HomeMy WebLinkAboutReso 1984-11574 Revised 3/29/84 RESOLUTION NO. 11574 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ESTABLISHING THE HIDDEN VISTA VILLAGE SEWER REIMBURSEMENT DISTRICT - RICE CANYON TRUNK The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the developers of Hidden Vista Village (Terra Nova) have requested that the City establish a reimbursement district to repay them for a portion of offsite facilities and all of the oversized sewer mains they constructed in the development of their subdivision, and WHEREAS, a report has been prepared setting forth the reimbursement cost data and the breakdown of those properties that will be assessed, which is attached hereto and marked Exhibit "A", and WHEREAS, the Chula Vista Municipal Code requires a public hearing to consider the establishment of a sewer reimburse- ment district and the City Council, by Resolution No. 11562, adopted on March 13, 1984, set April 3, 1984 as the date to hold a public hearing to consider comments relative to the establishment of the Hidden Vista Village Reimbursement District - Rice Canyon Trunk, and WHEREAS, having heard all testimony relative to said sewer reimbursement district, the City Council has determined it is in the best interests to establish the district. PURPOSE The purpose of this report is to present a methodology by which Financial Scenes, developers of Hidden Vista Village (Terra Nova), and the City can be reimbursed for offsite and oversizing of the Rice Canyon Trunk Sewer. II. Background City Council by Resolution Number 10081-A approved the Tentative Map for Hidden Vista Village, Chula Vista Tract 80-15. As a condition of approval, the developer (Financial Scene Inc.) was required to construct offsite sewer facilities between the western subdivision boundary and the Spring Valley Outfall. They were also required to upsize onsite facilities to accommodate future construction to the east. The Ci ty, through an agreement with the State of Cal ifornia constructed a segment of the Rice Canyon Sewer in conjunction with the 1-805 freeway. On August 11, 1981, Council directed the City Manager to begin proceedings for the formation of the reimbursement district requested by the developer. Said direction was contingent upon receipt of a deposit to cover City costs. That deposit was received on November 23, 1982. A preliminary district was set up early in 1983; however, the processing of the district was postponed with submittal of the Specific Plan proposal by the Gersten Companies. In January 1984 McMillan, managers of the Hidden Vista Village project (now Terra Nova) requested that the reimbursement be processed based upon the presently approved E. R. D. R. Specifi c Pl an. McMi 11 an does not want the reimbursement to be revi sed shoul d the densi ti es be increased by the recently submi tted Gersten proposal. This preliminary reimbursement district is now before Council to receive public testimony. The parties affected by the reimbursement di stri ct have been noti fi ed of thi s heari ng in accordance wi th Code requirements. III. GENERAL DISCUSSION A. Determination of Costs. The costs listed in Exhibit A are broken down into categories of offsite and onsite. Unit costs were obtained from actual contract prices included in a bid by Signs and Pinnick Inc. dated March 30, 1981. Lump-sum costs have been verified by the Engineering Department. Quantities were obtained from approved pl ans for the Hi dden Vi sta Vill age subdi vi si on and verifi ed by the Engi neeri ng Department. /?~ 1/.1"7 r City costs were obtained from charges paid by the City to the State for work relative to the portion of Rice Canyon Trunk sewer constructed with I-80S. B. Determination of Equivalent Dwelling Units (EDU) Weighting factors have been used to relate the reimbursement required to be paid to actual usage of the facilities. The City's Environmental Review procedures were used relative to sewage generation. A single family with 3.38 persons per dwelling unit was used as a basis for an equivalent dwell ing unit. All other types of dwell i ngs are shown to have 1 ess peopl e per dwell i ng unit. Per capita sewage generation is considered the same for all types of dwelling units. Single family attached homes (condos) are considered to house 2.66 people per dwelling and multiple family (apartments) are considered to house 1.94 people per dwelling. The weighting factor for single family attached and multiple family dwelling was calculated from the ratio of people per dwelling divided by the number of people per dwelling for single family detached units. Each was rounded up to the nearest tenth. Consequently. the factors used to cmpute EDU' s for si ngl e family attached (6-10 du/acre) and multiple family (11-18 du/acre) are 1 ess than one. The number of EDU' s to be charged agai nst the commercial areas were estimated based upon the City's Environmental review procedures and factors shown in Exhibit B. See Exhibit B. C. Determination of Reimbursable Amounts Offsite and Onsite of Hidden Vista Village: 1. Offsite Costs All costs associated with the offsite sewer construction have been included in the reimbursable amount. The amount to be reimbursed by properties other than the constructing developer will be the difference between the total cost and the developer's share of the construction cost. Reimbursement to the City is the amount represented by the actual cost of sewer faci 1 i ti es constructed 1 ess moni es pai d into the Rice Canyon Sewer Di strict fund by previ ous developments less the fair share of the units west of I-80S which did not contribute to the Trunk Sewer. See Exhibit C. 2. Onsite Costs The Hidden Vista Village development of itself would require constructi on of 1593 feet of 8-i nch sewer 1 i ne and 1575 feet of 10-inch sewer line along the trunk sewer alignment. Upsizing is provided to accommodate service to upstream developments. Only the upsizing from the required sewer line -2- /?-//J7f size was included in the reimbursable costs. All other onsite costs were considered to be required to serve the development and are not included. See Exhibit C. D. Determination of Parcels to be Included in the Reimbursement Plan: All parcels within the delineated basin shown on Exhibit "E" were included in the calculations except those presently existing developments whi ch had been requi red to pay into the Rice Canyon Trunk Sewer Fund, school and park sites, and parcels either using septic systems or likely to use septic systems. School and park sites were not included because users would otherwise be assessed at their place of residence, and thereby eliminate the possibility of double assessment. The existing developments were not included in the dwelling unit total because they had previously paid into the Rice Canyon Trunk Sewer Fund. The dwelling units west of I-80S were included because no contribution was made by those developments to the Rice Canyon Trunk Sewer Fund. The fee for those units has been subtracted from the Ci ty' s reimbursabl e costs for facil ities constructed, thereby reducing the reimbursable amount due. Pa rc el sin the Lynwood Hill s area whether occupi ed by dwell i ng units or vacant have not been considered in the dwelling unit totals. Parcels with existing units are on septic tanks and may never connect. Vacant parcel s are small in number and may be allowed to use septic systems as well. Should any of the parcel s in the Lynwood Hills area or any area capable of connecting to the system (and not specifically considered such as an area outside of the gravity basin) connect in the future, those parcels will be charged the appropriate fee plus interest and the funds deposited in the City's general fund. The number of equivalent dwelling units was calculated by using the highest density of the density range shown on the El Rancho Del Rey Specific Plan times the acreages for that density range. The current specific plan submittal by the Gersten Companies indicates higher density than the present specific plan. McMillan has indicated that they wish to have this reimbursement agreement approved based upon the presently approved spec i fic pl an wi th no revision in the amount to be paid for each SPA if density is increased. E. Methodology: The same basic methodology used in the Casa Del Rey Reimbursement Di stri ct was used in thi s di stri ct for the type of improvements considered. Chapter 15.50 of the Chula Vista Municipal Code -3- /?~//S7J./ di scusses offsi te and excess capacity rel ative to reimbursement. During the processing of the Casa Del Rey District it was determined that offsite improvement costs should be spread between all benefited properties including the development which constructed the facilities. Onsite improvements were considered on the basis of excess improvements or improvements constructed beyond what was needed by the development to serve itself. Equi val ent dwelling units were determined by the method stated in IIIB of this report. See Exhibit D. F. Applicability of Assessment: The assessments calculated for this district shall be charged any properties within or adjacent to the service area as delineated on Exh i bit E whi ch are served by the subject trunk sewer, whether through gravity flow, by pumping or by virtue of land grading. G. Interest to be Added: To the base cost per equivalent dwelling unit there will be added simple interest at 7 percent per annum to be charged at the time of issuance of bui 1 di ng permi ts or connecti on to the subject trunk sewer. The interest shall be calculated on a quarterly basis and shall i ncl ude the total number of full quarters from the date of commencement up to but not incl uding the quarter in which payment of such charges are paid commencing on April 3, 1984. Six percent will be payabl e to the entiti es enti tl ed to reimbursement and one percent to the City to cover costs of contract administration. H. CONCLUSION The proposed reimbursement district encompasses the entire gravity basin shown on Exhibit E. Parcels included in calculation of the reimbursable amount are those which coul d reasonably be expected to connect to the subject sewer within the term of the reimbursement agreement. A parcel connecting to the subject trunk sewer will be charged the calculated reimbursement charge plus interest whether or not that parcel is included in the determination of the reimbursement charge. Reimbursement charges for each development shall be determi ned on the basis of equivalent dwelling units within that development. Costs were ei ther deri ved from actual bi d pri ces or confi rmed by the Engineering Department. -5- !?-//S7Y Chapter 15.50 of the Chula Vista Municipal Code was followed in detennining the amount of interest to be paid; the length of time the reimbursement agreement will be in effect; the improvements to be included and the process to be followed.
