HomeMy WebLinkAboutReso 1984-11580 RESOLUTION NO. 11580 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR APPEL SUBDIVISION, CHULA VISTA TRACT 84-3 The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declaration, IS-83-26 , and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accor- dance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Appel Subdivision, Chula Vista Tract 84-3 and has recom- mended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-84-3 adopted on the 14th day of March , 1984 , a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. Project Setting The project site consists of 1.5 acres of relatively flat vacant property with approximately 251 feet of frontage on both Casselman Street and "0" Street. Adjacent land uses consist of multiple family units on the east and west sides of the project, multiple family units across "0" Street to the south and multiple and single family units across Casselman Street to the north. There are no endangered plant or animal species located on or near the project site and no geologic hazards are known to exist in the project vicinity. B. Project Description The proposed project consists of the construction of 45 residential condominiums with a total of 75 on-site parking spaces. C. Compatibility with Zoning and Plans The proposed project will result in a net density of 29.74 units per acre which is consistent with current R-3 zoning and "high density residential" land use designation of the General Plan. D. Identification of Environmental Effects/Mitigation The following environmental effect can be mitigated to a level of insignificance through standard development requirements: Schools - The present enrollment levels at Feaster Elementary School and Chula Vista Junior High School serving the project area, are above capacity. Implementation of the proposed project may result in the need for additional classroom space. Findings of Insignificant Impact 1. The site is void of any significant natural or manmade resources and there are no geological hazards on or near the project site. Standard development requirements will reduce impacts to a level of insignificance. 2. The res i dent i a 1 proposal is cons i stent wi th the General Plan and associated elements and is not anticipated to achieve short term to the disadvantage of long term environmental goals. 3. No impacts are anticipated to occur which could interact to create a substantial cumulative effect on the environment. 4. PCS-84-3 RESOLUTION OF CITY OF THE CHULA VISTA PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL APPROVE THE TENTATIVE SUBDIVISION MAP FOR APPEL SUBDIVISION, CHULA VISTA TRACT 84-3 WHEREAS, a duly verified application for a tentative subdivision map was filed with the Planning Department of the City of Chula Vista on January 16, 1984, by Appel Development Corporation, and WHEREAS, sai d appli cati on requested approval of a tentati ve subdivision map known as Appel Subdivision, Chula Vista Tract 84-3, in order to develop a one lot condominium project consisting of 44 units on a 1.51 acre parcel located between the 500 block of Casselman and "D" Streets, 200 feet east of-Broadway in the R-3 zone, and WHEREAS, the Planning Commission set the time and place for a hearing on said tentative subdivision map appl ication and notice of said hearing, together with its purpose, was gi ven by 'i ts publ i cati on in a newspaper of general circulation in the city and its mailing to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hea ri ng, and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., March 14, 1984, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Commission found that the project would have no significant environmental impacts and adopted the Negative Declaration issued on IS-83-26. NOW, THEREFORE,BE IT RESOLVED THAT THE PLANNING COMMISSION finds as foll ows: 1. The site is physically suitable for the residential development and the proposal conforms to all standards establ i shed by the City for such projects. 2. The design of the subdivision will not affect the existing improvements -- streets, sewers, etc. -- which have been designed to avoid any serious problems. 3. The project is in substantial conformance with the Chula Vista General Plan Elements as follows: a. Land Use - The proposed development is in keeping with the 1 and use designation of high density residential at 13 to 26 DU's/acre. /?-//,5St? b. Circulation - The project will be served by existing streets and no streets are required across the site. c. Housing - The project will provide additional housing and home ownershi p opportuni ty for the resi dents of the community. d. Conservation - The site is located within the urbanized area of the City and there are no si gnificant animal or plant species on the property. e. Park and Recreation, Open Space - The developer is required to pay a fee in lieu of dedicating and improving parks. f. Seismic Safety - The property is not near any known earthquake faults. g. Safety - Thp. site is well within the response time of the fire station located on "F" Street. h. Noise - The units meet the requirements of the U:B.C. i . Sceni c Hi ghway scenic route. The site is not adjacent to a designated j. 'Bicycle Routes - The adjacent streets are not designated bike routes but will accommodate bike traffic. k. Public 'Buildings - No public buildings are proposed on the subject property. BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSIOfJ recommends that City Council approve the tentative subdivision map for APPEL SUBDIVISION, Chula Vista Tract 84-3 subject to the following condition. 1. The developer shall obtain a construction permit prior to approval of the fi nal map for foll owi ng work whi ch shall be completed within one year from the date the permit issued: a) Removal of the existing driveway on Casselman Street and replacement with curb and gutter. b) Removal and replacement of broken sidewalk along Casselman Street. c) Constructi on of dri veway approaches on "0" Street and Casselman Street. -2- /l-II~,p d) Construction of one type "A" outlets per Regional Standard Drawing D-25 on Casselman and a pair of 4" PVC under sidewalk drains per Regional Standard Drawing D-27 on "D" Street. e) Installation of two lOa-watt HPS street lights; one on Casselman Street and one on "D" Street. That a copy of this resolution be transmitted to the owners of the property and the City Council.
