall not apply to the transportation
of sewage through lines which are jointly owned or operated or for which the capacity
rights are shared by San Diego, Montgomery and Chula Vista.
This agreement is not intended to, nor shall it in any way, supersede or modify the
terms and conditions of the Sewage Disposal Agreement of 1960 by and between the par-
ties hereto.
7. AREA TO BE COVERED
This agreement is for the specific purpose of providing a temporary sewage connection
to the Date-Faivre Trunk system from property located in San Diego more particularly
described in the attached Exhibit "Au.
8. MAINTENANCE AND OWNERSHIP
The maintenance and ownership of the off-site sewer line connecting said property,
as shown in Exhibit "All, to the Date-Faivre Trunk system shall be the sole responsi-
bility of San Diego. Additionally, any easements granted for the co~struction, oper-
ation and maintenance of said off-site sewer line shall be granted and vested in the
City.
9. DURATION OF AGREEMENT
This agreement shall be effective and in force until San Diego constructs the
pennanent "parallel" sewer line paralleling the existing line, and San Diego
causes said off-site sewer line to be connected to said "parallel" sewer line.
10. INDEMNITY
To the extent it may legally do so, San Diego shall defend and save and hold free
and harmless Montgomery and Chula Vista and their agents, officers and employees
from any claims, liabilities, penalties or fines arising from or out of any defects
in the installation, construction, operation, maintenance, repair, replacement andl
or reconstruction of said sewer connections and/or appurtenances.
In Witness Whereof, The Montgomery Sanitation District, has caused this instrument
to be adopted by the Board of Directors of said District; Qnd this instrument is

Negative Declaration
236,5775 EQD No. 83-0544
SUBJECT: Palm Pacifica. TENTATIVE MAP (83-0544) and REZONING (83-0544) to
develop a subdivision of 212 single-family, detached houses on
39.4 acres of land, zoned A-l-l (proposed R-1-5). Located on the
northeast corner of the intersection of Palm Avenue with Beyer
Boulevard in the Otay Nestor community (Portion of the Si of SEA
of Section 22, T18S, R2W). Applicant: Stafford Gardner
Development III.
I. PROJECT DESCRIPTION: See attached Initial Study.
II. ENVIRONMENTAL SETTING: See attached Initial Study.
II 1. FINDING:
The City of San Diego conducted an Initial Study which determined
that the proposed project could have a significant environmental
effect. Subsequent revisions in the project proposal create the
specific mitigation identified in Section V of this Negative
Declaration. The project as revised now avoids or mitigates the
potentially significant environmental effects previously identified,
and the preparation of an Environmental Impact Report will not be
required.
Potentially significant impacts from traffic noise, generated along
Beyer Boulevard and Palm Avenue, would be mitigated through
construction of a six-foot-high masonry wall on the project boundary
along both of these streets. Granting of building permits will be
conditioned upon carrying out this mitigation measure.
Potential effects to riparian vegetation in the Otay River due to
construction of a sewer line would be mitigated by constructing the
line on the existing Beyer Boulevard Bridge or, if constructed in
the river, would require the implementation of a revegetation plan
to mitigate the potential loss of wetlands vegetation. .
IV. DOCUMENTATION:
The attached Initial Study documents the reasons to support the
above Finding.
.-;; ---- ~.,
:g
Page 2
V. MITIGATING MEASURES:
Noise Impacts: The Tentative Map shall include the following
condition: "Prior to the approval of the Final Map by the City
Council, the developer shall enter into an agreement that no
building permits will be applied for until the developer constructs
a six-foot-high masonry wall adjacent to the Beyer Boulevard and
Palm Avenue rights-of-way as shown on the Tentative Map."
Services: The Tentative Map shall include the following condition:
"Any trenching or other construction which occurs in the Otay River
Valley to accommodate the proposed sewer shall be subject to
implementation of a revegetation plan approved by the Deputy
Director of the Environmental Quality Division.
VI. PUBLIC REVIEW DISTRIBUTION:

INITIAL STUDY
EQD No. 83-D544
SU8JECT: Palm Pacifica. TENTATIVE MAP (83-0544) and REZONING (83-0544) to
develop a subdivision of 212 sin~le-family, detached houses on
39.4 acres of land, zoned A-l-l (proposed R-I-5). Located on the
northeast corner of the .intersection of Palm Avenue with Beyer
Boulevard in the Otay Nestor community (Portion of the Si of SEl
of Section 22, T18S, R2W). Council District No.8. Applicant:
Stafford Gardner Development III.
I. PURPOSE AND MAIN FEATURES:
The project consists of a subdivision of 212 one- and two-story,
single-family residences. Construction would occur in two phases
with all site grading being carried out with the first phase.
Grading would require approximately 140,000 cubic yards of balanced
cut and fill, a major portion of which would consist of excavation
followed by refill and compaction. Storm waters would be directed,
via a 30-inch line, to the northwest corner of the property and a
desi1ting basin, before flowing off-site to the Otay River. Proposed
off-site development would include: I) widening of both Beyer
Boulevard and Palm Avenue adjacent to the project; and 2)
construction of an eight-inch sewer line northerly along Beyer
Boulevard approximately 2,400 feet to a trunk line on the north side
of the Otay River.
The current zoning is A-I-l which permits agricultural activities and
. residences at a maximum density of one unit per acre. A rezoning to
R-l-S is proposed. This zoning would permit single-family residences
at a density of up to nine units per acre.
II. ENVIRONMENTAL SETTING:
The project site is a square-shaped property located at the northeast
corner of the intersection of Beyer Boulevard and Palm Avenue in the
Otay Nestor community. The community plan designates this property
for low density residential use. The property is currently being
used as a vegetable farm. The topography slopes very gently to the
northwest where a north-trending drainage swale is located.
Sheetflow drainage trends towards this swale. A small man-made pond
is located in the center of the site. In the northwest corner,
between Beyer Boulevard and the swale, large amounts of concrete and
asphalt rubble have been dumped. Some ruderal native vegetatiory
exists in this area and within the swale.
8
Page 2
Several single-story frame buildings exist on site. along Palm Avenue
and Beyer Boulevard. A geo-technica1 study prepared for this site
indicates the presence of buried fuel tanks near the structures on
Palm Avenue.
The property. together with properties to the east and west. form the
northern edge of a low mesa which then drops northerly into the Otay
River Valley and the City boundary with the County. The river is
approximately one-third of a mile from the site. The land in between
is vacant. consisting of eroded hillocks. Rudera1 forbs and grasses
at the project site gradually merge with the riparian ecotone of the
river valley.
Easterly. Montgomery High School is sited on ground rising above the
project site. The project's southern boundary is Palm Avenue.
Across Palm Avenue. Montgomery-Waller Memorial Park contains athletic
fields. turf and picnic areas on 60 acres. Westerly. across Beyer
Boulevard. land is vacant and disturbed by off-road vehicles.
III. ENVIRONMENTAL ANALYSIS: See attached Initial Study checklist.
IV. OISCUSSION:
Soils
The project is located in Geologic Hazards Categories 51 and 52 and
Risk Zones A and AC. respectively. as defined by The City of San
Oiego Seismic Safety Study. Hazards Category 51 refers to relatively
level mesas. Risk Zone A in this category refers to nominal risk
potential. Hazards Category 52 refers to a variety of terrain that
is generally considered stable. Risk Zone AC in this category refers
to nominal to moderate risk potential.
A preliminary geo-technical study. conducted by Southern California
Soil and Testing. Inc. indicates that some minor problems (expansive
soils. dumpage) can be corrected by excavating. refilling, and com-
pacting certain areas of the site. If the report's 21 recommenda-
tions are carried out. there are "no geo-technica1 conditions
which would preclude the development of the site...." according to
the study.
.Traffic
Beyer Boulevard is designated as a major street in the community
plan. While current traffic amounts to only B.400 trips per day.
City projections place the number of trips at 18,000 per day by 1995.
Major expansion of Beyer Boulevard is being planned from State
Highway 117, northerly to the City limits in the Otay River Varley.
These plans call for widening the existing two-lane street to a full
y
Page 3
four lanes with center median and Class II bicycle facilities
adjacent to the project (Environmental Assessment/Beyer Boulevard
Project). This work is tentatively set for FY 1987. The project
will be required to construct street facilities on its side of Beyer
Boulevard in accordance with this plan. Widening of Palm Avenue
(designated a major street) along the frontage of the project will
also be required. Palm Avenue currently has an average daily traffic
load of 17,300 trips. This would increase to 20,000 trips by 1995.
The project itself would generate average daily traffic of some 2,110
trips.
Noise
Current and projected traffic on Beyer Boulevard and Palm Avenue
would create noise levels which would affect the residents of project
units which front along' those streets. An acoustical analysis has
not been conducted for this project. However, calculations of noise
levels along Beyer Boulevard, conducted for the proposed road
widening, indicate that the existing maximum hourly Leq dB(A) level
at the right-of-way adjacent to the site is 70 dB. Calculated
maximum hourly noise levels for projected traffic in 1995 would be 77
dB(A). Based on similar traffic loads, it can be assumed that
maximum hourly noise levels from Palm Avenue would approximate the
levels from Beyer Boulevard. The City's General Plan states that
noise levels exceeding 65 dB Community Noise Equivalent Level (CNEL)
are incompatible with residential land use. Since CNEL noise
standards are based on a 24-hour average level, weighted for evening
and night hours, the above calculations for maximum h~Ur~y noise
cannot be used directly to evaluate compatibility wit t e General
Plan standard. However, due to the current and projected traffic it
is apparent that noise along both roads is of significant concern.
The project proposal includes a six-foot-high masonry wall at the
property line adjacent to both Beyer Boulevard and Palm Avenue. Such
a wall is a standard and effective mitigation measure to protect
single-story residences from roadway noise. The wall proposed for
this project is judged to be necessary and sufficient to mitigate the
potential traffic noise impacts. Construction of the wall will be
required as a condition of obtaining City building permits for all
units along both streets.

Services
The project proposes to construct an eight-inch sewer line northerly
along Beyer Boulevard to a trunk line across the Otay River. The
distance is some 2,400 feet, of which some 1,300 feet is the river
floodplain. In order to cross the river, it is proposed that the
sewer would run along the elevated embankment and. existing timber
trestle bridge. This bridge is scheduled to be replaced with an
improved concrete and steel structure as part of the widening of
Beyer Boulevard proposed by the City in conjunction with CalTrans and
USFHA, tentatively scheduled for FY 1987.
A potential concern is raised with regard to the timing of
construction of the sewer and the new bridge and demolition of the
old bridge. It is important that the sewer service not be
interrupted once established. If approved, construction of the
subdivision and sewer would likely occur prior to the 19B7
construction of the new bridge. A question is how sewer service will
be maintained during bridge construction.
Three alternative bridge locations are identified in the Beyer
Boulevard Project Environmental Assessment (EA). The preferred
alternative would require construction of a bypass roadway atop
corrugated metal pipe arches and demolition of the old bridge prior
to construction of the new bridgp.. Under such circumstances the EA
states that a 5- to 10-year flood could be accommodated, but that
major floods could wash out the bypass roadway. Should damage occur
to a temporary sewer line mounted on the bypass, significant health
and environmental effects might result from raw sewage entering the
river. The other two alternatives call for completion of the new
bridge prior to removal of the present bridge. Under either
alternative the sewage flow could be diverted from a line mounted on
the old bridge to one mounted on the new bridge.
Another alternative for the sewer would eliminate the bridge
altogether and have the line simply pass under the river. Such
construction could have adverse impacts to riparian habit within the
river. Should this alternative be chosen, it will be necessary to
implement a revegetation plan approved by the Deputy Director,
Environmental Quality Division. In addition, the California
Department of Fish and Game would require consultation pursuant to
Fish and Game Code Section 1603, alteration of streambeds. Any work
which adversely impacted stream vegetation would require mitigation
through replacement in kind.
At this time it is not known which alternative will be implemented.
The bridge design is still conceptual. Consequently, the integra-
tion of the sewer with the bridge has not yet been formally
considered.

V. RECOMMENDATION:
On the basis of this initial evaluation:
The proposed project would not have a significant effect on the
environment, and a NEGATIVE DECLARATION should be prepared.
X Although the proposed project could have a significant effect on the
environment, there will not be a significant effect in this case
because the mitigation measures described in Section IV above have
been added to the project. A MITIGATED NEGATIVE DECLARATION should
be prepared.
The proposed project MAY have a significant effect on the
environment, and an ENVIRONMENTAL IMPACT REPORT should be required.

City Participation Agreement for the Construction of Drainage Facilities
at Palm Avenue and Beyer Boulevard
CITY 0'" SAN DIEGO
....CKGROUND= (DOU8LE BrACEI
The property at the northeast corner of Palm Avenue and Beyer Boulevard is being
subdivided by PAU1 PACIFICA SUBDIVISION. The subdivider is required to construct a storm-
drain system that carries offsite drainage from the intersection through his development
and to widen both streets to provide full-width improvements. r~st of the runoff water
involved comes from Luckie Waller Park, a City-owned park site on the south side of
Palm Avenue. It is proposed that the City finance the cost of the offsite drainage
facilities required to convey the runoff up to the Palm Pacifica site in accordance with
established standards and that the developer pay all costs associated with conveying the
runoff water through the development. The City-financed improvements include replacing
an existing cross gutter with a curb inlet at the intersection of Beyer Boulevard and
Palm Avenue, construction of a storm drain across Palm Avenue, plus replacement of an
existing undersized culvert under Beyer Boulevard. The total cost for the City-financed
improvements is $23,300.
The City participation is in accordance with the "Cooperative Drainage Projects
Section" of Council Policy 800-4.
FISCAL IMPACT: The $23,300 for City participation is available from Capital Outlay
Fund 30245, Annual Al,1,ocation Ilew Developments CIP 58-001.
